APPROVED ZONING BOARD OF APPEALS FORM ZB4 Board of Appeals After investigation and inspection, the Board finds that the applicant is requesting a five-foot sideyard setback from the property line adjoining the Dupont property, north of the subject property in order to install a loading ramp in a more practical and less dangerous area than he is presently using at the front of the business. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the ordinance would produce practical difficulties and unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in ' the immediate vicinity.. of the property and .in the . same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the ordinance. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( 1X) A Variance to the Zoning Ordinance is requested for the reason that Strict application of the ordinance .would hinder property improvements designed to increase business efficiency, improve service to the public, and provide a safe environment for store employees and customers. Form ZB1 (Continue on other side) RECEIVED NOV z 1979 = -- Town Clerk Southold REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary-HARDSHIP because (a) Interior renovation/modernization plans require rear delivery of shipments via proposed elevated ramp; (b) Delivery at rear via existing stairway is impracticable and potentially injurous to employees, since large quantities of heavy bulk goods are received daily; (c). Delivery through front entrance- of store is equally impractical since it disrupts free access by customers and creates a potential for accidental -injury to customers; and (d) Alternative location of delivery ramp at south side of building would entail the delivery vehicle' s blocking Equestrian Avenue at the apex of a sharp curve in the roadway, -thus creating a traffic safety hazard, whereas, safe parking is available near the proposed ramp. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because (a) The building in question is built in a depression formed by. a steep escarpment which drops away from Equestrian Avenue, . the rear of the building being raised, with no lst Floor delivery access at rear; (b) The frontage street curves at this point, limiting parking and unloading space for vehicles, thus, (c) under these circumstances it is often necessary to close the business in .the morning in order to receive shipments, thus limiting .hours of service to the public. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because (a) The proposed ramp leaves a mininum 5' of clear easement against the DuPont property line, and, being elevated with respect to the actual sloping ground level, leaves 10' of relatively unobstructed yardspace at , actual ground level, being interrupted by uprights; (b) The side yard in question inclines abruptly downward from street level, and is not immediately recognizable or useful as a yard; and (c) The adjoining DuPont property is an empty wooded lot. Locating the proposed ramp opposite this lot minimizes chan ing the appearance of the property and immediate neighborhood whereas a ramp -on the other side of the building would be an eyesore noticeable from Equestrian Avenue) . Future construction on the DuPont wooded lot would have the effect of masking the ramp if the trees were removed for this purpose.
