N.Y. 11971 TELEPHONE (516) 765-1809 ACTION OF THE ZONING BOARD OF APPEALS Appeal No. 3185 Application 'Dated October 26, 1983 . TO: Suffolk County National Bank [Appellant (s) ] 31225 Main Road, Box 702 Cutchogue, NY 11935 At a Meeting of the Zoning Board of Appeals held on November '30,: 1983 the above appeal was considered, and the action indicated .below _was_.taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [ X] Request for Variance to the Zoning .Ordinance Article VII ., Section 100-70 (C).12]. [ ] Reque'st for The public hearing on this application was al-so, -held -on. -November -30, .. 1983. Upon application of. THE 'SUFFOLK COUNTY NATIONAL BANK., Box 702, Cutchogue,. NY for a. Variance to _the 'Zoning.___Ordinance, Article. VII, Section 100-_70..(C) 12) for permission to have second identification sign .i on side of building facing the parking lot (Keyfood Shopping Center)_, . at premises known as,. 31225 Main. Road,-, Cutchogue,, NY; County Tax Map . : . . . . . . . . Parcel No.. .1000 .097 .0.5=012 *., The board made the following findings -and determination: By this appeal, applicant seeks permission to retain a second existing identification_ ..sign which is. located at the east side of the Suffolk County National Bank building in the KeYfood Shopping }A Center, Cutchogue, New York. The size is 32 ' by 2 '-„and is specifi- ?J cally located on the side gable area of ,the. roof. Section 100-70 (C) _] f of the zoning code refers _back to. Article. VI, Section 100-60 (C) [2] , i subsection (b) of. which permits one wall sign and subsection (c) _of which permits one roof sign, on a public street. It is the opinion of the board that since the code permits two building signs in a business district, that the relief requested in ."this, application will be. in harmony with and promo te the purposes and intent thereof. It is also the opinion of the board members . that the subject sign may face an area. other than the public street inasmuch-as it will be visible for the traveling public along the Main Road and adjacent to the Keyfood Shopping Center parking lot. In considering this appeal, -the board determines: (1) that the practical difficulties. have been shown and are sufficient -to warrant the granting -of the application as noted below; (2) that the- relief as noted below is .not substantial in relation to the requirements of the zoning code; (3) . that the circumstances are unique; (4) .that . the relief as approved will be in harmony with and promote the general purposes of zoning of the protection and promotion of the public health, safety .and. welfare; (5) that the interests of .justice would be served by approving the application as noted below. _. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Sawicki, it was (CONTINUED. 'ON PAGE 'TWO) DATED: December, 13, 1983. Such appeal was ( ) request for a special permit ( ) request for a variance and was made in Appeal No. ................................Dated ...................................................................... REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( X) A Variance to the Zoning Ordinance is requested for the reason that we would like to have, two signs on the Building, One facing the public highway and one facing the parking lot which has a large amount of traffic: Form ZB1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the construction of the signs are such that it is impractical to use them or either one of them as wall signs. The building is constructed in such a way as to make the use of a wall sign on either the south or east walls impractical. Our building is so close to the road that two roof signs would help our advertising and our image because cars travelling either east or west on Route 25 would see one of the signs. 2. The hardship created is UNIQUE and is .not shared by all properties alike irl the immediate vicinity of this property and in this use district because the other properties are set back quite far from the road and only have one exposure. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because we are set back far enough that the two signs would not interfere with traffic. The signs would be muted enough and high enough not to interfere with driver's eyesight. The signs are designed in such a way that they actually "dress up" the shopping area. Such appeal was ( ) request for a special permit ( ) request for a variance and was made in Appeal No. ................................Dated ...................................................................... REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (X ) A Variance to the Zoning Ordinance is requested for the reason that we would. like to have two signs on the Building, One facing the public highway and one facing the parking lot which has a large amount of traffic: Form zB1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces— sary HARDSHIP because the "-nstruction of the signs are such that it is impractical to use them or either opt: them as wall signs. The building is constructed in such a way are to make the use of a wall sign on either the south or east walls impractical. Our building is so close to the road that two roof signs would help our advertising and our image be cars travelling either east or west on Route 25 would see one of the signs. 2. The hardship created is UNIQUE and is not shared .by all properties alike in the immediate vicinity of this property and in this use district because the other properties are set bac lk quite far, from..the road and only have one exposure, 3. The Variance would observe the spirit 'of the Ordinance and ..WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because We are set back far enough that the two signs would not interfere with traffic. The signs would be muted enough and high enough not to interfere with driver's eyesight. The signs are designed in such a way that they actually "dress up" the shopping area.
