SEE REVERSE 1 FORM ZB4 gpat�'� Appea��` ONIN BOARD OF APPEALS r t After investigation and inspection the Board finds that the applicant requests recognition of access to a 28 acre .parcel of land which he is using in connection with his wholesale nursery business. The decision of the Board will have no bearing on the legal ownership of the right-of- way or the maintenance. thereof in the future. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the. character of the neighborhood and will observe the. spirit of the Ordinance. On motion by- Mr. Douglass, seconded by Mr. Tuthill , it .was RESOLVED, that Richard L. and Lois F. Woodhull, Main Road, Cutchogue, New York, be GRANTED recognition of access. Location of property: Main Road (State Road 25) , Mattituck, New York, bounded on the north by Long Island Railroad; east by Krukowski; south by Suter; west by Adel and Tuthill, subject to the following conditions: (1) Such access .road shall have a .width of not less than 15 . feet. (2), Such access road shall be cleared of all trees_ , brush. and other obstructions to a width of 15 feet. (3) Such access road shall be improved in either of the following , methods: (a) Such access road shall be surfaced with a minimum depth of 4 inches of packed 3/4 inch stone blend so as to afford access for emer- gency vehicles. Such stone blend may be either applied to the ground., surface and shaped or the surface may be excavated to permit- the applica tion of packed blend to a depth of 4 inches . ` a (b) The access road shall have top soil removed to a depth of 8 inches and then filled with 8 inches of a good grade of stone and sand bank run. The surface shall then be covered with a layer of 2 'inches to 4' inches of 3/4 inch stone blend. (c) . Oiled with a minimum of 4/10ths of a ,gallon of road oil per square yard. (4) All work required as hereinbefore set forth shall be performed under the supervision of the Town Engineer and no building permits or certificates of .occupancy shall be issued by the Building_ Inspector until the Town Engineer has certified that such access road has been constructed in accordance with the foregoing requirements. (5) Where the terrain of the land over. which such. access road is to traverse is- such that drainage problems may occur , the applicant shall be required to construct such drainage facilities as may be recommended by the Town Engineer. (6) The Board of Appeals may in passing upon any appeal for approval of access make any reasonable exception as in its .judgment it deems appropriate to the circumstances. The reproductions are so faint in-some cases that I have attached abstracts for clarification. The numbers. on the stapled papers correspond to the following numbers: 1 - Deed - Platt Gould and wife to Chauncy W. Tuthill, Fiber . 153 page 525. This is the original grant into the predecessor in title of Mrs. Suter - the Goulds having owned an acreage running north from the Main Road. The description is to be particularly noted that the premises are bounded on the north by Mary Gould and also on the west by Mary Gould. The property does not extend westward to the Gould property line adjoining Philip Tuthill on the west. 2 - Deed - Jonathan T. Gould and wife to Eliza M. Mather, Liber 239 page 599. This is the property south of the Tuthill parcel and more recently awned by Bagenski; the abstract also being included. It is noted here again that the west line is 18 feet east of the east line of Tuthill. The Bagenski deed (spelled Cogenski) Liber 872 page 158 shows this 18 feet as being a right of way going to the J. Tuthill, Archer and E. Tuthill properties; Archer and Tuthill being north of the Suter property. 3 - Mortgage - Jessie W. Tuthill to James A. Torrey, Volume 1084 page 99. This property on Elijah's Lane, now owned by John Tuthill, adjoins the Woodhull property but is somewhat north of the Suter parcel and does show at that time that there was an 18 foot roadway on the property to the east. The above instruments clearly indicate an 18 foot roadway running north from the Main Road into the Woodhull property and for this the applicants request access.
