SPECIAL EXCEPTION. By resolution of the Board it was determined that a special'exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection .................... paragraph .................... of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 9 :15 P.M. Upon application of Royal Reynolds, 27 Schaefer Street, Huntington, New York, for a variance to the Zoning Ordinance, Article .III , Section 100-31 and Bulk Parking Schedule for permission to construct a house with insufficient front yard setback. Location of property: Vanston Road, Cutchogue, New York, bounded on the north by Quigley; east by Harty and Gina-; south by Braatz ; west by Vanston Road. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE .(c) The variance (does) (does.not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE n col GoL CINING BOARD OF APPEALS FORM ZB4 "•� of pppeat Cha��n�an ° After investigation and inspection the -Board finds that the applicant wishes to construct a new dwelling with the reduced front yard setback on Vanston Road, Cutchogue, New York. The ecology and natural drainage of the area will be disturbed to a lesser degree by locating the house where the applicant wishes to rather than adherence to the 50 foot setback of the Zoning Ordinance. The actual area between the house and paved area of the road will be approximately _ 50 feet. The first floor will be approximately road level . In our opinion this is a better site to place the house instead of requiring the applicant to construct his house up. the hill'.to the rear which would cause further damage to the side of the hill. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and. in the same use district, and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie-,seconded by Mr. Douglass, it was RESOLVED that Royal E. Reynolds, 27.
