SOUTHOLD TOWN BOARD

WORK SESSION

9: 15 A.M. - Cablevision Advisory Committee members James Dinizio, Jr. , Chairman,
and Richard Fevola met with the Board to review their recommendations for
amendment to the current Cablevision Franchise which expired at the end of May.
The committee submitted and reviewed a number of proposed amendments, which were
turned over to the Town Attorney, who was authorized to negotiate a renewal
franchise on behalf of the Town Board (resolution 33) .
10 : 15 A.M. - Planning E Zoning: Town Board reviewed the latest draft of the
proposed "Local Law in Relation to Lot Creation and Merger", and placed resolutions
(34 6 35) on the agenda for a negative declaration, and to refer the law to the Town
and County Planning Boards for recommendations and reports.----Supervisor
Wickham informed the Town Board that Franklin Rich is interested in selling his
property on the west side of .Peconic Lane to the Town. The parcel is directly in
the middle of the hamlet business area, and the majority of the Board felt the logical
use is, development someday, and would be an ideals parcel for the TDR process.
The majority of the Board expressed' no interest in purchasing the property by the
Town of Southold.----Board discussed the Geier petition for annexation. The tie
vote by , the Southold . Town Board on May 15th resulted in a denial of. the
annexation, and Town Attorney. Dowd advised that the Board must legally sign an
Order to this effect which must be recorded with the County' Clerk. The Order was
signed, but Supervisor Wickham said he would like to have another joint meeting
with the Greenport Village Board and discuss the . matter further, among other
matters of mutual interest.
11 :45 A.M. - Town. Policy Town Code: A proposed policy with respect _.,to
advertisements in newspapers was reviewed. Although Supervisor Wickham did not
see the need for - such a policy, other Board members felt display ads being placed
in the newspaper should be reviewed by. the Board for accuracy and content. It
was ultimately agreed that any . advertisement placed in a newspaper must be
authorized by Town Board .resolution (resolution 36) .----Another policy, proposed
by Supervisor Wickham, to administer personnel matters through the Accounting &
Finance Department was reviewed and placed on the agenda for a resolution
('37) .----Town Attorney Dowd spoke to the Board about a proposed Town Code
amendments concerning violations. The Code currently provides. only administrative
remedies for such violations. She suggested that failure to pay dump fees be made
a violation of the Town Code. Currently the monies are collected through small
claims court. The proposal was referred to the Code Committee.
EXECUTIVE SESSION
11 :25 A.M. - On motion of Councilwoman Oliva, seconded I,y Justice Evans, it was
Resolved that the Town Board enter into Executive Session to discuss possible
purchase of property and police hiring. Vote of the Board: Ayes: Supervisor
Wickham, Councilman Lizewski, Counclwoman Hussie, Councilman Townsend,

11 :55 A.M. - Recess for lunch.
1 :45 P.M. - Work Session reconvened. Solid Waste: Solid Waste Coordinator James
Bunchuck present. Board reviewed the proposal of Cameron Engineering, P.C. to
conduct engineering work at the Scavenger Waste Treatment Plant, and placed a
resolution (41) on the agenda to accept their proposal.----Town Board reviewed the
proposal of Dvirka and Bartilucci Consulting Engineers to conduct engineering
investigations of well relocations and filtration systems at the Landfill, and placed
a resolution (42) on the agenda to authorize the work.----Councilwoman Hussie
advised the Board that she has been getting complaints about illegal dumping, and
would like the Town Investigator to make this. part of his duties.----Solid Waste
Coordinator Bunchuck reported that they have just about completed the paving
project at the Disposal Area at about $30,000 of budgeted funds. However there
is an important area that has not been paved, and Corazzini has offered to pave
the area by a swap for the Town's stump buster which Mr. Bunchuck said is an
unused piece of equipment. The Town Attorney will determine whether this swap
would be legal.
2:15 P.M. Personnel: Town Board agreed to reappoint four members to the
Conservation Advisory Council (resolution 43) .---Recreation Supervisor Kenneth
Reeves met with the Board to discuss the, need for four additional lifeguards for the
summer so there will be two at each beach to assist each other should an emergency
occur. However, it was determined that the funds are not in the budget for two
lifeguards at each beach, so Mr. Reeves recommended lifelines at Kenny's Beach
and McCabe's Beach, a two-way radio communication system between those beaches,
cellular phones for the Lifeguards at Goose Creek Beach and New Suffolk Beach,
and megaphones for, the four one-lifeguard beaches. In addition he will check with
Insurance Consulant Mullen concerning the liability of using only one Lifeguard at
a beach.----Town Board authorized Town Clerk to advertise for members of the
Architectural Review Committee (resolution 44) .----Board appointed eight full-time
and three part-time Traffic Control Officers (resolution 45) .----Board set Tuesday,
June 6th for interviews of Landmark Preservation Commission member, part-time
Computer Equipment Operator, and.Cook.
2 :55 P.M. - Board discussed the Community Service Program, and correspondence
concerning same from Town Justice Tedeschi. Justice Tedeschi's memorandum
advised the Board that up until recently there have been very few problems with
the Community Service Program, however, the court is now restricted to assigning
people to the landfill': and a few to the Senior Program in Mattituck. He feels the
program has been a success, until about the last year, as a deterrent to youngsters
and as an excellent alternative to incarceration of the young defendants. He said
the Town must look to expanding the program, not minimizing it. He asked for a
ratification by the Chief of Police, Superintendent of Highways, and Supervisor,
similar to that contained in a letter dated August 14, 1981 , in fact he would like
the program to go one step further and requests that other department heads (who
are able to handle same) be asked to join in the program. Executive Assistant
James McMahon will meet with Justice Tedeschi and Justice Price to discuss the
program.----Board reviewed a letter from Ron Morizzo who asked permission to plant
a Weeping Cherry Blossom tree at the Silversmith Corner park in memory of the
children who lost their lives in the devestating bombing of the Federal Building in
Oklahoma City. Board agreed,Mr. Morizzo should be permitted to plant the
tree.----Supervisor Wickham presented a proposed resolution (46) endorsing the
Municipal Electric Utility Technical Committee established under the auspices of the
East End Supervisors and Mayors Association, accepting the procedure for
appointment of members to the committee, and nominating James I . Monsell and Albert
J . Romeril as the Town of Southold's two members of that Technical Committee.----
Town Board agreed to donate $1,000 to the America's Sail Event to be held in
Greenport over the 4th of July weekend (resolution 47) .----The Board reviewed a
proposal from PSD3 John Raynor for upgrading the statewide NYSPIN computer
system at Police Headquarters (see resolution 48) .----Supervisor Wickham reported
that several residents have, called his office regarding the replacement of the State
"Town of Southold" sign at the Town Line in Laurel which disappeared several years
ago. He will consult with Superintendent of Highways Jacobs and report back to
the Board.
3 :25 P.M. - Town Board reviewed the resolutions to be voted on at the 7 :30 P.M.
regular meeting.
3:50 -P.M. - The Town Board met with Timothy Gannon, Thomas H. Gannon and
Sons, Inc. , his attorney Eric Russo, and P.J. Corazzini, Secretary of Paul Corazzini
Jr. F Sons Inc. , with regard to the Micro-surfacing bid. Corazzini was the lowest*
bidder on this project, but Mr. Gannon pointed out to the Board that Corazzini
specified the Ergon micro-surfacing, whereas the bid specifications specify Ralumac,
and "no subtitutions will be permitted". After considerable discussion, the Town
Board agreed the fairest method would be to rebid the project, based upon new
specifications.

A Regular Meeting of the Southold Town Board was held on May 30,
1995, at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Wickham opened the meeting at 7:30 P.M. with the Pledge of
Allegiance to the Flag.

SUPERVISOR WICKHAM: We have quite a full agenda of things tonight.
.During the day we had quite an active series of discussions at the Work
Session. I'm not going to take the time to summarize any of that, because we
have quite a full plate tonight. At 8:00 o'clock we're going to interrupt
the resolutions to consider three different public hearings, that are listed
on your agenda sheet in front of you. Before we do that, we're pleased
today to have the members of the Southold Town Landmark Preservation
Commission with us. They have a couple of presentations they're going
make, and I'd like to begin by introducing Cliff Benfield, who is the
Chair of that commission.

CLIFF BENFIELD: Thank you. The business of the Landmark Preservation
Commission is to promote preservation, and restoration, of historic
buildings, structures, sites, and we do this through education, through
application, and by making aware of what we're doing by these awards. We
have two awards tonight, which will be given to the people who have done
exemplary work in the preservation and restoration of their property, and
for the first one I'll turn to Bob Bayley.
BOB BAYLEY: Before I read this, I'd like to point to the house I'm going
to talk about. This is a house in Orient. It's called the Cicero Breese
King House. It was built in 1890, and the owners are Dr. Norman and
Phoebe Cohen. The King House is a modest sized Victorian house with
typical detailing. . It i:s on Village Lane, Orient, a street of many splendid
old houses. Yet this house immediately catches ones attention because of its
striking Victorian earth-tone color scheme. Such was not always the case.
For many years the house sat quietly among its distinguished neighbors,
most of which were characteristically clad in basic white with green or
black trim. The .King House was originally built by Cicero Breese King,
a local businessman, in 1890. In 1966 the present owners, Dr. Norman and
Phoebe Cohen, purchased the house from Floyd King. Fortunately for the
Cohens, most of the original interior and exterior detailing was still
intact. The Cohens set out to restore the house as faithfully to' the
original design as possible. This restoration . included replacing a
deteriorated rear porch, chimney and asphalt shingled roof. Wood shingles
were applied.. When it came time to paint the exterior, the Cohens queried
the previous owner, who told them that, in his memory the house had always
been painted white, and so it was done. Normal maintenance required several
painting jobs, all white. A few years ago when it came time to repaint the
buildup of old paint necessitated the striping of old paint. Much to the
Cohen's surprise, as the painter Monte Rivera, stripped off the old
paint the original colors, which were not white, began to emerge, deep red
for the shingles, olive green for the clapboards and dark brown for the
trim. With this discovery, the Cohens plunged into research, consulting
with neighbors, the nearby Oysterponds Historical Society and doing
their own color tests. The decision was made to return the house to it's
original colors, with the exception of the dark brown trim, which proved to
be too gloomy. This use of color dramatically brings out the rich structural
features and trim detail so characteristic of Victorian design. The result
is a stunning building that improves the ambiance of historic Village Lane.
SUPERVISOR WICKHAM: This is the Southold Town Landmark Preservation
Award presented to Dr. Bernard .and Phoebe Cohen for the restoration and
preservation of their Victorian house.
CLIFF BENFIELD: The next presentation award will be made by John
Stack, our former Chairman.
JOHN STACK: The house I'm going to talk about is called the Wolf Pit
House, the Ellsworth Tuthill house, and several other things. But I would
like to point out one or two things. This is a picture that was taken from
the air, when it was a diary. It spent quite a few years as a very
prominent diary in Mattituck. This picture is what we call an Italianate
house. That's the way it looked after it was built in 1870. After 1902, when
that Tuthill was being married, he made a few changes, and it came out
looking similar to this. This model is a model that Ralph Tuthill made, or
is making, let's put it that way. I think it's a work in progress, isn't it,
Ralph?
RALPH TUTHILL: I didn't make it. It was started by Matt Tuthill.
JOHN STACK: The Wolf Pit House, the Ellsworth Tuthill House, Beth and
Frank lanno bought the Wolf Pit House September 1992. They immediately
started on the restoration. The family, Beth, . Frank and four children, three
girls and one boy, moved into their restoration challenge in August, 1993.
The Wolf Pit House has an extensive Tuthill history. It was originally
built to be a stately Italianate home in 1870 by Captain Ellsworth
Tuthill. In 1901 Capt. Tuthill's son, Nathaniel's first wife died. He
remarried and the house underwent enlargement and re-styling, to become
the present Queen Anne style. Much work has been done by the lanno

family. The foundations were shorn up and pointed. Windows were renewed
with sash of the same style as the originals but glazed with Thermopane.
The furnace was removed and replaced with an oil burner. The original
cast-iron radiators were saved, cleaned and re-used: A complete new electric
system was installed and plumbing system was updated. Flooring was
replaced where needed .and the under-house support timbers were either
strengthened or replaced. The entire house was insulated when the inside
walls were replaced. The 'cladding on the outside of the house remains as it
was when the lanno's found it. Attractive paint and stain were chosen to
restore the stately "Queen Anne" to her throne atop the hill at Wolf Pit
Pond. Now when the ice skaters and sledders- play in front of the house,
their red jackets and hats blend cheerily with the green trim and the green
gray, siding of the house to bring holiday charm to Mattituck winters.
SUPERVISOR WICKHAM: Southold Town Preservation Award presented to
Beth and Frank lanno, a pleasure for the restoration and the preservation
of the Queen Anne mansion in Mattituck. I thank- you. It's a pleasure to
have a family like that, that will do all the work to restore a house. I've
spent some little time in. that house myself years, and years, ago in the
fifties,. and I have a sense of how difficult, and what tremendous work that
really is, and how much cost. At the same time, we also hold something to
the families who lived there before, and I see two of them sitting right
behind you, and I wonder if, Ralph, you and Sandy would like to like to
just stand up. Families have lived in that house for generations, who have
looked after it.
CLIFF BENFIELD: Our next piece of business is to give recognition to a
Landmark, and it is my pleasure to ask Ralph Williams to make the
presentation.
RALPH WILLIAMS: . You sit there for a minute, Spark, I'll come over and
get you. Now, this one is interesting for a lot of reasons. One is because
of the heritage of the house. Another is because of the person who owns it,
and I'm not so sure whether the real landmark isn't the person himself. So,
in a sense, I'm going to be talking to and about Frank, a good personal
friend, and at the same time I'm going to read a little bit about this
house. All of you I. hope know where it is. I hope you know where
Champlin Place is. As you go into Creenport along Main Street, on the left
hand side, it's the second . street. Is .it not? It's the one that goes across
the bridge all the way over to the cemetery, which is on Manhasset. About
half way on the north .side is Sparky's house. I don't know if the picture
is going to help identify it. I hope you will find .it to be true, and I hope
everyone on occasion will go on Champlin, and -lookat the house, possibly
even stop, and say, hi, to :Sparky. This house, it turns out, the
Landmark Commission has more than a little bit of question about. The
question is largely between Bob and. Ralph. Bob tends to lean in one
direction, and Ralph leans in, the other direction, and we together agreed
that it's vital that the ' Town know how important this particular place is,
even though we can't say, we have an absolute history of the entire place
from it's beginning. As. 1 read here you may get the reasons why 'that's kind
.of true. As one drives by the Youngs/Coyle House today, it is clear. from
it's saltbox shape and spare detailing that this could be a very old house.
Yet there are no other houses bike it on Champlin Place. Upon closer
examination of the interior, one can confirm by the post and beam framing
through out and by the handhewn, pegged beams visible in the attic, that
indeed, that this house is very old and very important. A review of
historical material paintings and photographs in the , possession of the
owner, Frank Coyle and other historians, suggest that this house was
moved to Champlin Place from a nearby site at the head of Stirling
Creek. Now Sterling Creek is the one that goes on past the hospital, goes
across Champlin, as a - kind of culvert, wanders on up to Route 25. It
turns out, if you follow it by walking in the marsh, it actually crosses
Route 24. Okay? The head of Sterling Creek was where it was originally,
where it was once part of the large, prosperous, 17th Century homestead
of John Youngs, sone of the Rev. John Youngs, a founder of the Town of
Southold. Now 'you see where it's history comes from. The westernmost
portion of the Frank McIntosh residence, and those of you who were here
with us last year remember that we recognized. That's the big kind of
yellow decorative place located just north' of Manhassest Road on Route 25
and adjacent to Brecknock Hall, shows many similarities in shape, size and
detailing to the Youngs/Coyle House. This indicates, as historical

materials show, that both houses may have, been joined together forming the
heart of the Young Family Homestead.Here's where the problem starts. If the
two house were once together, why are they now apart? That got us into
some very interesting family history. A map of Southold, Shelter Island
and the Village of Creenport, dated 1872, shows a symbol for a house and
the label J .B. Youngs at the head of Stirling Creek, corroborating this
theory. Furthermore, no houses or names are shown in the present
locations of the McIntosh and Coyle houses indicating that they must
have been moved to their present locations. In other words, the old map
doesn't show the new locations. The old map shows yet another location from
which these two houses emerge. Further investigative work would be
important in substantiating the present theory for the sequence of events.
Investigation could focus on an archeological dig at the Stirling Creek
Site and an examination of the wood frame for hash marks, dimension, by
spacing, wall section, and rafter slopes to further confirm the proposition
the Youngs/Coyle and McIntosh houses were once joined and situated at
the head of Stirling Creek. This would further document their intriguing
histories. Now, the Commission has been through both houses. The.
Commission finds, that they were probably joined. We believe that. The
difference is, where did the whole thing start? Because some of us think
that maybe it started about 1660, or 1665, when another house, part of a
whole complex, living there at Sterling Creek, was the very beginning, and
was built on, and on, and on, and somebody came along, and cut the two
pieces apart. Frank has his piece, and the other Frank has the second
piece. I would like to ask Frank Coyle to come up. now, if he would, and
accept this designation. Last year we sort of, should have done it. This
year we have done it, and Frank, I personally want to start the thank
yous for the work you have done, for, your historically work in the town,
in Creenport the village, and here in 'the town, and all the work you have
personally done to make it rich for all of us.
CLIFF BENFIELD: History is all about us in Southold, and comes from
various places. As a matter of fact, I told Sparky, I told Ralph, this
evening, I had a phone call from an eighty-seven year old lady, who says
she was one of the sisters who was born two years after the houses were
cut, and she has her father born in 1892 from the Youngs family. She's
going to be here Thursday, so maybe we'll be taking her up to see you,
Sparky. She says she has papers, and some pictures. The next, and
final, presentation is historical landmark is the milestones. Now, the
milestones were set by Ben Franklin, and I can read that citation, but they
belong to so many people. They're on Town and County property, and the
individuals who live near the stones take good care of them, and the person
who deserves the most credit for bringing this to our attention was Bob
Long, who expired last year. . Bob was very interested, wrote a very
interesting book, and it appeared .. many places, and we're very lucky in
Southold to_ have probably one , of the best stretches of milestones in the
country. It's because of that, that we "felt it being worthy, as a historic
landmark, all of the structures that stand. Our only problem is we can't
give this award posthumously to either Franklin, or people that set the
stones, or the people who have these stones, so it sort of belongs to
everyone, and because it belongs to everyone, we'd like to make this
presentation to the Town, and especially to Judy. Would you please come
down? One of the oldest landmarks in Southold is a set of milestones that
mark the . King's Highway from the Courthouse in Riverhead to the ferry at
Oysterponds, now known as Orient Point. When they were emplaced by
Benjamin Franklin's crew in 1775, the millstones marked every mile from the
center of Riverhead to the Point, and all were in Southold Town. In 1792
the western part of the Town became a part of Riverhead Town, and sadly
the milestones along the highway were not maintained. Of the original 23
milestones, that were in place between 'Laurel and the Point, two are
missing,- and three have been replaced. All have been moved short
distances from their original sites to accommodate the widenings, and the
relocations of the roadway, that has served Southold's road over two and a
half centuries. That so many of the original markers are still in place is a
tribute to .the public spirit of the town. This is well exemplified by the
work of Bob Long who, in 1990 to 1991, organized a work group to locate
and reset all the milestones. As part of work he recorded the achievement,

he published pamphlet, Benjamin Franklin's North Fork Milestones. The Town
of Southold through the Board of Trustees, and the Register of Designated
Landmark recognizes and records these milestones to honor Franklin, and all
the townspeople who kept markers as part of their unique heritage. We
have it framed. We hope that you will keep it in the Town Hall somewhere.
TOWN CLERK TERRY: We certainly will find a suitable spot for it. Thank

CLIFF BENFIELD: .That about concludes our presentation. I'd like to
mention that we have another member, who didn't have an award to give
tonight, Bob Kassner, and Valarie Marvin, the other member of our
committee of our commission, who are not here tonight. We have an opening.

SUPERVISOR WICKHAM: I have to say this is one of the Town's most active
committees. They work long and hard. There is a lot of expertise with
engineering, architectural, and planning in various types of capacity.
They've really put themselves into it. It's a good example, I think, of a
group that has put a lot into it for the town. Thank you very much.
SPARKY COYLE: Before you all get seated, in 1950 when Supervisor
Klipp authorized a fellow by the name of Archie Young and myself to make
the list of these milestones all the way from Orient, which I had given to
the Secretary before. There's only one thing ' I'd like to see done now, after
1950, we had them all painted in 1950, with the numbers on them in 1950. It
would be nice if Southold Town found enough money that they could have
somebody do it now, when we're having all these' people come. out from the
city.

A. Merger. A nonconforming lot shall merge with an adiacent conforming
or nonconforming lot which has been held in common ownership with
the first lot at anv time after July 1 1983. An adiacent lot is one which
abuts with the parcel for a common course of 50 feet or more in dis-
tance. Nonconforming lots shall merge until the total lot size conforms
to the current bulk schedule requirements.
B. Definitions. Common ownership shall mean that the parcel is held by
the same person in the same percentage of ownership as an adioining
parcel.
C. Exceptions. Lots which are recognized under Sec. 100-24 and meet
any of the following categories shall be exempt from the merger
provision set forth above and shall not be deemed merged by
operation of this law:
j The nonconforming lot has a minimum size of 40,000 square feet,
or
22) The nonconforming lot obtained a lot size variance from the
Zoninq Board, or
3) The nonconforming lot has been held in single and separate
ownership from July 1.1983 to date.
D. Proof of Merger. The Town may require a person seeking determin-
ation of merger to provide any or all of the following documents for
evaluation:
11 Proof of the date when the lot was created and the size of the lot,
together with a copy of a legal description of the parcel, all to the

SUPERVISOR WICKHAM: I'd like to just briefly comment, the language that
you just heard from Joe is a lot of legal language that puts into place, if
we enact it, a series of steps to deal with the creation of lots. A lot of
lots have been created by deeds, and In other manners, for many years,
and a lot of those lots are in limbo, and have been treated differently by
different Town agencies. So, we have a Building Department, the Zoning
Board, the Planning Board, all of whom have had a little different take on
how to deal with those kinds of lots. This legislation is the outcome of a
whole series of meetings held by, those departments, and that our Town
Attorney had coordinated from the beginning, and I wonder if I can turn to
our Town Attorney, and ask her to just summarize briefly just what this law
does.
TOWN ATTORNEY DOWD: What this law does, is to recognize lots that were
created either by official action of the town, either through the Zoning
Board, Planning Board, or Town Board, or that were created by deed
before 1983, and that meets certain sizes. After 1983 all lots were expected
to have known that they had to go through the official Town process, and
have to be approved by the Planning Board, Town Board, Zoning Board.
So, that's how it deals with creation. The Town rules about what lots
merge, and don't merge, have been similarly unclear in the past, and this is
an effort to try to spell out clearly what are going to be the rules about

merging of lots, and the feeling was that lots had to be at least 40,000
square feet in size, or that they would merge. Alternately, obviously lots
that are held in single and separate ownership won't merge. So, it tries to
apply a lot of :practical standards I.ike that, yet it provides some kind of
relief if necessary by allowing the Zoning Board to grant that type of
relief. One of the advantages of this proposal is that in the past. you've
had to go to a whole bunch of old lists. We call them grandfather lists,
lists of old subdivisions, ' and- if you're on that subdivision you might have
your lot recognized, you might not merge, and we try to get rid of all these
old ancient lists, that are hard for people to get access to, and provide
clear and simple rules for everybody.

COUNCILWOMAN, OLIVA: This has been a townwide project of the Parks and
Beaches Committee, to look at all the road ends, and all the different roads
in town, to see what signs would be appropriate for these areas. This
particular law Is just to tell you what times, and what places, that you can
park, or can't park for one reason or another. It's very specific.

Is hereby amended as follows:
1. Section 65-1 (Policy) is here by amended by adding the following:
The Town of Southold provides bathing beaches and recreational facilities
and parking areas adjacent thereto at various locations within the town for the
use and enjoyment of residents of the Town of Southold. The Town also has
many road ends which provide access to the water. The use of such facilities
by persons other than residents has increased to such an extent that such
facilities have become overcrowded, with the result that residents are denied
the use thereof. The Town Board therefore declares it to be the policy of the
Town of Southold to restrict and regulate the parking of vehicles in the parking
areas adjacent to the bathing beaches, road ends, and recreational facilities
described in this chapter in accordance with the provisions hereof.

chloride and hydrochloric acid, but when they were built they were never in
compliance with Article 12, and Cameron Engineering will come up with a
proposal to tell us just how much it's going to cost, and what will have to
been done to bring these into compliance.

the use of land and the number of dwelling units the building is
designed to accommodate; and the necessary computations to
establish conformity to the bulk and density regulations.

the lot or neighboring lots as may be necessary to determine that
the proposed construction will conform to the provisions of this
chapter.
M An application for a building permit for construction on a vacant lot
which is not on an approved subdivision map shall be accompanied
by a certified abstract of title issued by a title company which shall
show single and separate ownership of the entire lot prior to April 9,
1957.
D. No building permit shall be issued for the construction or alteration of any
building upon a lot without access to a street or highway as provided by
Sec. 280-A of the Town Law.

E. No building-permit shall be issued for any building where the site plan of
such building is subject to approval by the Planning Board, except in
conformity with the plans approved by the said Board.'
F. No building- permit shall be issued for a building in any district where
such use is permitted by special exception unless and until such
approval has been duly granted by the board having iurisdiction thereof.
G. No building permit shall be issued for any building until approval has
been received from the Suffolk County Department of Health Services for
the proposed water supply and sewage disposal system.
H. The building permit application and all supporting documentation shall be
made in triplicate Upon the issuance of a building permit the building
Inspector shall return on (1) copy of all filed documents to the applicant.
I.' The Building Inspector shall within ten (10) business days after the filing
of a complete and properly prepared application either issue or deny a
building permit If a building permit is denied the Building Inspector shall
state in writing to the applicant the reasons for such denial.
J. Every building permit shall expire if the work authorized has not com-
menced within twelve (12) months after the date of issuance or has not
been completed within eighteen (18) months from such date. If no zoning
amendments or other regulations affecting the property have been
enacted in.the interim, the building Inspector may authorize, in writing
the extension of the permit for an additional six (6) months. Thereafter, a
new permit shall be required.
K. As soon as the foundation of a building or of any addition to an existinq
building is completed and before first-story framing or wall construction is
begun; there shall be filed with-the Building Inspector an accurate sur-
vey, signed by the person responsible for said survey, showing the exact
location of such foundation with respect to the street and property lines of
the lot. No further construction shall be performed until such survey is
approved by the Building Inspector. I
L. Permit fees.
M The following fees shall be paid upon the filing of an application with
the Building Inspector for a building permit, which fees shall be paid
into the general fund if the application is approved or returned to the
applicant if the application is denied:
La I Single-family dwellings:

dwellings: seventy-five dollars ($75.), plus twenty cents
($0.20) for each square foot of floor area in excess of eight
hundred fifty (850) square feet.

taxing entities or districts including but not limited to fire districts,

SUPERVISOR WICKHAM: We have another one on the Veteran's Exemption,
and in view of the questions that were raised about the language, let's hold
that one, and take a look at it.
TOWN CLERK TERRY: And Depot Enterprises change of zone?
SUPERVISOR WICKHAM: We'll hold on to that. The floor is open to members
of the audience, who managed to survive through this lengthy period, we'd
be pleased to hear from you.
ED SIEGMANN: Ed Siegmann, and I'm speaking for TaxPac. I guess
you all know that there's going to be a hearing Wednesday night at the Fire
Department in Mattituck, where they want to add an extension to the
building for $625,000. They just finished spending $200,000 on a piece of
equipment. They are talking about bonding out four hundred and some odd
thousands dollars of that $625,000. By the time you pay the interest on
that, I don't know how many years they want to bond it out for, but by the
time you pay the interest on that I think we're looking at somewhere around
a million dollars that will be spent. Before I go further in reference to
this, I want to make a couple of comments. Since when you approached the
Fire Department, or some of these other taxing agencies around here, it's
treated as if you are against motherhood, and you don't seem to get too
much done. In fact, I get the impression that most of these places don't
like to see anybody looking over their shoulder. I want to assure everybody
here, that we are not against firemen, we are not against the emergency
groups, we think they do a terrific job. I think that should have been
proven to the firemen, and to these emergency groups, when there wasn't
any real effort . put against giving them pensions. I think the people
recognized that they were entitled to something, they voted for pensions.
The fire group is the fastest increasing group as far as percentage of tax
increases. It's been 140, 1 think, over the last few years, and you have a
committee that's looking into this, and they did a very good job in
reference to looking into these taxing groups. But, as I listened here over
the years I'm convinced that there won't be any industrial business brought
into Southold, because people don't care for it. There won't be, besides an
industrial zone, I don't believe you'll have much business encouraged to
come into town. So, those things that would take some of the pressure off of
the people, as far as taxes are concerned we won't be able to get any
benefit out of that. The only thing that you'll be getting benefit out of is
additional residential people coming. in, where they're paying taxes, and
when they do that you wind up with having to give more services. You wind
up with having to build more classrooms, and you are behind the eight ball
with that one, also, as far as taxes is concerned. My main concern is that I
would hope someway before this million dollars is spent in Mattituck, I
would like to see someone bring the Commissioners together, if it's that
taxing committee, or if the Town Board could do it, and talk to them, and
find out if they wouldn't be willing' to have somebody come in here. When
say, somebody, I'm talking about even going to the City of New York, and
asking a Commissioner from the Fire Department there, or some people that
work for him, to come out here, and take a look at how fires are handled.
You know we have so much equipment. For example in Mattituck, you go
down the road a few miles, and you've got another load of equipment sitting
there. From what I've looked into, as far as the way the city operates, they
may have one fire vehicle spread around in all different places, and then if
there's a fire they'll sent two pumpers, and if that's not sufficient
they'll call on another firehouse to send a pumper out. I don't know whether
it works out here. I think it would. That if Mattituck, for example, had a
fire, and they had two pumpers out at the fire, and if they needed a third
pumper for that fire for some reason, why do they have to have a third and
fourth pumper sitting in their firehouse, and maybe only used every four,
five or six months, where you would need a third pumper? When they need
a fourth pumper, I don't know. I haven't, seen anything burn down out here
where you'd have a line of pumpers like that going. But, be that as it may,
why couldn't that get on their phone, and call Cutchogue, and say to
Cutchogue, we need a third pumper, send a pumper out. It seems there is
no cohesion among these fire companies because they're separated by that
imaginary line in between all of these towns. I would hope that these
Commissioners could be convinced that before they spend that they would do
something about bringing somebody in to take a look at this. Even get a
hold of LaValle, and ask if somebody from the State would come in, and
take a look at it. I think you could get people to come in, and look at it

without it costing you any money. I don't see why the City of New York
would say to you, that we won't send somebody out here to take a look at
this. I don't want to „go into the libraries today, but the same, thing could
be done as far as the libraries. You know, somebody may think that this is
something that shouldn't take place. I'll bet you those same people, that
are spending that kind of money here without looking into whether you
really need it, are the same people who voted in the last election, because
they wanted our people in Washington to stop spending money unnecessarily,
and to cut back on what is being spent. Those same people, that voted for
that, when you go to them, you have a hell of a time convincing them, that
they should look in .the. mirror, and take a look at their own taxation. I'm
hoping you can do something about it. They said, that they can build this
$625,000 extension without any increase in taxes. I'm going down there
Thursday night to find out how you spend $625,000 without adding new
taxes, because if that's possible you're going to see the damnedest
extension on my house 'that you've ever seen. Thank you.
SUPERVISOR WICKHAM: Would anyone else like to address the Board
tonight? I see Jean Cochran is here. Jean, you Chaired the Parks and
Beaches Committee, that came up with the recommendations that we acted on.
Do you want to make an comments on that?
JEAN COCHRAN: I would just like to thank the Board for their support.
The Committee. .it was a lot fun, because you'd go out with Ray Jacobs, and
Jim McMahon eight o'clock in the morning, and ride up and down these road
ends, and make the determination, and as Ruth said, I think it will solve a
lot of problems, and parking is still by permit, so it's not that we are
telling people that they can't park at the road ends at all. It is for a
limited time during the .year. Just one thing, as I sat through the Work
Session today, I would like to comment upon, and that is Silversmith
Corner. Being the liason between the committtee, and the Town Board,
at the time the park was developed, and there is a plan that shows where
future plantings could take place. One of the feelings of the committee at
that time was that there not be plaques all over the place, and that is why
there is only one monument within the park right in front of the gazebo,
and they just didn't want to see memorial plaques throughout the park.
SUPERVISOR WICKHAM: Where can we find a copy of that plan?
JEAN COCHRAN: Oh, golly.
TOWN CLERK TERRY: I'll look.
JEAN COCHRAN: There is room for several plantings. I just wanted to
bring that to your attention.
SUPERVISOR WICKHAM: Thank you, Jean. Would anyone else like to
address the Board tonight?
COUNCILWOMAN HUSSIE: I would like to address for the record. This
evening I abstained on two resolutions, number 19, and also, number 44,
which were concerned with advertising for the Architectural Review Board.
The Architectural Review Board has been .one of the items of discussion,
which has been quite a few months, I have been concerned about architects
on the Architectural Review Board. Today after the Work Session I went
home, and there was a message on my machine from the Attorney General's
Office giving me bare bones about the possible conflict of interest, that we
are creating here. He cited a 1970 opinion of the State Controller, that
said, an architect may not serve on the village Board of Architectural
Review. So, that given that bit of information I did not want to vote, yes,
and at the same time I didn't want to say, no, until I was sure.
COUNCILMAN TOWNSEND: May I address that? It would have been
helpful if you had shared that with us, or you didn't have it?
COUNCILWOMAN HUSSIE: When I went home this afternoon I found it.

COUNCILMAN TOWNSEND: I didn't want to speak out about that, but
since I'm batting a thousand I will. I can't think of any Architectural
Review Ordinance' I've seen, where they didn't have architects on the
Architectural Review Board. So, if this an opinion of the State Attorney of
the State Attorney General, there's an awful lot of towns in this state,
that are in contradiction of his opinion. Actually, what I wanted to talk
about was something different, if I could shift gears for a minute. The
issue brought up about the additional building in Mattituck, Mr. Siegmann
mentioned that he thought that the taxes had -gone up some 14% in the last
two or three years, and I think he is correct on that, but that also happens
to be the period of most moderation in those budgets. 1 think since 1984, or
'85, the amount of tax dollars raised by the fire departments has gone from
$800,000 to over $3,000,000. So, it's been $800,000 over $3,000,000. So,
it's been more like over 300% in the last ten year,,,., ..that i,t's gone up.
Everybody understands how great a job the fire departments do, that we
shouldn't be throwing stones, because I think we've gone up over 100% in
the same period. But; it is time to look at things, things that have been
considered sacrosanct. Do we need all that equipment? I have the same
feeling of pride, that people have on Washington's Birthday, when you watch
all this equipment go by, but there's millions and millions of dollars in
taxpayers' money going by, and is it necessary? Most of these departments
were formed in the 1800's, when you couldn't get from town to town.
Greenport has four fire companies going back to when the firemen pulled it
by hand. I think it is time to look at these issues. That's all I have.
SUPERVISOR WICKHAM: I'd just like to comment briefly on Alice remarks
about Architectural Review. Alice, these are things and issues, that I think
the Board had ought to get the benefit of your views about. If you felt
strongly enough to seek an opinion from the Attorney General's Office, why
couldn't you have brought it to the Board?
COUNCILWOMAN HUSSIE: I brought it to the Board quite some time ago.
SUPERVISOR WICKHAM: We have never heard it before until just now. Any
other comment that anyone would like to make? Ed?
ED SIEGMANN: I want to make a comment in reference to what was just
said about the fire departments. You know there's a percentage, that they
collect every year on your taxes, _that are specifically earmarked for
building and grounds, or building and equipment, whatever it's called. That
money gets put in there, and builds up, and builds up, and you know what
happens when you have somebody see a lot of money sitting in the thing. It
burns a hole in somebody's pocket, and they say, hey, let's spend it on
something. For example, when they buy a new piece of equipment, a
pumper, even though that pumper can be twenty years old, you got to look
at the mileage that was on that pumper, because when they sell that pumper
here, that goes to another town. Now, if another town can use that pumper,
and it falls under Underwriter's permission, then why does it have to be
sold? Is it because that money is sitting in the bank, and somebody thinks
you've got to sell it. These are the things that have to be looked at. Is it
being bought because it's needed, or is it being bought because the money
happens to be there?
Moved by Councilwoman Oliva, seconded by Supervisor Wickham, it was
RESOLVED that the Town Board meeting be and hereby is adjourned at 9:25
P.M.
Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva,
Councilman Townsend, Councilwoman Hussie, Councilman Lizewski,
