Article III, Section 100-31 3'." TYPE OF APPEAL Appeal is made herewith for (X-) A VARIANCE to the Zoning Ordinance or Zoning Map ( ) .-A VARIANCE--due .to lack-':of .access- (State .of-New York Town Law Chap. 62 Cons. Laws A-rt.-15 Sec.`-280A Subsection 3 4. PREVIOUS APPEAL ,A previous appofrl ) {has riot) been made -with-respect-to' this-decision of the Building Inspector or with respect to this property. Such appeal was ( ) request for a special permit ( ) request for a variance andwas made in Appeal No. ................................Dated ...................................................................... REASON FOR APPEAL . ( ) A Variance to Section 280A Subsection 3 (K-r A Variance to the Zoning Ordinance is requested for the reason that Petitioner would like to build a .house on _i_ premises which-are--situate on a. bluff overlooking Long `Island Sound. Due to active erosion of said bluff (as set forth "in inspection report attached hereto)-, Petitioner requests a variance of the set-back requirement off Glen Court to be 15 feet. This would allow maximum distance between the proposed dwelling and the top of the bluff. Foi-m ZB1 (Continue on other side) REASON FOR APPEAL Continued - 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because' Petitioner would be unable to build the proposed duelling at a safe distance from the Long Island Sound bluff, due to the required 50-foot front yard set-back off Glen_ Road Court. Y. .-J Y 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because this particular property has over- 20 feet- less footage between Glen Court and the Long zsl:and' Sound bluff, due to a cul-de-sac which takes away from this lot' s front yard. .. -- -- - 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because only a one-family dwelling will. be erected on these premises at the end of a road, on a cul-de-sac, .which dwelling will be essentially the same as the other residences in the area, None of the other houses ix on this cul-de-sac have this problem because they have other_ rQad access. New York 10016 Dear Mr." Van Dyne. .,On' 'October 11 , 1979 I inspected your property in Southold, district #10009 sectioink083, block ` ,: parcel 10 to assess the erosion problem and its effect on the placennen.t-'of the. house you are planning to build. ,i.Your property is undergoing active erosion caused by wave attack. at the toe 6U the bluff,, ground water seepage, and rain drop erosion on the face of the bluff. According .to the report "Erosion of the North Shore of Long Island,". by Davies, 'Axelrod °and 0.'Connor, the long term erosion rate for your area, established over ,aw,85'=year period (1885-1965) is 0.8 "feet 't6 1.0 feet per year. .The bluff is in particularly "bad shape" at the top, where the slope is steeper, than the natural angle of .repose of the soil. Should you choose to attempt to stabilize the bluff vegetatively, the top will have to be cut back about 15 feet or. so in order :to obtain a more stable slope. ' If you do not do this, you can expect to lose this, top section, in any event, through natural means. Complote. stabilization of the bluff will require,- in addition to vegetation, _structural means to. protect the toe from further erosion. Given the °present rate of erosion, which can be expected to continue, if not be'come, more severe in the future, the current state of your bluff, and the' fact that structural and vegetative methods of erosion control are not fool proof, I would 'recommend',.that your house be placed..as far back from- the, top of the, bluff as possible. As a minimom-you will rave to compensate for the 15 feet that will shortly. be lo'gt, add, to this at least 20feet if you build a toe protection structure, and more -to compensate for future erosion if you don't. The-20 feet mentioned above is primarily a safety factor based on erosion potential, and dater runoff considerations. Your architect should review the situation from the point of view of foundation conditions. Very • U ly yours, . - o b titer T.
