No action was taken during this time. 7:30 p.m. A Regular Meeting of the SOUTHOLD TOWN BOARD OF APPEALS was held at the Southold Town Hall, 53095 Main Road, Southold, New York 11971, on WEDNESDAY, NOVEMBER 8, 1995 commencing at 7:30 p.m. Present were: - Gerard P. Goehringer, Chairman Serge Doyen, Jr. , Member James Dinizio, Jr. , Member Robert A. Villa, Member Lydia A. Tortora, Member Linda Kowalski, Board Assistant I. N.Y.S Environmental Quality Review Act on the following: A. Each of the applications advertised for public hearing tonight do not require SEQRA determinations pursuant to Section 617.3(f) of 6 NYCRR Part 617, Environmental Conservation Law Sections 3-0301(1)(b) , 3-0301(2)(m) and 8-0113. I1. PUBLIC HEARINGS: The Chairman read the legal notice and application for each of the following matters at the beginning of each hearing (times identified below) : 7:33 p.m. Appl. No. 4347 - DORIS KERR BROWN. This is a request, based upon the October 11, 1995 Notice of Disapproval issued by the Building Inspector, in which applicant applied for a building permit to relocate an existing dwelling, and which application was disapproved on the following grounds: "Under Article XXIII, Section 100-239.4.A(1) (portion of) proposed relocation is less than 100 feet from the Long Island Sound Page 2 - Minutes and Resolutions Regular Meeting of November 8, 1995 Southold Town Board of Appeals bluff." Property Location: 3400 Private Road #12 off the north side of Bergen Avenue, Mattituck, NY; Parcel ID No. 1000-112-1-17. Mrs. Doris Brown and her son, Jeff, spoke in behalf of their application. During the hearing it was mentioned that they may now be able to locate the dwelling in a different spot - without a variance. The Board members encouraged them to do so and recessed the hearing until the next meeting, December 6, 1995 3" for an update. 7:35 p.m. Appl. No. 4346 - REGINALD MINOR. This application is based upon the October 3, 1995 Notice of Disapproval issued by the Building Inspector, wherein applicant is requesting a building permit for an accessory inground swimmingpool, and which application was disapproved on the following grounds: "Under Article IIIA, Section 100-30A.4 proposed construction shall be installed in the required rear yard. Under Article XXIII, Section 100-231, fences in residential zones shall not exceed four feet in height in a. front yard. Under Section 45-8 a building permit is required before a fence can be installed or replaced." Location of Property: 360 Private Road #1 (Stephenson Road) Orient; Parcel No. 1000-17-1-12. Mr. Minor appear in behalf of his application. Following the hearing, action was taken to approve the application as applied. (See findings and determination near last few pages of this set of Minutes.) 7:55 p.m. Appl. No. 4340 - J. GRILLO. (Recessed from October 11, 1995) . Variance for fence height location commencing near Peconic Bay Boulevard and running to the south along the westerly side of right-of-way known as Mesrobian Drive, Laurel, NY. 1000-145-4-12.1. 7:5 7 p.m. Appl. No. 4348 - MR. AND MRS. THEODORE PETIKAS. This is a request for a variance under Article XXIX, Section 100-239.4, based upon the October 17, 1995 Notice of Disapproval issued by the Building Inspector wherein applicants are requesting a building permit for a 6 ft. wide deck entry from the easterly side of the dwelling to a proposed raised deck area within 100 feet of the low bank of the Long Island Sound. Property location: 52755 Soundview Avenue, Southold; County Tax Map Parcel No. 1000-135-1.-27. 8:20 p.m. (Recessed from October 11, 1995) Appl. No. 4344 - AMAC, INC. (SUKRU ILGIN) requesting a Variance for relief of Conditions 3 and 4 of ZBA Determination rendered March 25, 1992 under Appl. No. 4074 which Conditions read as follow: ". . .3. There shall be only one entrance for the convenience store area, that being located only at the east side of the existing building; and 4. There shall be no entrance way between the gasoline sales area of the building to the convenience store area. . . ." Property is established as a gasoline service station with accessory convenience sales at: 7400 Main Road, Mattituck (Laurel School District) ; Parcel #1000-122-7-1. B-General Business Zone District. Page 3 - Minutes and Resolutions Regular Meeting of November 8, 1995 Southold Town Board of Appeals 8:33 p.m. Appl. No. 4349 - PHILIP LAGRECA. This is a request, based upon. the October 13, 1995 and October 26, 1995 Notices of Disapproval issued by the Building Inspector, in which applicant applied for a building permit to add a deck to existing dwelling, and received a building permit to add an extension at the rear of dwelling. Under Article III, Section 100-32, variances are requested for a reduction in the rear yard setback at 465 Hyatt (private) Road, Southold, NY; County Tax Map Parcel No. 1000-54-01-11. Following the hearing, alternative relief was granted. (See findings and determination in this set of minutes, infra.) 8:44 p.m. Appl. No. 3451 - EDWARD AND JEAN ZUHOSKI. This is a Variance requesting relief under Article XXIV, Section 100-244B for permission to construct an extension of existing carport which would be located with a reduced front yard setback on this nonconforming lot (substandard lot area and width) . Location of Property: 18250 County Road 48, Cutchogue; County Tax Map Parcel No. 1000-96-4-1.1. 8:55 - 9:20 p.m. and again 9:28-10:15+- p.m. (A short break was taken between 9:20 to 9:27 p.m. ) Appl. No. 4350 - THOMAS McCARTHY. This is an appeal for an Interpretation based upon a Stop Work Order issued on 10/18/95 by the Building Inspector suspending all work for the reason that construction fails to comply with Article XXIV, Section 100-242A and B-1 of the Zoning Code which at sub-section B-1 provides that ". . .A nonconforming building containing a conforming use which has been damaged by fire or other causes to the extent of more than fifty percent (50 0) of its fair value shall not be repaired or rebuilt unless such building is made substantially to conform to the height and yard requirements of the Bulk Schedule." Location of Property: 375 King Street, New Suffolk; County Tax Map Parcel No. 1000-117-7-8.3. Following testimony, motion was made by Chairman Goehringer, seconded by Member Tortora., and duly carried, to close the hearing pending deliberations. (Action was taken later in the meeting. No. 4350 - THOMAS McCARTHY Page 4 - Minutes and Resolution Regular Meeting of November 8 , 1995 Southold Town Board of Appeals ACTION OF THE BOARD OF APPEALS DATE OF ACTION: November 8, 1995 APPL. #4346. APPLICANT: REGINAIO MINOR. LOCATION OF PROPERTY: 360 Private Road #1, Stephenson Rd, Orient. COUNTY TAX MAP DISTRICT 1000, SECTION 17, BLOCK 1, LOT 12. BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated October 3, 1995. PROVISIONS APPEALED FROM: Article XXIII, Section 100-231 and Article IIIA, Section 100-30A.4 (ref. Article III, Section 100-33) . RELIEF REQUESTED: Proposed swimmingpool in a yard technically defined by the zoning code as a front yard location, and proposed fence, as built, at six feet in height along a front yard. Proposed pool is shown to be 10 feet from the easterly property line and more than 200 feet from the Main Road. MOTION MADE BY: Robert A. Villa; SECONDED BY James Dinizio, Jr. ACTION/RESOLUTION ADOPTED: Granted as applied. REASONS/FINDINGS: Requested location is not unreasonable since it will be placed in the yard area which is normally a rear yard, and due to the location of a right-of-way is considered a front yard. This property does not have a designated rear yard as regulated by the code. No other alternative is available, nor is any other yard area better suited to this type of construction. GRILLO and ORS. LOCATION OF PROPERTY: 365 Mesrobian Drive, Laurel. COUNTY- TAX MAP DISTRICT 1000, SECTION 145, BLOCK 4, LOT 12.1. BASIS OF APPEAL:' Notice of Disapproval issued by the Building Inspector dated 9/11/95. PROVISIONS APPEALED FROM: Article XXIII, Sections 100-231. RELIEF REQUESTED: Increase in fence height from 4 ft. to 6 ft. along portions of the west side of applicant's land (along right-of-way). MOTION MADE BY: James Dinizio, Jr. SECONDED BY: Gerard P. Goehringer ACTION/RESOLUTION ADOPTED: Denied six ft. (61) height for new fencing and granted alternative relief for five ft. (51) high fencing commencing at a point approximately .g., ----' feet from Peconic Bay Boulevard. Fence height from beginning of garage existing at the entrance of the subject right-of-way may not be higher than four feet and shall not obstruct existing windows of garage. Any other fencing which does not comply with height requirements must comply with zoning restrictions (unless a new application is filed for consideration and subsequently acted upon by the ZBA). REASONS/FINDINGS: Location of fencing is along the back yard areas of existing neighboring dwellings, although the back yards are technically defined under the present zoning code as front yard areas limited to four ft. height without action by the ZBA. The amount of relief alternatively granted is not substantial being a variance of one foot. APPLICANT: THEODORE PETIKAS LOCATION OF PROPERTY: 52755 Soundview Ave, Southold. COUNTY TAX MAP DISTRICT 1000, SECTION 135, BLOCK 1, LOT 27. BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated October 17, 1995 and ZBA Conditions under Appeal No. 4170 dated June 22, 1993. PROVISIONS APPEALED FROM: Article XXIX, Section 100-239.4A. RELIEF REQUESTED: 14' x 20' Open deck extension along the northerly end of dwelling and proposed walkway along easterly side of dwelling. MOTION MADE BY: Lydia Tortora, Member SECONDED BY: James Dinizio, Jr. , Member ACTION/RESOLUTION ADOPTED: Denied 5' side walkway as applied and _granted alternative relief for a four-foot wide side walkway. Open deck area must be reduced to dimensions of 14 ft. by 19 ft. and shall not extend beyond the 14 feet from the sound (north side) of the existing house. REASONS/FINDINGS: Conditions of the soil and layout of the property lend to the need for variance relief. Deck construction is not a major type of construction, and the deck will remain open and unroofed as proposed herein. VOTE OF THE BOARD: Ayes: Serge J. (SUKRU ILGIN) LOCATION OF PROPERTY: 7400 Main Road, Laurel. COUNTY TAX MAP DISTRICT 1000, SECTION 122, BLOCK 7, LOT 1. BASIS OF REQUEST: ZBA Conditions No. 3 and 4 of ZBA determination of March 25, 1992 under Appl. #4074 which restricted interior building entrance PROVISIONS APPEALED: Article X, Section 100-102 #4074 adopted 3/25/92 pertaining to accessory use and size of lot. RELIEF REQUESTED: To allow removal of counter barrier between customer area and cashier which was restricted under Appl. #4074. MOTION MADE BY: Lydia Tortora SECONDED BY Serge Doyen, Jr. ACTION/RESOLUTION ADOPTED: Granted with the following conditions: (a) unlock rear door while building is in operation and encourage use of rear door by customers as often as possible; (b) all parking must be utilized by customers on-site, including the easterly parking area; (c) existing "no parking" sign in front of building must remain REASONS/FINDINGS: Present outside.parking for customers interested in purchasing items sold inside of building is not feasible when customers leave their cars at gasoline pumps and walk around to easterly side of building. Same opportunity for other gasoline/covenience sales businesses was not available to this business with present restrictions as is normally made available for other business operations of this nature. No other alternative is available. The testimony submitted and personal observations made since its opening find the former restrictions truly creating difficulties in attempts to properly stand, park, and maneuver vehicles while customers left their cars to go inside. (Member James Dinizio, Jr. was in favor of granting the relief requested, however he was opposed to the additional restrictions placed in this resolution as offered and seconded.) Page 8 - Minutes and Resolutions Regular Meeting of November 8 , 1995 Southold Town Board of Appeals ACTION OF THE BOARD OF APPEALS DATE OF ACTION: November 7,' 1995 APPL. #4349. APPLICANT: PHILIP E. LaGRECA LOCATION OF PROPERTY: 465 Hyatt Road, Southold. COUNTY TAX MAP DISTRICT 1000, SECTION 54, BLOCK 1, LOT 11. BASIS OF APPEAL: Notices of Disapproval issued by the Building Inspector dated October 13, 1995 and October 26, 1995. PROVISIONS APPEALED FROM: Article III, Sections 100-32 RELIEF REQUESTED: One foot for the new addition and five ft. wide open wooden deck wrapped around corner of new addition reducing the total setback to be a distance of 24 ft. from the property line. MOTION MADE BY: Robert A. Villa SECONDED BY: Gerard P. Goehringer ACTION/RESOLUTION ADOPTED: Granted .as amended and described above, with the condition that the wraparound deck remain unroofed as proposed, and subject to receiving a final drawing of .this project as corrected and discussed at the November 8, 1995 public hearing. REASONS/FINDINGS: Same side yard setback will be maintained at 11 feet. There is no alternative due to the size and layout of the property. The relief is basically a total of six feet (one foot for addition and five feet for deck) which is not unreasonable and is very minimal. VOTE OF THE BOARD: Ayes: Serge J. Page 9 - Minutes and Resolutions Regular Meeting of November 8 , 1995 Southold Town Board of Appeals ACTION ADOPTED NOVEMBER 81 1995 Appl. No. 4350 - Request for Interpretation of Article XXIV, Section 100-242. Subject Parcel 1000-117-7-8.3 (Current Owner: T. McCARTHY) . Location of Parcel: 375 King Street, New Suffolk. WHEREAS, on July 12, 1995, a building permit was issued under No. 22881 Z by the Building Inspector for an addition and alterations to an existing one-family dwelling to include an enclosed porch as applied for, and which was thereafter amended to show handwritten changes for new construction (additional fee of $75.00 charged by the Building Department and receipted July 28, 1995); and WHEREAS, the building plans submitted under the original building permit are substantially the same as that which was stopped under the Stop Work Order issued October 18, 1995; and WHEREAS, the basis of the Stop Work Order is stated as ". . .failing to comply with Article XXIV, Chapter 100-242A and B(l) of the Zoning Code of the Town of Southold. . . ," and WHEREAS, an application for a formal Interpretation of Section 100-242A has been requested by the applicant, based upon the reasons for issuance of the subject Stop Work Order dated Octo- ber 18, 1995, and after due notice a public hearing was held on November 8, 1995; and WHEREAS, at said public hearing, all testimony was submitted - in support, in rebuttal, and in general regarding this project, and a duplicate of the Building Permit file and records, together with all prior actions rendered by the Board of Appeals pertaining to this property and transcripts have been made a permanent part of this record; WHEREAS, Article XXIV, Section 100-242, Subsection A which is appropriate and applicable for this conforming residential use with a nonconforming sideyard setback, is noted in the following excerpt at page 10143 of the Zoning Code: Page 10 - Minutes and Resolutions Regular Meeting of November 8 , 1995 Southold Town Board of Appeals (Appl . No . 4350 - Interpretation of Section 1002242 , continued : ) 100-242. Nonconforming buildings with conforming uses. A. Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or enlargement of a nonconforming building containing a conforming use, provided that such action does not create any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings; and NOW, THEREFORE, on motion by Member Tortora, seconded by Member Villa, it was RESOLVED, that it is hereby DETERMINED in interpreting Section 100-242A that the term 'reconstruction' may include the term "rearrangement" in the structural parts of the building, and/or the term "alteration," defined at Section 100-13 of the Code as follows: ALTERATION: As applied to a building or structure, a change or rearrangement, or an enlargement, whether extending on a side or by increasing in height, or the moving from one location or position to another"; and a building permit for building alterations and addition or enlargement which does not extend into a new nonconforming yard or which does not increase the degree of nonconformance with regarding to the regulations pertaining to such buildings; and BE IT FURTHER RESOLVED, that the reason given by the Building Inspector dated October 18, 1995 to Stop Work under Building Permit No. 22881Z ". . .for failing to comply with Section 100-242A of the Zoning Code. . ." is found to be deficient in form and content, and based upon this Board's authority for a formal interpretation, the Stop Work Work shall be removed (or lifted) . Furthermore, any reference to Subsection B(1) does not apply when compliance is found at Subsection A of 100-242. Vote of the Board: Ayes: Messrs. Doyen, Dinizio, Villa, Tortora, and Goehringer. Other/Updates/Miscellaneous: The Board Members were updated on each of the following: A. Committee Sessions: Code Review: Mon. Nov. 13 at 4 p.m. (Commercial Vehicles and Public Notices) Committee of Planning/Zoning (No date set) B. Final Draft - Proposed Local Law: Lot Creation and Merger - expected to be scheduled for public hearing by the Town Board within 3 - 4 weeks. Final draft was given to board members' review and update. No comments or changes were offered. C. Proposed Local Law: Limitation on Outdoor Display at retail or other establishments. Proposed Draft prepared by Town Attorney was given to board members' review and update. No comments or changes were offered. Agenda Item I V. Miscellaneous: A. New applications tentatively scheduled for Wed. , December 6, 1995 subject to site inspections by board members (includes Robins Island and LILCO application, and other variances filed on or before Tuesday, November 24, 1995. ) . Motion was made by Chairman Goehringer, seconded by Member Doyen, and duly carried, to authorize advertisement of the following matters, once deemed complete by the Chairman and ZBA Office for public hearings to be held on WEDNESDAY, DECEMBER 6, 1995: 7:30 p.m. Appl. No. 4353 - HELEN RUTKOWSKI. This is a request, based upon the November 15, 1995 Notice of Disapproval issued by the Building Inspector, in which applicant was denied a building permit to add a second story and to convert existing boat facility-accessory building to single-family dwelling use due to prior restrictions under ZBA action #2032 dated 5/1/75 and #1954 dated 2/27/75. Location of Property: 1025 Gull Pond Lane, Greenport, NY; County Tax Map Parcel No. 1000-35-4-7.2 (and 28.16) . Zone District established 1/9/89: R-40 Residential. 7:32 p.m. Appl. No. 4352 - PHILIP GIOIA. This is an appeal based upon the November 3, 1995 Notice of Disapproval from the Building Inspector in which applicant was denied permission to construct garage based upon Article IIIA, Section 100-30A.4 (ref. 100-33) which requires a rear yard location. Subject premises is substandard in size and is virtually all front yard due to the existing rights-of-way. This is an application based upon the October 31, 1995 Notice of Disapproval issued by the Building Inspector, the grounds for which read as follows: A.2 Boat House, B1.1 Garage, C.1 Recreation Building, E.4 Garage with staff quarters: all exceed 18' height limitation for accessory structures, Article III, Section 100-33A. E.1 Family Vacation Home exceeds height limitation of 35 ft. as stated in the Bulk Schedule for an R-400 Zone (as principal building) . E.1 Family Vacation Home, B.1 Lane House, C.7 Caretaker Cottage, EA Garage with staff quarters: One Family Dwelling not to exceed one (1) dwelling on each lot under Permitted uses in an R-400 Zone. Action required by the Zoning Board of Appeals. . . . Location of Property: Robins Island, near North Race of Great Peconic Bay, Town of Southold, NY; County Parcel ID No. 1000-134-3-5, containing 434+- acres. B. NEW APPLICATION: LOUIS MOORE BACON/Roobins Island. Appl. No. 4354 - It was agreed by all board members to commence the SERR.A review and transmit the initial coordination letter with all documentation and copies of the application to all involved agencies, with the anticipation of a Type I Status and lead agency designation by the Board of Appeals if there is no objection from other agencies. Also, the Board also agreed to commence review with Chic Voorhis of Voorhis and Associates, Inc. as the ZBA consultant on environmental issues in this project. The Chairman agreed to deliver copies to Chic Voorhis in the next day or so. The Board Secretary agreed to deliver copies to the County Health Department, Town Trustees, and NYS Department of Environmental Conservation this week. The Board Members indicated they would continue their review of the new application and related documents (LEAF, etc. ) and discuss their concerns at the December 6, 1995 preliminary ZBA Page .13- Minutes and Resolutions Regular Meeting of November 8, 1995 Southold Town Board of Appeals hearing. Member Tortora offered a motion earlier that would invite the County Health Department and State DEC officials to the December 2nd island inspection, but the motion failed. The Board Members were inspecting the Island based upon. an invitation and transportation offered by the owner and it wouldn't be fair to the owner to extend that invitation to other agencies. The other agencies could contact the owner when they felt the time was appropriate and when they had received their applications. There being no other business properly coming before the Board at this time, the Chairman declared the meeting adjourned.
