A regular meeting of the Southold Town Board of Appeals was
held Thursday, July 9, 19599 7:30 P.M. , at the Town Clerk's Office,
Main Road, Southold, New York.
There were present: Messrs. Robert W. Gillispie, Jr. , Chair-
man, Robert Bergen, Herbert Rosenberg and Serge Doyen, Jr.
Absent: Mr. Charles G?igonis j Jr.
Also present: Mr. Howard M. Terry, Building Inspector .

special exception in accordance with the Zoning Ordinance, Article
IV, Section 408, for permission to erect and maintain a directional

Horace Kysera I do not- believe.:there was such a request, that, the
was prepared.-to -read as is, _in the- section of the Ordinance-. Although
it tras suggested to us that we amend' the application we had not =dis-
cussed .or considered it. I do not know' what fir. �:yser has in mind
but I bolieve is, interest. is to 'us-e . the premises as . a gasoline service
station and I ,think that the property was formerly operated by an out-
board sales sand. service agency and wa.s at one time an automobile. agency.
I think Mr. 1rKyser is sole interests at this .time would be to -use the
property as a gasoline . service station- but, I would like to. have ,Mr.
Kyser • tell you the reason .the . applica:tion was made _for .a public garage,
what his interests are in. that respect.

used as a service station for a good .many, years.- 'When I bought it
-the pumps were in the 'station. and owned by ESSO Standard Oil.: I
want to continue the operation of the service station and , in the same

I wish to state that this .was ..purely an unintentional e rror.• We
'double checked ,and .measu.red carefully. But when the,'Building Inspector
came down he found us; in violation..

finding that strict application of. the 'Ordinance,'.would produce undue
hardsrip' because if it were, :not granted it would` 're,quire the redesign-
ing of •the -entire interior ' of the house. The situation is., unique and
would not be.-shared by all properties"alike ',in the immediate vicinity
because the nearest -house is, located -200 feet' away from, this-house.

considered at Public Hearing .No. 197 on July .9, 19599 and the ,Board,
finding that strict application of the Ordinance would produce .undue
hardship because of the unusual topography of the lot. The situation
is unique and would. not be shared .by all properties alike in the .
. immediate vicinity- because this is a corner lot and the depression
to the east side of the lot makes it undesirable to build,. The public
conven ience and'.welfare . and-, justice will be substnatially served and
the legally established or permitted use of neighborhood property and
adjacent use districts would not be substantia7.ly or permanently
injured and the spirit of the Ordinance would be observed because

Mx. Pancoastls son-in-law, Mr: William Rogner; is the owner of the former
Mahlon Dickerson house .on Bayview;Road, Southold., New York. This is .
a white, two and one halfstory- •'oil heated, , approximately 85 x 40 -
house, 'with about' to large rooms, . three and one, halr baths, six fire_
places, accessory buildings, two acres of land. Mr. Rogner has , found
the house far too large for a single. family residence and presently
has it for sale, . and has found 'a purchaser, for the property, the
Christian Science. Church,. who propose to use the premises for a
home ror �retired people of �their organization_ Before going through
with the purchase the Christian Science Church wishes to know whether
the house ''could be' used for, such, a purpose (home'L. •ror retired people ). ,
Mr. 'Pancoast stated that he has been advised -by tie organization that
-this will°'be a non-profit use of, the property. :
Mr: Edson' speaking for Mr: Pancoast, contends that the' use , comes
under .Article III Section 300, Subsection 5 or '8 o'r '.the Building.
Zone Ordinance. �he- members 'of the Board o_f 'appeals aZ 1 feel .that the
tse is-strictly one or an "M" Multiple' Residence District. and there-
rore a change of' zone ,would be` required. A':lengthy discussion was
held by ' the Board and Mr. Edson and it was decided that. the only
solution would .be to- con-Per' with the Town 'A ttor'ney .and learn his
opinion in. this matter. , The Board advised Mr.. Edson that such a'
. meeting with the Town 'Attorney would be arranged. .and Mr. Edson
would 'be advised of the time and place in order that he may attend.

Mr. George McCarthy, Mattituck, New York, appeared before the
Board of Appeals for an informal discussion relative to tree appli-
cation of Ernest Wilsberg, Jr. , for permissive use rich was with-
drawn. vL. McCarthy was confused as to the reason the application
was ?withdrawn, and just vThat lair. Wilsberg could do with the property
in the future. The Board advised I\Ir. McCarthy that Pis. Wilsberg
would be permitted any use allowed in a "B" Business District on
the property bought :from Mr® Wilsberg, Sr.
To complete the file of Wilfred B. Ruland, Jr. , it was decided
a letter should be forwarded to Per. Roland advising. that it was the
opinion of the Board of .appeals of ter consultation with the Town
Attorney on the night of June 25, 1959, that he is permitted to
move his occupational handicraft to the ?proposed new residence on
Main Road, Mattituck. However, no advertising sign is permitted
at the new location. The only sign permitted is one of two (2)
square feet viith his name only, as agreed
