Hussie, Councilman Joseph L. Townsend, Jr. , Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Town Clerk Judith T. Terry, Town Attorney Laury P. Dowd. 9 : 10 A.M. - Supervisor Wickham presented a report on the Peconic County Financial Feasibility Study draft, prepared for the East End Economic and Environmental Institute, Inc. , and funded by the east end towns. Each Board member received a copy of the report, and one is on file in the Town Clerk's office. 9 :45 A.M. - Solid Waste Coordinator James Bunchuck and Recycling Coordinator Mary Jackson met with the Board to review the rough draft for the Waste Watch newsletter due to be printed shortly. Ms.. Jackson reported that Marcal Paper has agreed to extend the date on a purchase rebate to August so the Town can participate, and the information will be included„ in the newsletter.- -Mr,. Bunchuck discussed the proposed Consent Order to the Suffolk County Department of Health Services with regard to the two oil storage tanks at the Disposal Area. He and Town Attorney Dowd met with a County representative recently to explore ways to correct the problem, and Mr. Bunchuck proposes to remove the existing tanks and replace them with pre-approved tanks and the"Ibbunty agreed. See resolution no. 25 authorizing the Supervisor to execute the Consent Order.----Mr. Bunchuck explained to the Town Board his proposed modifications to the recycling drop-off area at the Collection Center. 10:40 - William Boylhart, President of Land's End Property Owners Assodiation, Orient, met with the Board to request . a waiver of landfill tipping fees for brush and vegetative matter to be brought to the Disposal Area once they have formed a road improvement district and begin work bringing the roads up to the Town specifications. It is anticipated' the cost to do the entire road improvement project will be over $90,000, and the association is petitioning the Town Board for a reduction in cost by way of a waiver of the tipping fees for brush. A resolution (26) was placed on the agenda to grant the waiver provided the district is formed. 10:55 A.M. - The Board discussed the bids received for the clean-up of the Fishers Island Metal Dump. Councilwoman Hussie and members of the Solid Waste Task Force, William Cremers and Councilwoman Oliva, analyzed the bids and Tri-S (Ensa) and Action Remediation Co. are the two lowest bidders. Before a decision is made, Justice Evans will discuss the 'work plan of each bidder with the Fishers Island Ferry District. 11 :00 A.M. - Personnel: Town Board set 3:00 P.M. , Tuesday, April 25th to interview applicants for part-time" 'Ordinance Inspector, Tax Receiver Clerk, and Town Investigator, and 3:00, April 27th to interview part-time Data Processing Equipment Operator, and Planning Board member.----Appointed Joseph Fischetti (resolution no. 27) as Southold Town's representative to the Calverton Joint Planning & Redevelopment Commission. 24 APRIL 18, 1995 11 : 10 A.M. - Linda Fletcher, representing the North Fork Environmental Council addressed the Board concerning the proposed construction of a McDonald's in Mattituck. Ms. Fletcher asked that a Stop Work Order be placed on the project until a full investigaton can be conducted. She asserted that a Code violation exists, since the Board of Appeals issued a Special Exception, good for six months, and only permits a six month . extension. Other NFEC representatives expressed their concerns as well. During the discussion a letter was received from William Esseks, attorney for Cofam Realty Co. , stating that approvals were granted by the Board of Appeals, Planning Board and Building. Inspector for the construction of a McDonald's restaurant and subsist for said parcel. He ask that the Town Board not take any action until his office ha`s' had further opportunity to review the Town files and be present at a Town Board meeting and appropriately present his client's position. The Town Board declined to discuss the matter further and entered into Executive Session. EXECUTIVE SESSION 11 :40 A.M. - On motion of Councilwoman Hussie, seconded by Councilman Lizewski, it was Resolved that the Town Board enter into Executive Session to discuss possible litigation and personnel matters. ' Vote of the Board: Ayes: Supervisor Wickham, Councilman Lizewski, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva, Justice Evans. Also present: Town Clerk Terry, Town Attorney Dowd.---- The Board met with Board of Appeals members Lydia Tortora and Robert Villa to discuss possible litigation.----The Board met with Assessor Chairman Scott Russell to discuss personnel matters. 12 :45 P.M. - Recess for lunch., 2 : 15 P.M. - Work Session reconvened and the Board discussed a recommendation of the Board of Appeals for a change in the Zoning Code under the bulk schedule pertaining to the minimum front,,:y.,ard setback requirement in the R-120, R-200 and R-400 columns to be 75 feet instead of 60 feet. The proposal was referred to the Code Committee-----Supervisor Wickham reviewed his notes from a meeting with school officials on March 13th, which was called to explore the needs of youth in Southold Town and how to best address those needs. Among the suggestions offered at the meeting were: (1) Consider having specialized consultants review the community over a short perod of time; (2) consider working directly with families; (3) consider a coordinator who would help a school address the issue. - It was agreed that Supervisor Wickham will sit down with a few key people and come up with a formal proposal for the Board's consideration.----Request from .the Greenport- Southold Chamber of Commerce to use the parking field in the business section of Southold for a craft fair on May 27th - Board-agreed :(resolution 28) . 2 :55 P.M. - John Sullivan, Chairman of the Board of Assessment Review, met with the Town Board to request an increase in the board's compensation this year. After considerable discussion, it was agreed to increase the budget from $3, 120 to $4,000, which would mean an increase from $624 to $800 for each member (resolution no. 29) .----Town Board agreed to the appointment of Jonathan Wiggins and Jess Wolf to the Board of Assessment , Review to fill two . yacanci.es (resolution no. 30) .---- Senior Accountant John Cushman met with the Board to discuss . a proposed Local Law electing a retirement incentive program for certain targeted Town employees. The purpose of the law is strictly to reduce payroll costs. At the present time there appears to be three possible retirements as a result of the incentive (resolutions 31 & 32) . EXECUTIVE SESSION 3 :40 P.M. - On motion of Supervisor Wickham, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter into Executive Session to discuss personnel and possible litigation. Vote of the Board: Ayes: Supervisor Wickham, Councilman Lizewski, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva. Also present: Town Clerk Terry, Town Attorney Dowd. 4:25 P.M. - Work Session adjourned. 25 REGULAR MEETING The Regular Meeting of the Southold Town Board was held on April 18, 1995 ,at the Southold Town . Hall, Main Road, Southold, New York. Supervisor Wickham opened the meeting at 4:30 P.M., with the Pledge of Allegiance to the Flag. Present: Supervisor.Thomas H. Wickham Councilman Joseph J. Dowd SUPERVISOR WICKHAM: The Town Board has been occupied today at the Work Session since 9:00 o'clock' this morning. We just finished a few minutes ago. I hope you had a chance to pick up an agenda outside. I see some, copies of it, -so it's probably there. The last-page is the order of business of the items for discussion, that we took up during the day. Some of them have turned into resolutions that we'll be taking up and considering this afternoon. Anyone like to move the audit of bills? We do have a series of thirty some resolutions in front of us, and rather than my taking any time to summarize the discussions of the Work Session today, I think we'll move directly 'into -the resolutions, so we'll have some time left over at the end to have discussions, and comments from the audience, or from other Board members,. It's an opportunity before we move into the resolutions for members, who come to attend meetings to address the Town Board on any one of the resolutions, that is in front of us. We allocate up to five minutes per person per comment, that you would like to make on any of the resolutions before us. The resolutions are listed there in the agenda. Yes, Mr. Carlin? FRANK CARLIN: Frank Carlin. Number 21, what kind of investigator? SUPERVISOR WICKHAM: The Town Investigator, is this? FRANK CARLIN: What kind? SUPERVISOR WICKHAM: You ,will recall that the Town Board...has followed a rather torturous path in the last six months to find an Ordinance Inspector, or a Code Enforcement Officer, and this is the latest iteration of that particular route that we're taking. FRANK CARLIN: You mean as Ordinance Inspector? SUPERVISOR WICKHAM: It's like that, yes. Are there any other questions, or comments about any of the resolutions that the Board is about to take up? (No response.) If.,not,, I'll launch into th_e first one. APRIL 18, 1995 y 23 1 .-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was .RESOLVED that the Town Board of the Town of Southold hereby appoints Joyce M. Wilkins as Secretary for the Southold Town Landmark Preservation Commission, effective immediately through December 31, 1995, at a salary of $7.50 per hour, not to exceed five (5) hours per week in addition to her regular 35 hour work week, regardless of the number of committees she serves. 1 .-Vote of the- Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 2 .-Moved by Councilwoman Hussie, seconded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Thomas Wickham to execute a Contract Budget Modification Request to the Suffolk County Office for the Aging for a change to the Expanded In-Home -Services for the Elderly Program (EISEP), which modification results in a zero net change. 2 .-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, .Councilwoman Hussie; Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 3.-Moved by Councilman Lizewski; seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Thomas Wickham to execute a Contract Budget Modification Request to the Suffolk County Office for the Aging for change to the CSE Home Chore Program, which modification results in a zero net change. 3.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, .Supervisor Wickham. This resolution was duly ADOPTED. 5.- Moved by Councilman Townsend, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Thomas Wickham to execute agreements between the Northeast Document Conservation Center, Andover, Massachusetts, and the Town of Southold, for conservation treatment of four (4) volumes of historical Town records, at a cost of $7,395.00, . to be paid through the Town Clerk's Local Government Records Management Improvement Fund grant. 5.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 28 APRIL 18, 1995 6.-Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was .RESOLVED that the Town Board of the Town of Southold hereby authorizes the closure of Love Lane and Pike Street, east and west of Love Lane, Mattituck, from 8:30 A.M. to 4:30 P.M., Saturday, .July 8, 1995, to permit the Mattituck Chamber of Commerce to hold their 18th Annual Mattituck Street Fair, provided they file with the Town Clerk a One Million Dollar Certificate of Liability Insurance naming the Town of Southold as an additional insured. 6 .-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. B.-Moved by Councilwoman Hussie, seconded by Supervisor Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Thomas- Wickham to execute Spring 1995 Recreation Program agreement with James Mikelbank, Friday Night Gym Program, $17.00 per hour; and Glen Stegner, Basketball Workshop, $17.00 per hour, and Teen- Nights, $15.00 per hour; all in accordance with the approval of the Town Attorney. This resolution was duly ADOPTED. 13.- Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the issuance of free beach parking permits to the following summer employees: Water Safety Instructors, Beach Attendants, Lifeguards, Beach Manager. 13.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 14•-Moved by Justice Evans, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Southold Town Beach Attendants to be supplied with a petty cash fund in the amount of $34.50 (2. rolls quarters, 2 roll dimes, 2 rolls nickels, 1 roll pennies) per Beach Attendant, to enable them to make change due to tax that is charged for each permit; check in the amount of $207.00 to be made payable to Recreation Supervisor Kenneth Reeves; charge to be made to A210, Petty Cash. 14.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 15.- Moved by Councilman Lizewski, seconded by Justice Evans, it was RESOLVED that the Town Board- of the Town of Southold hereby commences the Lead Agency Coordination process with regard to the State Environmental Quality Review Act in the matter of the petition of Strong's Marine, Inc. for a change of zone from R-80 Low Density Residential District to M-1 Marine District on certain property located on James Creek, west of Camp Mineola Road, Mattituck, New York. 15.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 16.- Moved by Supervisor Wickham, seconded by Councilwoman Hussie, WHEREAS, a petition has been received from Strong's Marine, Inc. for a change of zone on certain property located on James Creek, west of Camp Mineola Road, Mattituck, New York, from R-80 Low Density Residential District to M-1 Marine District; now, therefore, be it RESOLVED that the Town Clerk be and she hereby is authorized and directed to transmit this petition to the Southold Town Planning Board and the Suffolk County Department of Planning "all- in accordance with the Southold Town Code and the Suffolk County Charter. 16 .-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman . COUNCILMAN TOWNSEND: This resolution does not appear on this agenda, but I promised I would bring it forward this week, and I intend to do so. Last meeting I stated., all the reasons I thought we should hire policemen for the Town of Southold. This week, once again, we got a letter from the Chief pointing out how far down we are in personnel. We have not yet replaced officers, that are working in Creenport, and so I'm going to put that resolution before the Board, even though I don't think I'm going to get it passed. I won't go over all those reasons, that I said again, but I would to propose the following officers from the preferred list. All officers in the order have not been included. APRIL 18, 1995 35 COUNCILWOMAN HUSSIE,: . , „Qvr advisors, both our Labor Management Advisors, and our legal advisors, have asked us to wait. We have not yet received the definitive word from Civil Service, and there are other matters that are unresolved. There was a discussion about doing a pending certain other things happening. Whatever the certain other things that are going to happen are, they have not been accomplished. I- have seen nothing in writing. I've heard a lot of things, but I've seen nothing in writing. I think it's precipitous. This does not mean to say that I don't think that we need to add to our Police Force. I definitely do. Have for .a long time, but I think we have to be careful. SUPERVISOR WICKHAM: Anybody else on the Board like to address this issue? COUNCILMAN TOWNSEND: Week after week it's been one thing or another, and each week it keeps changing, and I just feel that we have to address the issue, because -we • have a public safety issue, and that's my position. I know that some of the other Board members are doing this, and I'm not doubting their. motives, but I just feel just that the safety issue outweighs the other, and I think that waiting does not help any of the other issues. SUPERVISOR WICKHAM: We have a motion on the table, is the Board ready to vote? FRANK CARLIN: Being as this is a resolution, can't I speak about it? It wasn't on the agenda. SUPERVISOR WICKHAM: That completes the resolutions that the Board has taken up this afternoon. It wasn't clear to me, that this one was going to be on the docket, and that's why it wasn't there before, but we have no hearings for this afternoon. . The Board is at the disposal of the audience, would be pleased to hear any comments within a five minute time frame. Mr. Carlin? FRANK CARLIN: I'm coming up again, Tom, maybe three times if necessary. I'm not here to speak for the Southold Police Department, I'm here to support it. I can't speak for everybody, but I can support it. You know, back in 1990 we 'had forty-two Police Officers. We had nine in Creenport, plus five part-time in Creenport. A total of fifty-one officers in 1990. Now we have thirty-five. I come from a long family of Police Officers. I'm not here speaking because they are a part of my family way back, my grandfather, my brother-in-law. My uncle was an ex police commissioner of New York City back in the '40's, my brother in Maryland, some are retired. Sometimes we get to discuss cases, ex cases, that happened. One of the most critical one, believe it or not, is to respond to a house, domestic dispute, between a husband and wife. It doesn't seem much, but it can be critical, because I'll tell you why, because sometime when the officer goes to arrest the husband, the wife she turns on him. She don't want him to go. So, the officer alone can have a problem. That's one case where a back-up man comes in handy. Many a times a back-up men come in handy on the Police Department, many a times. I'll give you another example. This is back in 1950, late '60s, I'm not sure, I'm not going to mention the Police .Officers name, but I will tell you if you want to know, and I'll tell the Chief. You probably know who I mean. A Southold Police Officer responded to a labor camp dispute in Cutchogue, and they ganged up on him, and '"he was in trouble:- Lo 'and behold, before he responded in called for a back-up man, and that one back-up man came, and he survived. Without the back-up man he would have been in a lot of trouble, and serious trouble. That goes to show you how important it is to have enough police officers, and what we're going to do here is, we're going to wait till the summertime, until fire starts going here, in Creenport when people start moving in, and all the action is spots. We're going to realize that we do need police officers, but we might not get them. There might not 36 APRI,L 18, 1995 be any from the academy. It takes sixteen weeks to train them. You just can't find them from the sky sometime. That's what might happen, and another thing is, I want to .mention too, is Lord forbid if a disaster happens, or a police officer gets injured due to lack of policeman, the Town Board is ,going to have some explaining to do. It ain't easy being a policeman. There a lot of pressure. I don't want to get into that right now. But, I take my hat off to the policemen, but they need more, and my number set. We need seven at ' least to bring us up to. .and that's only giving us forty-two without even the nine we had in Greenport. We need seven. Tom, when I was in the service, and remember the time we would get paid every payday, you'd see groups, I never done it though, only time I gamble is when I play Lotto, but in the Army they used shoot the dice. I'd hear seven, keep that in mind, seven, seven, seven. We want seven, we're going to have seven. Get what I mean? Anyway, we're waiting too long for the cat to get out of the bag, and we ain't going to catch him. We need seven, at least seven to do the job right. We had, forty-two in 1990. We had nine in Greenport. We can't do it with no less than forty-two. I'll tell you're taking a. chance, and if you gamble, what you're doing is you're gambling with money on people's lives. Don't do that. You are an intelligent Board, and I give you credit when it's due. I want to give you credit to see if you hire policemen, but hire 'enough, and do it now, because if you wait it might be too late, and you're going to be in trouble. SUPERVISOR WICKHAM: Thank you, Mr. Carlin. Anyone else like to address the Board on any matter of your concern. WILLIAM SWISKEY: William Swiskey, 184 Fifth Street, Greenport. I happen to be a Town taxpayer, too, and I've seen a couple of things in the papers the last couple of weeks, and I think this Town Board is heading for a serious lawsuit. The gentlemen on the Grand Jury didn't indict anybody. There wasn't enough evidence to prove anything. Most of it was hearsay. Some of it came from people that were dead. So, let's live within the realm of facts. You can't exclude somebody unless you've got something specific that you can prove. If you can't prove it, don't invite a $5,000,000. lawsuit. So, the list is one, two, three, four, as far as I'm concerned, as far as Civil Service is concerned right now, and that's the only way to go, unless you've got something you can prove against somebody. Otherwise, shut up and don't put it in the paper, please, because I find that disgusting. Thank you. SUPERVISOR WICKHAM: Is there anyone else who would like to address the Board on any topic this afternoon? Mr Capon? CEORGE CAPON: This has nothing to do with the proposed budget, it's something I'd like to bring up today. My name is George Capon. I live in Greenport. I am resident of the East-West Fire District. In 1994, the Southold Town Board past the Service Award to the Greenport Fire Department of paying 460 of the whole thing. Am I right there? SUPERVISOR WICKHAM: Approximately. GEORGE CAPON: The Village Board voted on August 16, 1994, that is the Village people voted to pay 54% of the Creenport Fire Department Award System. In the Suffolk Times on April 13, 1995, Mayor Kapell is proposing to take $86,000. out of the East-West Fire Protection to pay for .the Greenport Award. System, which would mean that the people that live in the East-West Fire District would pay 1000 of the Award System. I think it's time that the Town Board get a.. .hold of Mayor, set down the rules. There's too much going on that the Town Board is favoring everything, I shouldn't say everyth.ing, Kapell is, but a lot of things that Mr. Kapell. I'd like to give you the paper, 'if 'everybody has not read the Suffolk Times. SUPERVISOR WICKHAM: We'll look into it, George. GEORGE CAPON: You said Pyou would look into it. I think it should be looked into before the youth start to work on to it. I realize, that maybe the Village can..take that money, and do what they want with it, but still don't think the 'people that live in the East-West Fire District should have to pay 100% where the Village taxpayers did vote on August 16th to pick up the 56% of it. Thank you. APRIL 18, 1995 7 SUPERVISOR WICKHAM: We'll look at that. Anyone else like to address the Board on any topic of your interest? Yes, sir? PHIL VANBOURGONDIEN: My , name is Phil VanBourgondien from Southold. Coming back from vacation I find it very depressing to see so many empty stores in the town of Southold. They weren't that way when I left. I have also noticed that there are hundreds of homes for sale, including four in my own small neighborhood, and there were three additional that were sold just during the winter, and last fall. So, there seven houses in just the small little neighborhood, that I live in. The realtors that I talk to sa,y, that home sales are very slow. Empty store, what's wrong here? What's going on, that this town is becoming such a depressed area? First of all, I might add that in today's Farm Bureau notice I got, the tax burden on, New Yorkers we rank number one in the nation. As a state, we are taxed number one out of fifty states. We are raising taxes. We're raising fees. We're increasing spending. We're hiring all the time. We're having new committees. Our only solution is going to be to lower taxes, reduce the spending;,.�,and shrink local government. In Washington, Governor Pataki, they're all trying to do just that, and we should be doing that also. Let's start with some suggestions I have. A hiring freeze in all departments' of the Town. Reduce the budgets of all of the departments. Unilaterally reduce the budgets five percent, or ten percent. Don't say it can't be done. I just spent several months in Sarasota, Florida, Bradenton. They are in the same boat we are, and they just said, everybody, every department 100, and they've made it work. They got along with it. Why not hire a working full time Tax Receiver? Not have a political appointed one, but a full time working Tax Receiver? I don't always agree with Dr. Lizewski, but he is correct. It is almost impossible for any good commercial light industrial, or small business to get. started. in Southold. I just recently heard, after I came back, of a company that couldn't wait the six to twelve months to get all the permits together in Southold, and so they went to Brookhaven, and set up their company, a nice clean industry, employed one hundred fifty people. They wanted to come to Southold, but when they were told by a lawyer in this town, that is was lengthy, long, process, they said, we can't wait, and they went somewhere else.. e ,Permits are too ...complicated. They're too time consuming, and they are too expensive. Every time you turn around it's a different permit for something else, and the fees keep going up. Water hookups, I know two people who built homes. They were told they had to pay $5,000.00 to Greenport, to put in the water main, to hook up. They bargained down some, but it was still thousands of dollars. One man couldn't move into his house for over six months, because he was fighting that. That's an astronomical amount of money, and they tell you, the Department of Health says you can't put your own well in, you must hook up to Greenport for a $5,000.00 fee. There's something here. Environmental problems, zoning and planning, Health Department, DEC, every time a person wants to do anything in this town, they turn around and they're socked with something else. Another department, another group has to put there two cents into everything, and it just delays, and . makes it so complicated, that there is no one who wants to live here, move here, build here. Just a further note on this public safety issue, that was just mentioned, and the Civil Service, isn't . it pathetic that we have a Civil Service Law that makes it mandatory that you have to take the people on the top of the list all the time? I'm not trying to fault with the situation with the Greenport Police, or with Southold Police, but it's a shame for the whole State, when that •law. was put through. The other thing, that surprises me is, I'm under the impression that we're so thin on Police that the sector cars at night,,.,there's one car to .a, sector. Am I correct in that matter? And I come home from `the west end frequently at night from visiting my children, and I find it positively unbelievable that every Police car I see, there's not one, there's two, sitting together talking. Now, how can they be in their sectors, if there's only one car? -If,, . SUPERVISOR WICKHAM: I'd like to address that. PHIL VANBOURGONDIEN: I'm finished, Tom. I just put that out as a thought. I will add that in Sarasota, Florida, they have the Sarasota Police, they have the Sheriff's Department, and they have the Florida Patrol. All three departments circulate throughout the city, and the County of Sarasota, I have not yet to see, I have yet to see two cars of any 3 APRIL 18, 1995 department chatting away. They are always on the move. They're traveling around. I think they're getting good service for their buck. I thank you. SUPERVISOR WICKHAM: This issue of having two Police cars coming side by side, the occupants talking, has. . l think you've .mention it a couple of time, and other people have picked up on it, and I have explored this with our Chief of Police, and the reason for is, that you're right, we have one Police patrolman in each sector.,.. .but we also have one Sergeant who's job it is to supervise, and keep in touch with all these people, and this Sergeant is in one car, and it's a roving car. His job is to touch base with each of these patrolman in the 'different sectors, and keep in touch with them. You can identify the Sergeant's car, it has yellow stripes on the side, unlike the patrolmen's .car, which just has a normal Town insignia. So, the next time you see these two cars, see if one of them has yellow stripes on the side, which is the Sergeants • who's doing the job of supervising the patrolman. I can't say how much time they spend doing that, and the value of it, and all of that, but it is a legitimate, and an important part of the police function, the supervisory function. PHIL VANBOURGONDIEN: I agree with you. If that's the reason I think that's perfectly acceptable. If it isn't then I think there's something wrong, when they are out of their sector. SUPERVISOR WICKHAM: I was very interested in your comment about this firm that relocated in Brookhaven. I'm surprised. I'm not surprised (tape change) I'd like to help the firm. I'd like you to share with me, if you would, the name of this firm, and afterwards I'd like to know a few more details about it. Are there any more questions from the people in the audience today? Mr. Carlin? FRANK CARLIN: Frank Carlin, ' 'Laurel. A few of my comments will reflect back on this gentleman's last comments here. Before I start, as far as I'm concerned I'd like to see -the whole North and South Fork become all Suffolk County Police. Do away with all the towns, all Suffolk County Police. I don't know what you're thoughts are on this. I can't read your mind, but I review last week's newspaper about the McDonald's from the NFEC. You know it's so strange that we.,,have all winter to come up with one of these ideas, and now that the fire is starting to blaze now, they're trying to come along with a fire extinguisher, and put it out, with my opinion an empty fire extinguisher. You know, we had the okay from the Zoning Board of Appeals originally. I. don't want to go into all this. I'll just briefly bring myself up to date with it, too. We 'went through this a few years back with the Zoning Board of Appeals, with McDonald's. Okay, but no drive-through window. Okay, that was that one. Then Burger King came along last year, and it was approved by the Planning Board. Everything was all right. They did start to dig ground a month after. There's one picture. There's another picture. They did try to do some work. They had a bulldozer. Here's another picture here. I got three of them here. Here's the foundation being put in. They just started to do work there. They tried to anyway. You know, that's the reason why. . one of the reasons is exactly what this man said here. We have something that wants to come into this town, but we don't it. Now, I don't know if you don't want it, but seems to me that NFEC doesn't want it. I don't . know what that got to do with any environment here. But, I'll tell you another thing, McDonald's has got some good lawyers, and if something .were to 'happen.,.her.e, and something changed here, and it goes to litigation, don't use an outside lawyer at $125.00 an hour to fight this thing in court, like you did to Charlie Zara's case, to the cost of $140,000. We've got a . Town Attorney here, that can give legal advise for the NFEC. She. could fight that in town, but don't use my money, and don't use the taxpayers' money, as a habit. I don't know what your thought is on this latest thing that was in the newspaper here. Another thing do you realize what good McDonald's, what they do for children, or don't we care? The Ronald McDonald Foundation, they support sick and homeless children. They give to Little League baseball teams. What's wrong with that? What do we want in this town? We have a chance to have a business, and we don't want it. I'll challenge Mr. Goldman, NFEC, if he wants to debate me on this issue, we'll go on public television, one on one, and we'll have it out .once and for all, because I'm sick. and tired of it. I want to know who's running this town, they or you? If they think they got a case, let them get their own lawyers. Don't use our taxpayers' money, in case this thing goes to court. Our taxpayers' money at $125.00 an APRIL 18, 1995 39 hour, let them buy their own. I'm getting tired of it, and I ain't giving up. I'm not a weakling. I don't give up easy. I don't know what your opinion of that last letter in the newspaper was, but I want to leave you with one thing, Tom. I could say more, but I don't want to. But, I want to refresh your mind, and that,'s it. I got other stuff I'd like to talk about, but I won't tonight. I just want to refresh your mind, Tom. Last year what you said in the local newspaper right here, and I want to read it to you, and I read it to once , before. This wa-s - in November 18, 1993. Supervisor-elect Tom Wickham has said, that he would not have a problem with a fast food outlet. Now, it says a fast food outlet. Doesn't say McDonald's or Burger King. Being built in Southold providing it conforms with Planning and Zoning Board requirements. I'm sorry to say, it does, and it did. Tom, remember that. SUPERVISOR WICKHAM: I still feel that way. FRANK CARLIN: Good. I'll take my hat off to you, if you stay that way, because then you show me that you're a man who can make a statement, and stick by it. SUPERVISOR WICKHAM: Anybody else who would like to address the Town Board on any matter of your concern this evening? (No response.) If not, I'd like to turn to the Board. Sometimes Board members have things on their minds. COUNCILWOMAN HUSSIE: This Board member does, and I've got my voice back, again. Isn't everybody happy? I know that two studies came out in the last week. One was 'on Peconic County. The other one was the feasibility study of the five towns breaking away from LILCO. We disci4ssed Peconic County. .this morning, but we didn't have an opportunity, I guess, to discuss LILCO, but. I do want to tell those of you who are interested in this, those of you who are interested in bringing costs down. You mentioned Mr. Van Bourgondien about the taxes, I tell you, if you could reduce your LILCO by, 300, that would be a considerable sum. You might even be able to stand the taxes. Nevertheless, for those of you who are interested, Thursday, this Thursday, day after tomorrow, at 4:00 o'clock in. the Ramada Inn in Riverhead, everybody is getting together with the experts, the lawyer, the engineers, and whoever else there are, who wrote this feasibility study, to answer any questions that you might have, I might have, we might have. You are all invited. That's one thing that I wanted to say. SUPERVISOR WICKHAM: Joe, do you have any comments? COUNCILMAN LIZEWSKI: No. SUPERVISOR WICKHAM: Alice referred briefly to the Peconic County study. I have a copy of it. It was just released about a week ago. It's a draft study about the feasibility of a reformulation of the County structure on Long Island, that would produce a new county, namely Peconic County, including the five East End towns, up to Riverhead, but not including Brookhaven. I don't want, to . go into a lengthy discussion about it, but would just let people know that, this was study that the Town of Southold financed $10,000 towards. It was a $100,000 study. The State of New York put up $50,000, and the towns combined, in proportion to population, put up the other $50,000. The bottom line of this survey, and study, is that it appears that a new formula"ion of county structure, establishing a new county for the five East End towns, is financially viable. It looks as if the towns out here, who currently contribute about 150 or so, would make a significant savings in the tax revenues that we send for County government. At' the present time those funds are something on the order of, I think, $34,000,000.00, and they would be about $28,000,000.00 if Peconic County were established. There would be a significant reduction due to the formulation, about a 15% reduction in taxes of that portion that goes to the County. The proposal that the people who drafted reported, and the firm is called Public Financial Management. The proposal, that they have made, and recommended, is that the governing structure of the County would be a Board of Supervisors with a paid professional County manager, so as to avoid a lot of the political patronage, and a lot of the costs, that have been associated with Suffolk County over the years. It would be a real savings in part, because there would be somewhat of a reduction in 4 0 APRIL 18, 1995 services. A Peconic County would presumably be a more spartan or bare bones affair. There would 'be reduced salaries and benefits, because it would be basically run on the level of towns, rather than the County. It would also be cheaper, because. it's. anticipated that Peconic County, if it were ever established, would contract with towns for some of the services, for example the Highways, or the Police would be continued as a Town function, and not at. the level of a County Police Department. There would also be the restructuring of debt, and other things that would be result in the cost. There are a lot of things in this report. It's rather thick and heavy. The Town Board got a copy of the report today. Next week there will be further meetings. It's still in draft. There will . be a hearing here in Southold Town in the future, probably this summer, as we look carefully at the possibility of Peconic County. My own view is, there was a time when almost all of Suffolk County, from one end to the other, was more or less homogeneous, and most of the people in the county shared a kind of common interest. I'm not sure if that's true anymore. It seems to me there is a difference in point of view from East End from the rest, and I think the likelihood of the East End people, in some sense, reformulating or changing, the way that Suffolk County operates is negligible. There is virtually no hope of that. As difficult as it may be to establish a new government, I suspect there is more likelihood of bringing about the changes we want that way, rather than to try make a change in Suffolk County. So, I'm quite enthusiastic about it. I hope you'll have a chance to read it. There is a copy of it with the Town • Clerk's Office, and .also the Supervisor's Office.
