The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees. of written notice from such other governmental or municipal authorities of its refusal or . disapproval. The applicant 'does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted; do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. .. . This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. Haje, President En-Consultants, Inc. 1329 North Sea Road Southampton, New York 11968 Re: Olof Nelson - Application No. 467 Dear Mr. Haje: The following action was taken by the Board of Trustees during their regular meeting held on March 26, 1987 regarding the above referenced matter. WHEREAS, En-Consultants, Inc. on behalf of Olof Nelson applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 7, 1986, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on March 26, 1987 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that En-Consultants, Inc. on behalf of Olof Nelson BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a timber dock consisting of a 4 . x 5 ramp extending from lawn onto a 10' x 10' deck landward of marsh fringe; a 4' x 60' fixed, elevated (4' above grade of marsh) walkway; a 4' x 16' finged ramp; (2) 8' x 16' floats secured by (5) 12" pilings. Property is located on Fishers Island. This permit is issued with the provision that a 4' x 40' fixed dock is constructed. e Olof Nelson - Page 2. This permit will expire on March 26, 1988 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. Haje, on behalf of the applicant, En-Consultants, Inc. : It is a straight forward application. If you have any questions on it I will be glad to answer them. Trustee Krupski: Ellen and I were out there earlier in the year, we met with some people that were concerned with possible navigational problems. It is a busy area. They were concerned with.the length of the dock. Roy Haje: It is a busy area but it does not extend out into the navigable channel way. We have taken that into account because we know that there was a problem with a fellow down the way, 500 or 600 ft. or so away. That was a considerably a longer dock. This area is not part of .the channel way. s Trustee Larsen: We saw moorings that were about 100 ft. off shore. Trustee Smith: They would have to stay away from the channel also. Trustee Larsen: I don't have a problem with the length of the dock, other than - it interfering with the moorings that had been previously secured immediately adjacent to the end of the dock? Nelsonts projected dock. It should be noted that I do not ' oppose per/se the building of a dock on Mr. Nelson' s property. If handled well it could have a beneficial impact on the area, particularly on marine life, fish, etc. which often use docks and piers for shelter from predators and for food from mussels, minnows, small crabs, etc. which swarm around docks and their pilings. There are, however, several caveats and precautions that must be strongly considered also, including: (1 ) A fringe of salt water marsh grass extending from the rocky upper shore-line to the waters edge at high water. Though not wide, this type of marsh grass bordering much of !,,lest -7arbor in this area is environmentally significant and must be considered in assessing the environmental impact of dock construction on the affected area. I believe representatives from the New York State Department of Environmental Conservation (DEC) have inspected the site of Mr. Nelson' s proposed dock, and I would certainly defer to their judgement on the ecological significance of this narrow strip of marsh grass. (2) According to the plans submitted, ?+fir. Nelson's proposed dock would jut at least 85 feet into West Harbor from the mean high water mark on shore. This would bring the docks' seaward edge extremely close to the Alrn&dy existing mooring area in West Harbor, if not actually inside it. Island Harbormaster John Clavin has already written a letter referring to the possibility of such a long dock structure impacting marine traffic around already existing mooring areas, which are here very close to shore. In my judgement, Mr. Clavints concern is well-founded, particularly since moored boats swing with the wind and tide in a circle that can easily have a radius of 100 feet or more. Summer mooring markers are quite visible even in winter, and a marine traffic conflict, especially involving the large keeled sailboats who use these moorings in the warmer months is a distinct possibility. con't. 2 In conclusion, I feel that the Southold Conservation Advisory Council and the Southold Board of Town Trustees should take -both these caveats into consideration before making a recommendation or a ruling on Mr. Nelson' s permit application. It should also be noted that the N.Y. State Department of Staters Coastal Management Program has jurisdiction over shoreline docks, etc; or anything that tampers with or disturbs the shoreline.
