We presently have an applicati.on . pending in which
the property owners propose to locate .a new single-family
dwelling and two accessory buildings .as shown on. the
attached sketch. The subject .premises 'i.s referred to
as Minor Subdivision Lot #1 , 'Cabot ` s. Woods, .and fronts
along the Long Island Sound .
Attached are. photographs of .depressed areas at
the site , together with a ..photocopy of 'the map showing
the access over a private right-of-way extending from
the north side of Middle Road (C . R . 48) , Peconic .
It is the opinion of this Board at this time that
your office may wish to be informed in order that a
determination could be made by the Trustees or the Bay
Constable as to your jurisdiction .
Please feel free to advise the property owners ,
Mr . and Mrs . Richard Greenfield in the event you deter-
mine that an application is necessary before your Board
prior to the issuance of a building permit. Also , if
it is determined that there are freshwater wetland
species growing landward of the bluff area , please
let us know.

All work shall. be in accordance with the attached NYSDEC approved plan.
GENERAL CONDITIONS
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compli-
ance with the ECL,all applicable regulations and the conditions specified herein or attached hereto.
1. The permittee shall file in the office of the appropriate regional permit administrator,or other office designated in the special conditions,a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify him/her promptly in writing of the completion of the work:
2. The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL§71•0301 and SAPA§401(3).
3. The permittee has accepted expressly,by the execution of the application,the full legal responsibility for all damages,direct or indirect,of whatever nature,and by whomever
suffered,arising out of the project described herein and has agreed to indemnify and save harmless the State from suits,actions,damages and casts of every name and descrip-
tion resulting from the said project
4. The Department reserves the right to modify, suspend or revoke this permit at any time after due notice,and, If requested, hold a hearing when:
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found;or
b) the permit was obtained by misrepresentation or failure to disclose relevent facts:or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
S. The permittee is responsible for keeping the permit active by submitting a renewal application,including any forms,fees or supplemental information which may be required
by the Department,no later than 30 days(1B0 days for SPDES or Solid or Hazarduous Waste Management permits)prior to the expiration date.
6. This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights,title or interest in real or personal property held or vested in a person not a party to the permit.
7. The permittee is responsible for obtaining any other permits, approvals, lands,easements and eights-of-way which may be required for this project.

In conformance with the requirements of the State Uniform Procedures Act
(Article 70, ECL) and its implementing regulations (6NXCRR, Part 621) we are
enclosing your permit. Please read all conditions carefully. If you are unable
to comply with any conditions, please contact us at the above address.
In addition to the added special conditions, our Bureau of Marine Habitat
Protection, as a result of their field inspection, recommends stabilzing the
eroding portion of the cliff with- plantings in accordance with the U.S. Soil
Conservation Services recommendations.
Also encloseiis a permit sign which is to be conspicuously posted at the
project site and protected •from the weather.
