Section Subsection paragraph . of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be. confirmed because Public Hearing held September 6, 1979 . 9:10 P.M. (D.S.T.) Upon application of David and Carmen Olenick, 120 Park Place, Brooklyn, New York, fora variance to the Zoning Ordinance, Article III., Section 100-32 for permission to construct a' swim- ming, pool in the front-yard area. Location of property: Corner' Of South Harbor Lane and Private Road, ,Southold, New York; bounded on the north by VandenHeuvel; west by Jacobs; south by Prvate .Road; west by South HarborkLane. (.SEE REVERSE. ) 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (.would) (would not) produce practical difficulties or unnecessary hardship because 'SEE REVERSE. (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties' alike in the immediate vicinity of this'property and in the same use district because SEE REVERSE. (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE. and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector (. ) be confirmed ( ) be reversed. ZONING BOARD OF APPEALS FORM ZB4 After investigation and inspection, the Board finds that the applicants wish to construct a swimming pool in the front- yard area fronting Private Road. It is impossible to construct a swimming pool in the front-yard area fronting South Harbor Road because it is low land or creek land and also impossible in the rear-yard because of the dwelling' s closeness to the creek. The Board agrees with the reasoning of the applicants. The Board finds that strict application of the Ordinance would produce practical difficulties - or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by- Mr. Grigonis, seconded by Mr. Tuthill, it was RESOLVED, that DAVID and CARMEN OLENICK, 120 Park Place, Brooklyn, New York 11217 , be GRANTED a variance to the Zoning Or- dinance Article III, Section 100-32 for permission to construct. a swimming pool in the front-yard area.
