Box 5 Cutchogue NY 11935 Re: WALTER GREEN SCTM #70-6-20 Dear Mr. Dempsey, The following action was taken by the Board of Trustees at their regular meeting of February 28, 1995: RESOLVED that the Southold Town Board of Trustees deny the application of WALTER GREEN to construct a 4' X 24 ' catwalk, a 3' X 12 ' ramp and a 6 ' X 20' float based on the standards set forth in Chapter 97-28F that "could adversely affect the navigation of tidal waters", and Chapter 97-38I that "otherwise adversely affect the health, safety and general welfare of the people of the Town" , in that this structure just doesn't seem to be appropriate for the size of the property and that the property lends itself to access to the water not a structure on it. Mr. Green has asked to to check with you for alternatives for his situation. Mr. Green has advised me that he has a bad leg and can submit a letter from a doctor if necessary. He would like to have some type of access , perhaps a. small floating dock for his dinghy, to get to his moored boat. In other words, some type of docking for the dinghy so he can step down into it rather than having to haul it and step up into it. Please contact me with your thoughts. Thank you. Mr. Green has less than ten feet of property on Jockey Creek. I can't see how approval could be granted him to construct any kind of dock. There just is not room enough for Mr. Green to have a dock and not invade other peoples areas. I have lived at my present address for thirty eight years. We and our children enjoyed our waterfront as they were growing up in this de- lightful area. Now when I might have enough time to enjoy my waterfront I am confronted with the possibility of a dock being built on less than ten feet of owned land. My wife and I are very much opposed to the approv- al of this application. I am enclosing a letter I sent to the Department of the Army when Mr. Green requested permission from them. The Department of Army sent an individual out to inspect the site and I assume turned down Mr. Greens request. Mr. Walter Green's house is on the market for sale and I feel certain a dock would be an advantage to him. It certainly would not be to my property. Please deny his request. I am of the opinion that the width of Mr. Green's property at the water line is approximately ten feet or less. This being the case, I can' t see how your department could consider his request. If his request for a twenty foot by twenty foot float at the end of a twenty-four foot pier were approved this float would extend outside the limits of his property. The diagram of application #94-06430-L2 does not show my float of twenty by twenty at the end of my ramp. If 'the application were approved it would be virtually impossible for me to bring my boat into my dock. I know Mr. Green owns a sailboat with a length in excess of thirty feet.
