(E.S.T. ) Upon application of Amelia Narobe, Alpine Avenue, Fishers Island, New York, for a variance in accordance with the Zoning Ordinance, Article II , Section 100-23C; Article III, Section 100-31 'and Bulk Parking Schedule and Article XIV Section 100- 144 B for permission to divide property into three lots with insuf- ficient area, width, side yard and rear yard. Location of property: Alpine Avenue, Fishers Island,. New York, bounded on 'the north by Howell; east by private right-of-way; south by Alpine Avenue; west by Calanquin. 2. VARIANCE. By resolution of the Board it was determined that (a). Strict application of the Ordinance (.would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would.not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit .of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions.of the Building Inspector ( ) be confirmed ( ) be reversed. The entire Kiross parcel was bequeathed. through Mr. Kiross ' estate, and the four houses have been there for more than 50 years. This is' the only reasonable way to divide this, and the Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not. be shared by all properties alike in the immediate vicinity of the property and in the same use, district; and the variance will not change the character. of the neighborhood,.:. and will observe the spirit of the Ordinance. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 01 A Variance to the Zoning Ordinance is requested for the reason that the premises in question comprises a. total area of 4, 480 square feet and the front yard, rear yard and side yards are less than required by the Zoning Code. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the premises in question comprises a portion of lands owned by Mehal Kiross at the time of his death on January 30, 1969. Nleha.l Kiross acquired the premises in question together with the premises adjacent thereto from ;one William H. Chapman in 1944. Under the Last Will and Testament of Mehal Kiross, he devised the lot designated on the tax map as 10. 2 to Leon V. Ca.lanquin. The testator devised the lot west of the Calanquin lot (Lot 10. 3 on the tax map) to Joan Erpenbeck Graves. Narobe, Ca.la.nquin and Graves each have a private one-family dwelling. erected thereon. .Attached hereto, and forming a. part hereof is a sketch showing the three lots in question prepared by the Real Prop- erty Tax Service Agency. Also attached hereto is a survey of the.Na.robe prop- erty. The Narobe property is presently under contract of sale to Raymond A. and Elizabeth M. Ya.kaitis. Such sale is subject to obtaining a Certificate of Occupancy from the Building Inspector. The Building Inspector has denied an application for such certificate. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the division of the property owned by Kiross was effected pursuant to the provisions of the Last Will and Testament of the, said Meha.l Kiross. A copy of said will is annexed hereto. No-other p*perty Jn the vicinity has been divided by a. will of the owner thereof. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because as shown on the copy of the tax map attached hereto all of the lots in the immediate neighborhood are of substantially the same size as applicant's lot and, therefore, the grant of the variance applied for, would not change the character of the district. To deny the variance applied for, would create practical difficulties since applicant will not be able to sell the premises unless an area variance is granted.
