I have attached an LWRP Consistency Application Form with all policies indicated as "Not Applicable" due to our understanding that the proposed work constitutes a "minor action" not subject to waterfront consistency review pursuant to §268-5, "Review of Actions." Specifically, the work appears to conform to the following definition of minor action"A" listed under §286-3: "Maintenance or repair involving no substantial changes in an existing structure or facility." Because the bulkhead is located in Mattituck Creek, minor action "GG"would appear to exempt from review the complete replacement of the bulkhead, but since only the above described maintenance and repair work is proposed at this time, I am not sure this definition would be applicable.
