TOWN OF SOUTHOLD, NEW YORK DATE July 26, 1979 ACTION OF THE ZONING BOARD OF APPEALS Appeal No. 2561 Dated June 12, 1979 ACTION OF THE ZONING BOARD OF APPEALS OF THE TOWN OF SOUTHOLD To Jay and Mary Thomson Appellant 695 Bayshore Drive Greenport, New York 11944 at a meeting of the Zoning Board of Appeals on July 5 , 1979 the appeal was considered and the action indicated below'was taken on your ( ) Request for variance due to lack of access to property ( ) Request for a special exception under the Zoning Ordinance O ) .Request for a.variance to the Zoning Ordinance 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection paragraph .................... .................... of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 8 :10 P.M. (D.S.T. ) Upon applicaton of Jay and Mary Thomson, 695 Bayshore Drive, Greenport, New York_ , (George Ahlers, as agent) , for a variance to the Zoning Ordinance, Article III, Section 100-31 for permission to construct an addition to the existing house which would cause the usage of more than 20 percent of the building lot. Location of property: Bayshore Road, Greenport, New York, known as Lot No. 64 , in Peconic Bay Estates, Greenport, New York.. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE t ?0 ONING BOARD OF APPEALS FORM ZB4 -` $IS After investigation and inspection the Boar&!! finds that the applicants are requesting permission to construct an addition to an existing house which would cause the usage of more than 20 per- cent of the building lot. The addition will be two stories in height and will occupy 3.34 `.percent more; of the lot than is allowed under the Southold Town Zoning Ordinance. The Board agrees with the reasoning of the applicant. The Board finds that strict . application_of the Ordinance would produce practical;";.difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion of Mr. Tuthill, seconded by Mr. Douglass, it was RESOLVED, that Jay and Mary Thomson, 695 Bayshore Drive, Greenport, ' New York, be GRANTED permission to construct an addition to an existing house whch. would-.cause the usage of . 23..•34 percent of the lot.. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the owners have had two .residences. Having sold one of the re'zidences, all of their .furniture and belongings must now fit into one small- dwelling. . :The furniture and.belongings all have real and sentimental value, and the owners do not wish to part with them. It would be a hardship to be- forced. to sell or part with them, especial'ly,when the added square footage we are asking to add to their home is so small. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use. district because the' existing house occupies 2% more; of the; lot area than, the. ordinance allows. Also, the house sits close to its existing side lot lines. Most other houses do not. 3. The Variance:would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF.TH'E-DISTRICT because' the proposed additional square footage of lot coverage is less than 1%, actually .91%. This small amount could not possibly change the district. In addition, the extension is on the water side of the house and away from the street where it would not be seen. I believe granting this variance would observe .the sprit of the ordinance in not inflicting a forceable separation of the owners and their belongings, which would be. necessary if .they were not granted the variance.
