Box 962 Mattituck, NY 11952 At a Meeting of the Zoning Board of Appeals held on April 27 , 1983 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [x] Request for Variance to the Zoning Ordinance Article III, Section 100-32 [ ] Request for The public hearing on this matter was held on April 20, 1983. Upon application of HENRY JOHN PAVLAK, 3505 Grand Avenue, Mattituck, NY for a Variance to the Zoning Ordinance, Article III, Section 100-32 for permission to construct accessory garage structure in the sideyard area. Location of Property: . 3505 Grand Avenue , Mattituck, NY; County Tax Map Parcel No. 1000-107-01-005. The board made the following findings and determination: By this appeal, appellant seeks permission to construct a 22 ' by 32' accessory garage structure to be located in the northeasterly sideyard area, approximately 65 ' from the existing 12-story frame dwelling, and between 10 and 15 ' from the rear property line. The parcel in question contains an area of . 9265 acre with 228 .12' front- age along Grand Avenue. The depth of this parcel in the area of the existing dwelling and proposed garage is 94 . 89 feet; the dwelling is set back 42' from Grand Avenue leaving very minimal rearyard building .area. It is the opinion of the board that` the relief... requested ,is reasonable and most feasible under the .circumstances. In considering .this appeal, the board determines. that the variance request is not substantial in relation to the requirements of zoning; that the circumstances are unique; 'that by allowing .the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a. method feasible for appellant other than a variance; that the relief requested will be in harmony with and promote the general purposes, of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors , the interests of justice will be served by allowing the variance as indicated below. On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was RESOLVED, that Appeal No. 3098 , application of HENRY JOHN PAVLAK for permission to construct a 22 ' by 32' accessory structure for garage purposes in the sideyard area as applied, BE AND HEREBY IS- APPROVED, SUBJECT TO THE FOLLOWING CONDITION: (CONTINUED ON PAGE TWO) DATED: May 6 , 1983. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( 7) A Variance to the Zoning Ordinance is requested for the reason that accessory garage must be built in side yard as we have no back yard. Form ZBl (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unnece�- sary HARDSHIP because we have no baeic yard. 2. The hardship created is UNIQUE and is not shared by .all properties alike in the immediate vicinity of this property and in this use district because the property line is 25' behind the house leaving no alternative but -to build the accessory ;;;rage in the side yard. 3.
