After investigation and inspection the Board finds that the applicant wishes .to eliminate the requirement for off-street parking on premises .which are 40 feet wide and 115 feet deep. The office building is centrally located on the premises: A parking area whould have to be excavated in a front yard area which ' is 40 feet by 40 feet.. Even though the square footage is available for 3 parking spaces; there is not enough room for a vehicle`,.to turn around so the car would not back .bnto to Route 25, which ' is a vio- lation of the traffic:,law. The -Board agrees with the reasoning of the applicant. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (x) A Variance to the Zoning Ordinance is requested for the reason that Form zs1 (Continue on other side) REASON FOR APPEAL Continued - 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sgry HARDSHIP because applicant seeks to utilize the existing building .as an office for one business. Due to the fact that the property is only forty feet wide, and due to the topography of the property, it4s impractical to.construct parking facilities on the subject premiss., -There ;an-existing brick building,on the premises, which was formerly used by the ,New York Telephone Company, and said building is located approximately forty-five feet back on the property from the Main Road. Permission has been -obtained -from the Mattituck Manor to park the owner's'-And employees' cars in the Mattituck Manor parking lot located across the street from the subject premi- ses. It is anticipated that the office would be utilized from Monday through .Friday, between the hours of approximately 9:00 am to 5:00 pm, which would not interfere with the general hours of operation of the Mattituck Manor. There are practical difficulties in attempting to construct a limited parking lot on the subject premises due to the fact that there is limited land available and due to the terrain of the property. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because there is 'a pre-existing-building:on the subject premises which was so located so as to leave very little room for the con- struction of parking facilities -and duel to the -fact that the terrain of the property is not suitable for the construction of parking facilities. 3. The Variance would observe the spirit of the Ordinance 'and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this is a pre-existing situation and a license has been received from the Mattituck Manor for permission to utilize its parking lot across the street during hours and days which-Would not conflict with the use by the Matti- tuck Manor of its own parking lot facilities.
