Terp [Appel. nt (s) ] 1435 Hobart Road Southold, NY 11971 At a Meeting of the Zoning Board of Appeals held on September 13, 1983 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [X] Request for Variance to the Zoning Ordinance Article III , Sections 100-31 and 100-34 [ ] Request for . The public hearings on this application were held on June 23, 1983 and July 28, 1983. Upon application .of ALFRED J. TERP, 1435 Hobart Road, Southold, NY for a Variance to the Zoning Ordinance, Article III, Sections 100-31 and 100-34 for permission to construct bathroom addition to dwelling leaving an insufficient sideyard setback, at 1435 Hobart Road, Southold, NY; County Tax Map .Parcel No. 1000-064-002-012. The board made the following findings and determination: By this appeal, applicant seeks permission to construct a 6 ' x 15. 4 ' addition along the northerly side of the existing dwelling structure, 8. 3 feet from the northerly property line (as shown on survey dated May 11, 1983 by Young & Young) , exclusive of patio setback, for use as a bathroom. The premises in question contains an area of 11, 250 square feet with 75' frontage along Hobart Road. The setbacks of the existing one-family dwelling are: (a) 37. 2 '. at its nearest point from Hobart Road; (b) 14 .1' from the northerly side line [excluding root cellar-patio] , and 4. 5' sideyard setback from the existing root cellar-patio,. which construction has not been approved by the building department to date (see letter of July 5, 1983 from the building inspector) ; (c) 19. 8 ' from the southerly side line; . .(d) 96 ' rearyard setback. At the back porch area (which would adjoin the .proposed 'a.ddition) there is an entrance stoop approximately 7 ' by 7. 6 ' . Also existing on the premises is an accessory garage structure in the extreme southwest corner of the rearyard. . For the record it is .noted that the dwelling on the .parcel north of the subject. premises is set back approximately 14. 5 feet from the same lot line, being their southerly. side line.. Existing between the two properties is a stockade fence which is. shown on the above- mentioned survey as being- 0. 2 feet south of the applicant' s property line and 0. 8 feet at the extreme west end of this side yard area. In considering this appeal, the board determines: (1) that the variance request may be detrimental to adjoining property; (2) that the relief requested will not be in harmony with or pro- mote the general purposes .of zoning; (3) that the relief requested (CONTINUED ON PAGE TWO) DATED• September 21, 1983. Would not permit a bathroom on the first floor. 2. Placed to the East, I would have to rip out' my back porch and build a foundation, which would then create a 20 feet wall instead of the existing 12 feet wall. 3. Placed to the West, I would have to build a foundation and change my grease trap. 4. Placed to the South, I would have to build in my driveway. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because _ Of the way the house and drive are situated on my property, 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because 1. The architecture of my house will be unified. 2. FOURTH: The necessity for an application for a variance , and the area variance sought , was for permission to construct a bathroom addition to petitioner,' s dwelling, which dwelling pre-existed and does not conform to the present 15 foot side yard requirements of the Zoning Law of the Town of 'Southold. FIFTH: That petitioner ' s residence which pre--dates- the-present zo-ni-n-grequirements is set off 14 ' 1" from his side property line (see annexed survey) . SIXTH: That petitioner ' s property contains a 15 ' 4" by 9 ' 6" root cellar with a concrete slab over it, which is at ground level, and has been used by petitioner as a patio. SEVENTH: That at all times, hereinafter mentioned, the property for which the area variance has been sought has and is being used and maintained by petitioner as a residential dwelling in a Zone A-1 Residential Area. EIGHTH: On or about the 23rd day of June, 1983 , and the 28th day of July, 1983 , petitioner appeared before the said ZONING BOARD OF APPEALS and presented facts and exhibits which showed that a practical difficulty 'existed with respect to petitioner ' s property. i -2- NINTH: That petitioner demonstrated by his testimony and the affidavit and exhibits he presented that the proposed 15 ' 4 " x 6 ' addition to his residence could only be practically built over the existing patio slab and cellar as the proposed addition would be off the petitioner ' s kitchen, as opposed to an addition to the rear of the house which would require the exten- sive remodeling of the dining area. TENTH: That petitioner demonstrated that it is im- practical and economically unfeasible to completely remodel peti- tioner ' s first floor of his residence and- -add an- additional foundation to accomplish what can be more easily accomplished by the G ' addition over the existing cellar and foundation. ELEVENTH: That the existence of practical difficulty on the part of the petitioner was and still is uncontroverted by any source, other than the decision of the ZONING BOARD OF APPEALS (see decision annexed hereto) . TWELFTH: That the ZONING BOARD OF APPEALS used an incorrect standard for the denial of petitioner' s application, in that they cite "uniqueness" as a criteria in denying peti- tioner ' s application. THIRTEENTH: That the standard of "uniqueness" is a criteria for a "use'" variance and not for the requested "area" variance. FOURTEENTH: That the denial of said area variance was arbitrary , capricious and unwarranted, in that , the decision -3- misinterpreted the authority of .the BOARD to issue such. variance. FIFTEENTH.: That the denial of said variance was arbi- trary, capricious and unwarranted in that it took into considera- tion criteria which ought not to be considered in the denial of an area variance. SIXTEENTH: That the denial of said variance was arbi- trary, capricious and unwarranted in that the requested variance will in no way alter the residential character. of the neighbor- hood, as all of the adjoining properties have inadequate set- backs under the present zoning laws . SEVENTEENTH: That, in fact, the majority of the homes and accessory buildings in the "Founders Estates" subdivision have been built within five feet of the sideyard property lines, as they were constructed when the sideyard requirement was three feet; and any recent construction on these quarter-acre building lots has involved variances granted by the Zoning Board of Appeals due to insufficient sideyard setbacks. EIGHTEENTH: That it is the character of this "Founders Estates" development to have all the structures with insufficient sideyard setbacks . NINETEENTH: That the denial of said area variance was arbitrary, capricious and unwarranted, in that, the BOARD has granted variances under similar circumstances involving insuf- ficient sideyard setbakcs. - 4 - TWENTIETH: That the denial of Petitioner ' s applica- tion for. said. variance was arbitrary, capricious and unwarranted, . . in that," the evidence submitted by Petitioner establishes beyond any reasonable doubt that practical difficulty existed if said variance was not granted. TWENTY-FIRST: That the power to issue such variance is within the authority of :.said ZONING BOARD OF APPEALS. I I ` I - I I I I I I i - I S` STATEMENT The instant c,: se involves an application to the Southold Town Zoning Boaid of .Appeals for an area variance so the petitioner may construct a � bathroom addition to his dwelling at 1435 Hobart Road, Southold, � Suffolk County, New York . The Southold Town Zoning _Board of Appeals in its decision to deny the variance request cited the following reasons: 1) That the variance request may be detrimental to ad 3oining property; I 2) That the relief requested will not be in harmony with or promote the general purposes of zoning; I 3) That the relief requested may alter the essential i character of the neighborhood; 4) That the difficulty can be obviated by a method other than a variance; 5) That the circumstances are not unique; 6) That the interests of justice would best be served by denying the variance applied for. The decision contains no rationale for these conclusions, and no explanation nor factual basis is cited as to how these con- \ I clusions , whichlformed the Board' s decision; were arrived at . . II I� �I I I . I i THE CRITERIA FOR THE 'GRANTING OF AN AREA VARIANCE IS THE DEMONSTRATION . OF . A PRACTICAL it DIFFICULTY It is well established in New York thatan area variance i only requires the showing that a practical 'difficulty exists; that the New York courts have long held that the requirement of a necessary hardship ('or economic hardship) has application only to a use variance, as an area variance involves no real change in the character ofia zoned district. Bronxville v. Francis, 1 App. ' I Div. 2d 236 (1956 2nd Dept. ) As pointed out by .Mr. Justice Meyer in Wachberger v. Michalis, 19 Mise 2d 909 (1960) , the criteria that a .Board should consider are: I I " . . . (1) how substantial the variation is in relation to the requirement, (2) the effect whichlany .increased population density caused by.%the ,-variance would produce on available governmental facilities for fire, water, garbage and the like, (3) whether a substantial change would be produced in the character of the neighborhood or a substantial detriment to adjoining properties,. (4) whether the diffi- culty,,can be obviated by some other method, feasible for the applicant to pursue, . and (5) whether in view of the manner in which the ' difficulty arose and considering all of the abovelfactors, the interests of justice will be served by allowing the variance. Further - more, � (6) if the board inspects the property, its decision must set forth the facts ascer- tained upon such inspection which support its determination. " . In theicase at bar, it is obvious that the respondent Board used improper criteria in the determination of petitioner ' s application. � -2- I I I A1so, ', apart from the bare recitation of the physical characteristicsl� of the subject premises , the decision is completely devoid of any facts ascertained upon an inspection which support its determination. I Furthermore, as can be seen by this Court, the decision is completely devoid of any facts warranting its conclusions . The Zoning Board simply states that. the proposed change "may be" detri- I mental to the adjoining property without determining the health or safety hazards which form the basis for such a conclusion. In fact, the Board has even failed to determine if there would be a I detriment but rather concludes there "may be" . The Board also states " . . .that the relief requested will not be in harmony with or promote the general purposes of zoning" , which is not a criteria to be considered in .granting or denying an appeal, nor does the Board explain what it means by or how facts compel such a conclusion. Thirdly, the Board concludes the relief requested "may alter the essential character of the neighborhood" . The fact of the matter is that the variance requested is an "area" variance and not a "use" ,variance, and that the neighborhood will remain residential and1will not change in any essential character. The Board points out that "the difficulty can be obviated by a method other than a variance" , but fails to explain how it i arrived at this !conclusion, and also fails to consider the balance of the criteria which is feasible for the applicant to pursue . j -3- it n I, I The petition of ALFRED J.. TERP and the testimony before the Board demonstrate that remodeling of an entire floor is not a feasible alternative to a six foot. addition to the side of a dwelling. Finally, the Board considers "uniqueness" which is not a consideration for an area. variance and concludes without re- course to facts 'that the application is not "_unique" . I CONCLUSION As the� Southold Town. Zoning Board of Appeals decision is completely devoid of any factual basis other than mere conclu- sions, and the Board has either considered criteria not applicable to an area variance or misconstrued the proper criteria, the decision rendered is arbitrary as a matter of law, and the relief demanded in. the petition: should be granted. . Due to the frontage of this parcel along more than one access road or right-of-way, the building area of this parcel is technically considered all "frontyard area. " It. would be impractical and unfeasible to build in any other yard area of the premises in question. The board agrees with the reasoning of appellants. CHAIRMAN GOEHRINGER: We have a copy of a survey dated May 11, 1983 indicating the nature of the proposed addition, which is approximately 9. 6 ' in width. TERP, continued: ) MR. CHAIRMAN continued: the surrounding properties in the area. And I have one letter of opposition in the file. Mr. Terp, would you like to be heard in behalf of your application? Could I ask you to use the mike please. ALFRED J. TERP: Yes. The map that shows that 9. 2, I think it is , feet to the north, I did not wish to extend all the way of that 9. 2 feet, and I wish to go only north about six feet, and there is a slab there over a foundation, which was originally built as a root cellar in the years that go back. And as I stated in the application, any of the other places that put it would either put the bathroom off of a kitchen or off of a dining room or a living room. And it will only be a one floor---in other words it would not be the height of a two-story house. It would only be the height of the existing one-story addition which was there ever _ since the house was built and we would only move that wall 6 ' further to the north from where it is now and that would certainly allow me to put it in. Now another reason, maybe you gentleman and ladies don't know, many of the houses that are in the Founders Development have -- and we 're going around the area -- are inadequate according to the new law-- .a side yard, and as I say I really don't think it would really detract on any value or the aesthetics of the character of the neighborhood of that particular development. That' s been there since 1931 , I think, was when it was started. MR. CHAIRMAN : You' re presently using this as a patio, is that correct? MR. TERP : My wife is, yes. Well we both do. MR. CHAIRMAN: That' s the only question I have at this time. Is there anybody else that would like to be heard in behalf of the application? Would somebody like to be heard against the application? Ok, would you please state your name? MRS. STELZER: I'm Emmy Stelzer and I live next door to Mr. Terp. As I understand it, and I think. Mr. Fisher is familiar with this. When he built that side, it was supposed to be a patio on low level ground which was built up with tiers of block and the dirt was piled up around it. Now I spoke to Al; he asked me; and it' s going to hurt the sale of my property to have him right on the line. There' s just about this much room to walk through. He has a 6 ' fence up there now, a hedge--you can' t walk through there and it' s going to be right on my living room side, this bathroom that he is applying for. They have a bathroom upstairs. There' s plenty of room in the back. . And I can' t understand -- my air is going to be cut off. I have fences on both sides of me and houses and I only have a' 75 ' lot and I think it' s within my interest to protect my property. If it was a hardship , it would be a hardship for me. It' s practically in my yard now on the side porch. Have you people.-been down to check this? MR. CHAIRMAN: Excuse me, Mrs. Stelzer--you have to address the questions to the board because we're taking this down. MRS. STELZER: Oh, I'm sorry. I don' t know-- and I don't want any trouble--but I do think I'm in order to protect my property. For the past week or so they've been taking sand from the back cellar door--load after load. Now where it' s coming from, I don't know. It' s coming from the cellar. MR. CHAIRMAN: Ok, would you like Mr. Terp to respond to your requestions? MRS. That' s what I would like to know. MR. TERP : Yes. I'm not going over the whole thing. I didn ' t ask for that. MRS. STELZER: Well I didn' t know, Al. You didn't come back and say anything to me so I didn' t know what was going on. And I do object very strongly. It is right on my line , on my living room line. He doesn' t want a bathroom on his --where the dining area is. MR. TERP: If you looked at the existing houses to the north and including Mrs. Stelzer, I believe you will find that one of her bathrooms was very close to the main that' s next door and his porch is about 3 ' from the line, and many of the houses that had these insufficient or deficient say, sideyard properties there , and every- body ' s been getting along for many, many years. MRS. STELZER: The man who owns the house on the left is my attorney. I asked 'him to appear here tonight , but he was unable to, to explain this. That property that was built before was put there before zoning came in, and it is practically in my driveway which this of course is on the other side of my house. Have you people been down to see this? Do you see what a hardship it is going to cause me? MR. CHAIRMAN : We were down last Friday night. MRS. STELZER: Taking the wind out and so forth. That Ms. Stelzer is incorrect in her statement about the "alleged" permission granted by the then Building Inspector Howard Terry; that in fact when the cellar and its roof . (patio) were constructed, no permission was required and no permission was sought from Mr. Terry, and that petitioner has a, legal right to maintain his pre-existing, non-conforming use regardless of the Present building code requirement. 6 . That the petitioner ' s building line is approximately 4 . 5 feet from the property line, and petitioner .has the legal right to maintain this pre-existing, non-conforming use to the fullest extent of the law, which does include building to and above the already pre-existing building line . 7 . That Ms . Stelzer is also incorrect in her assertions . about the petitioner ' s living arrangements; that in fact two of my children are living in the house between 20 and 22 weeks a year, 8 . That Ms . Stelzer ' s speculation as to what is archi- tecturally feasible , sound and aesthetically pleasing has no factual merit, and is not worthy of serious consideration_ by this Board . 9 . Petitioner has consistently done what he pleases over the years without regard to any law or authority. He has constructed a two story garage behind his house which has severely curtailed the air circulation and now plans to add an extension to his house which would only be 4. 5 feet from my property line. When he was originally given permission to build the patio on the north side of the house it was to be ground level only, to be used strictly as a patio. Instead, he raised it two levels of cement block so that it would be event with the existing structure. His ultimate goal and plan at the time was to add the proposed extension. For the past two weeks, he has escavated the basement, pail by pail and it appears that he has started construction of the proposed addition. To grant petitioner the right to build now would be to reward him for his disregard of the right of others. -1- 2. The alleged permission to build the patio came from Howard Terry, who now clearly states that he gave verbal permission to build a patio only with the understanding that petitioner would never build over the patio or request permission to do so. the enclosing of the patio which would only leave a 4. 5 foot side yard set back is a clear violation of the building code. 3. There is no hardship involved. Petitioner has a wife and three (3) children. All the children are either in college or in prep school and do not live at the premises . Petitioner has a full bathroom on the upper level where the bedrooms are located. If a one half (1/2) bathroom is essential on the ground floor, Petitioner can use the existing 61foot addition for the 1/2 bathroom. 4. Petitioner could also easily build to the rear of the house and add to any part of the 12 feet that faces the rear yard. His statements in the application are grossly in error. Perhaps it would mean a little extra work and money on his part but his application is based on hardship and not of convenience. Both I and my attorney have examined his property and the survey attached to his application and there is no doubt that the proposed extention could be added to the. rear of the house. The statement in Petitioners application that "the ardh teeture of my house will be unified" As ludicrous. A bathroom way off to the side of the house can hardly be said to unify a house. Perhaps a 1/2 bathroom off the kitchen near -2- the porch as indicated above would be more in keeping with the architecture of the house. 5. Your deponent is past retirement age and is contemplating a sale of her-house. Any construction as proposed by the petitioner would severely depreciate and restrict the saleability of my. house. No one would want to buy the house with the petitioner' s bathroom only 4. 5 feet away from my property. As it is, I can clearly hear the Petitioner and his wife now every time there is a family dispute. Talking to George Fisher, Sr. Building Inspector, he gave me the following explanation. Mr. Terp talked with Howard Terry and Mr. Terry said if the finished slab (patio) were ground level, no permit was necessary. Shortly after, Mr. Terp wanted a root cellar under the slab and the ruling was the same. When the work was all complete, the slab was above ground eighteen inches to two feet. This was a violation, but I am told that if Mr. Terp agreed to 1) regrade the property to top of the slab and 2) if he agreed not to ever construct on the said slab, then the whole matter would be resolved. Again this is strictly a verbal okay and heresay. Whether Mr. Terp or Mr. Howard would verify this I could not say.
