VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (.would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSEIJ ZO NG BOARD OF APPEALS FORM ZB4 pea Chap an � After investigation and inspection the Board finds that the applicant wishes to divide a parcel containing 80 , 900 square feet into two plots. The parcel labelled Parcel A will contain 33,300 square--"feet. Parcel B will contain 47 , 600 square feet and re- quires recognition of access from Spring Lane, Peconic, New York. The Board agrees with the reasoning of the applicant. There will be no increase in the projected density permitted in the Town of Southold. The Board- finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Tuthill, seconded by Mr. Douglass, it was RESOLVED, that Richard Schlumpf, 32 Curtis Path, East Northport, -"New York, ' be GRANTED permission to divide his property into two lots with insufficient area and width and be GRANTED recognition of access to Spring Lane, Peconic. REASON FOR APPEAL ( X) A Variance to Section 280A Subsection 3 ( X) A Variance to the Zoning Ordinance is requested for the reason that applicant wishes to purchase and divide Parcels A and B as shown on the attached survey by VanTuyl dated April 3, 1964 with Parcel A having insuffi— cient area and frontage and Parcel B requiring approval of access over a 30 foot right of way from Spring Lane. Form ZB1 (Continue on other side) _J REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the two parcels together form one large,narrow lot bordered by much smaller lots. When Mrs. Francisco purchased the property in 1968, the deed described the two parcels as separate parcels, and the front lot (Parcel A) met the Town Code requirements. Parcel A has a 125.66 foot frontage, containing approximately 33,300 square feet. The frontage and area are consistent with the other lots in the immediate vicinity, as shown on the survey,, Parcel B contains approximately 47,600 square feet, with access over a 30 foot right of way from Spring Lane. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the property as a whole is shaped differently from all surrounding parcels and was purchased by the present owner as 2 separate lots. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE. THE CHARACTER OF THE DISTRICT because the property would be divided into 2 lots in keeping with the size and frontage of neighboring lots as shown on the attached tax map. Goehringer, Chairman REPORT N0. 407 Southold Town Board of Appeals FROM: John W. Davis DATE: November 10' 1984 RE: ACCESS ROAD FOR RICHARD & JANET SCHLUMPF AT PECONIC. APPEAL NO. 2786. COMMENTS: 9he following is from my inspection on above date. 1he completed road is 16 ft. in width except at the entrance where for a short length it is 14 ft. due to trees. Length in the 25 ft. R.O.W. and meeting Indian Neck Lane is 275 } ft. The owner has extended the road into the property for a driveway with the same construction as the road. Ttst holes show 711 ' of sand and gravel base and close to 3" of stone blend for the top course. Topsoil was removed in the road area. It remains on the site in a stockpile.
