By resolution of the Board it was determined that (a) Strict application of the'Ordinance (.would) (would not) produce practical difficulties or unnecessary hardship because 'SEE REVERSE. (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE. (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE. and therefore, it was further determined that the requested variance ( ) be .granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. ZONING BOARD OF APPEALS FORM ZB4 After investigation and inspection, the Board finds that the applicant wishes approval of insufficient area and width 'as well as approval of insufficient road frontage in order to subdivide this property. The neighboring lots also have road frontage and area and width less than- that required in the Zoning Ordinance, and thereby gives a pattern in the neighborhood. The Board finds that strict application of the Ordinance would produce practical difficulties -or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion.by' Mr. Tuthill, seconded by Mr. Grigonis, it was RESOLVED, that RICHARD PRAETORIUS, 846 Westmoreland Avenue, Syracuse, New York 13210, be GRANTED a variance to the Zoning Ordi ' nance, Article III, Section. 100-31, approving . the insufficient :.area, width- an_ d . frontage on the proposed lots with the following . Decision of this Board made September 6 , 1979 granting Richard and Roger Praetorous , 846 Westmoreland Avenue , Syracuse , NY 13210 approval of insufficient area and width as applied for , for property located at Westview Drive , Mattituck , NY , more particularly known as County Tax Map Item No . 1000- . 139-1 -4. Mr . Allen Dawe , Mr. George Morgan , Mrs . Rits Schmidt , Mr . Marty Phillips , Mr. Paul Murphy , among other property owners in the area of Brower Woods , Mattituck , appeared presenting a Petition with 20 . signatures "resenting and objecting to the granting of a variance of one lot into two undersized lots , Appeal No . 2586 , dated .September 6 , 1979 , Article III , Section 100-310 [sic] " and seeking a reversal of decision for the following reasons : . . . 1 . There is no consistent pattern of ownership in Brower Woods of narrow frontages and insufficient area to justify this variance . Please note our proof by studying the survey covered by this petition". Many owners built on two or three lots . 2 . There is no reasonable hardship to the owner other than the loss of his contemplated profit . This is a selfish interest to try to gain monetary advantage . Furthermore , we question whether two lots would bring Mr. Praetirous any more money than one . 3 . This variance will lower our property values and encourage other owners of vacant land to try and cut up their property. This will be true not only for adjoining owners but to ALL of Brower Woods . This is a hardship on ALL of us as against his one possible hardship . We find this hardship not unique and .it will change the character of the neighborhood. , 4. Your Board is supposed to be set up to protect the Town of Southold from over-development and population . density. You are breaking down the purposes and the spirit of the zoning ordinance by. granting this variance . 5 . - Water supply and sewage disposal are very critical in this area and your act increases this shortage possibility. We are presenting this petition to the meeting on September 22 , 1980 [Planning . Board] and hope the Town of Southold can exert enough pressure -to reverse this decision . . . . That was a lot, lots 18 and 19 that was subdivided many years, I believe, I don 't. know when. MR. DOUGLASS: It would be in 'the Town Code under filed sub- divisions. (The Acting Chairman and members of the Board research this in the Code- Book. ) MR. DOUGLASS : The only thing that we can do is, I'll accept a motion if anybody, there isn 't anybody here to speak against it so I guess nobody wants to speak against it. MR. PRAETORIUS : Ok, please explain to me why that 's necessary. I 'm not familiar with the procedure. I came down from Syracuse, New York. to do this and I was just curious why. MR. DOUGLASS: We approve conditions that create your piece of land not meeting the. zoning standards. In other words the standards today are 150 feet on the road and 40,000 square feet for a building lot, but you are proposing a 60+ feet on the road for each lot and 21,000+, a 'half acre instead of an acre. This is the way you bought it in the subdivision, however, once it was bought and put into single and separate ownership it became one piece of land. So now you are applying to divide that one piece of land, that original line is no more there. Once they bought to two pieces and put in into one deed, it's no more there. It became one lot. So when you divide a piece of land the party who divides the piece of .land is the Planning Board. We grant you .the right or okay the right to have a smaller than presently required lot with insufficient frontage or whatever the case happens to be. But they have to grant you the right to do the division and so we' ll, I 'll accept 'a motion to approve the insuf- ficient width and area and insufficient street .frontage, and then you go back. CAfter investigation and inspection, the Board finds that the applicant wishes approval of insufficient area and width as well as approval of insufficient road frontage in order to subdivide this property. The neighboring lots also have road frontage and area and width less than that required in the zoning. ordi- nance and thereby gives a pattern in the neighborhood. The Board finds that strict appl;i.catic. of the Ordinance :•?ouzel produce practical difficulties or unnecessary hardship; the hard- ship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in. the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. WE SEEK A REVERSAL OF YOUR DECISION FOR THE FOLLOWING REASONS; 1. There is no consistent pattern of ownership in Brower Woods if narrow frontages and insufficient area to justify this variance. Please noteour proof by studying the survey covered by this petition. Many owners built on tto or three lots. 2. There is no reasonable hardship to> the owner other than the oss of his contem- plated profit. This is a selfish interest to try to gain moetary advantage. 4 Furthermore, we question whether two lots would bring Mr. Pretorius any more money than one. 3. This variance will lower our property values and encourage oher owners of vacant land to try and cut up their property. This will be true no only for adjoining owners but to ALL of Brower Woods. This is a hardship on AL of us as against his one possible hardship. We find this hardship not unique and it will change the charcter of the neigh- borhood. 4. Your Board is supposed to be set up to protect the Town of Suthold from over- development and population densityr. You are breaking down tb purposes and the spirit of the zoning ordinance by granting this variance. 5. Water supply and sewage disposal are very critical in this aea and your act increases this shortage possibility.
