By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because (SEE REVERSE) (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because (SEE REVERSE) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. ZONING BOARD OF APPEALS FORM ZB4 After investigation and inspection, the Board finds that the applicant is requesting permission to construct an accessory building in the sideyard area due to the steep slope. of the . rearyard and loca- tion of cesspools . The applicant indicates that the building will not be constructed closer than the front line of the dwelling house. The- Board agrees with the reasoning of the applicant for the project if implemented as applied for. The Board finds that the circumstances present in this case are unique, and that strict application of the ordinance would produce practical difficulties and/or unnecessary hardship. The Board be- lieves that the grant of a variance in this case will not change the character of the neighborhood and will observe the spirit of the zoning ordinance. On motion made by Mr. Grigonis, seconded by Mr. Doyen, it was RESOLVED, that JAMES REALE, 7845 Skunk Lane, Cutchogue , New York; by Peter Stoutenburgh as agent, BE GRANTED permission to con-struct accessory building in the westerly sideyard area and in accordance. with the requirements of the Southold Town Building Code, and provided further that the same not be used for living quarters.
