A Regular Meeting was held by the Southold Town Board of
Appeals on WEDNESDAY , JUNE 27 , 1990 commencing at 7:30 o'clock
p.m. at the Southold Town Hall, Main Road, Southold, New York.
' Present were: Gerard P. Goehringer, Chairman; Members
Charles Grigonis , Jr. , Serge Doyen , Jr . , Joseph H. Sawicki ,
James Dinizio , Jr.
Board Members absent

Doreen Ferwerda, the Board's Secretary and Court Stenographer
(per contractual agreement with the Town for stenographic
services) .
The Board proceeded with the all .the public hearings (as
advertised in the Legal Notice) . During each of the hearings,
testimony was given and the hearing was immediately concluded
thereafter (except as noted in the attached Transcripts of
Hearings) . The transcripts of all the hearings listed on the
attached agenda have been prepared by a court stenographer, and
copies of the board decisions as filed with the Town Clerk's
Office and S.E.Q.R.A. declarations are attached to this cover
page together with the transcripts as the record of the board's
actions for future reference. (No other minutes for this
regular meeting have been prepared. )

WHEREAS, a public hearing was held and concluded on April
19, 1990 and May 30, 1990 in the matter of the Application of
EVA HALLA, under Appeal No. 3914; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with- the premises in question, its present zoning and
—the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Glen Court, Hamlet of Cutchogue, and is identified on
the Suffolk County Tax Maps as District 1000, Section 083, Block
01, Lot 01.
2. This is an application for Variances from the Zoning
Code Article III A, Section 100-30 A.3, Article XXIV, Section
100-244, Article XXIII,' Section 100-239.4, for permission to
construct a one family dwelling.

5. In considering this application, the Board finds an

character of the immediate area and will be a substantial
change, creating other precedents to follow; (b) the practical
difficulties claimed are not sufficient to warrant the granting
of the relief requested; (c) the circumstances of the property
are not unique; (d) that in carefully considering the record
and all the above factors, th6 interest of justice will be
served by denying the relief granted. and granting alternative
relief, as further noted below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Grigonis, it was
RESOLVED, to DENY the Variance with ALTERNATIVE RELIEF in
the matter of the application of EVA HALLAunder Appeal No. 3914,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the house not be any closer than ten feet from
the southern property line (toward Glen Court) .
C2. That the house not be any closer than 65 ft. to the
top of the bank.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen, Sawicki and Dinizio. This resolution was duly adopted.

3. The subject premises as of January 9, 1989 has been
situated in the R-40 Residential Zone District and is improved
with an existing one-story frame building having a total floor
area, inclusive of attached garage, of 1408+- sq. ft.
4. By this application, the appellant requests a Variance
for permission to construct new 1426 sq. ft. (One-story) masonry
. building to be occupied by retail stores and commercial office
uses, uses which are not permitted in this R-40 Zone District.
5. Certificates of Occupancy have been furnished for the
record indicating that on January 14, 1988 renovations were made
to an existing real estate office in an existing building (C.O.
#Z-16582) and that on'August 2, 1973, Certificate of Occupancy
No. Z5343 was issued for a business building with apartment -
(public garage) . -
6. Although the present use of the site has been
nonconforming in this R-40 Zone District since the January 9,
C1989 Master Plan Zoning Revisions, the relief requested in this
application is not under the nonconforming sections of the code
and was applied for a variance under the "permitted use" section
of this R-40 Zone District.
7. For the record, it is noted that expansions,
enlargements, alterations or reconstruction of nonconforming
buildings and/or nonconforming uses are not permitted without
variances from the Board of Appeals (Section 100-243 of the
Zoning Code) .
8. It is the position of the Board Members that the grant
of the subject variance under the present terminology and
definitions of the current zoning code is not. appropriate.
9. In considering this application, the Board also finds
and determines:
(a) sufficient proof has not been demonstrated as
required by the statutes to show that: (1) the property cannot
yield a reasonable return with underlying facts in dollars and
cents proof; (2) the burden of proof of unnecessary hardship or
that literal. application of the zoning ordinance would result in
unnecessary hardship has not been sufficiently met (Otto v.
Steinhilber) ; (3) the use to be authorized will not alter
the essential character of the locality;

application of MATTHEW KAR as applied under Appeal No. 3946,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the 16' X 37' addition be located as indicated in
on the survey submitted.
2. That the proposed addition not extend any closer than
eleven (11+-) ft. to the rear property line and fifteen (15+-).
ft. to closest side yard on north side of property.
