Box 295 East Marion, NY 11939 At -a Meeting of the Zoning Board of Appeals held on JANUARY . 13, 1983 the above appeal was considered , and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property .New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [X ] Request for Variance to the Zoning Ordinance Article VII , Section 100-70 (C) [1] [ ] Request for ---------------------------------------------------------------------------- The public hearing on this application was also held on 'January 13 , 1983. Wd;lvs k, Upon application for CATHY T^oSq<--j , by Robert Ketcham, Box 295 , East Marion, NY for a Variance to the Zoning Ordinance , Article VII, Sec- tion 100-70 (C) [1] for permission to place wall sign on existing building at 27980 Main Road , Cutchoque , NY; County Tax Map Parcel ID No. 1000- 102-86-part of 006 . Zoning District: B-1. --------7------7---------------- ---- ---------------I------------------------- - The board made the following findings and determination: By this appeal , appellant seeks permission to place a wall sign , to be attached at the west side wall of the existing business structure, advertising the business conducted within this building, which at the present time is "The Alleluia Shop - A Christian. Family Gift Store. " The premises in question contains an area of approximately 6 ,175 square feet with approximately 65 feet of frontage along the Main State Road, and is zoned "B-1 General Business. " Currently under Article VII of the Zoning Code , there are no provisions or regulations concerning signs , which have inadvertently been left out. It is the feeling of the board that the provisions stipulated in Article VI , Section 10060 (C) [2] should be applied to the B-1 Zoning District as well as the B-Light District. In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of the zoning code; that the circumstances are unique; that by allow- ing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method fea- sible for appellant other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors , the interest of -justice will be served by allowing the variance , as indicated below. On motion by Mr. Douglass , seconded by Mr. Griqonis , it. was RESOLVED, that Appeal No. 3064 , application for CATHY VOT71-N-aKI (WILINSK_, for permission to attach sign to west side wall of existing building, BE AND HEREBY IS APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: (CONTINUED ON PAGE TWO) DATED: January 26 , 1983.
