After investigation and inspection the Board finds that a previous
variance was granted creating a 40 ,000 square foot lot on behalf of the
applicant. At that time an access variance was not granted. The findings
of the Board are that they are in agreement with the reasoning of the
applicant. There are no other roads to this property. Route 25 (Main
Road) , ends 25 feet to the west of this property.
The Board finds that strict application .of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the same use district; and the variance will not change the character of
the neighborhood and will observe the spirit of the Ordinance. .
On motion by Mr. Douglass , seconded by Mr. Grigonis, it was
RESOLVED that. William G. Wysocki , Orchard Street, Orient, New York? '
be GRANTED recognition of access as requested. . Location of property:

is requested for the reason that the lay of the land of the proposed building'site is such that
it is impossible to front on a dedicated street. The proposed dwelling will face a 16,
r/o/w which will provide excess thereto.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would,produce practical difficulties or unneces-
sary HARDSHIP because
As previously staged herein, the lay of the land of the proposed building site is such
that it is impossible to front on a dedicated street.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because of the location of the site on a r/o/w,
as aforesaid.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because there ate now two dwellings facing the r/o/w,
which is used.for access thereto.
This property, the subject of this appeal, is part of a tract which has been owned by
the Latham Family for upwards of 50 years. The grantor in the deed to the applicant,
William G. Wysocki, is said applicant's maternal grandmotherp to wit, Betsy (Mrs. Geo. E.
Latham, Sr.) Latham. Indeed, the two dwellings presently erected facing the r/o/w,
and using it for access thereto, are owned by the said Betsy Latham and George E.
Latham, Jr.
