Southold Town Board of Appeals

A regular meeting of the Southold Town Board of Appeals
was held Thursday, July 16, 1959, 7:30 P.M. , at the Town Clerk's
Office, Main Road, ,Southold, New York.
There were present: Messrs. Robert W. Gillispie,. Jr. ,
Chairman, and Rerbert Rosenberg.
Absent: Messrs. Robert ,Bergen, Charles Grigonis, Jr. ,
and Serge Doyen, Jr.
Also present: IvLr. Howard !'I. Terry, Buildi.rg Inspector.
The Board discussed the revision of the"Action of the Zoning
Board of Appeals", and decided that Item 1. should -read Special
Exception in lieu of Special Permit, and all places where special
permit appeal, to be changed to read special exception.
The matter of setback on lot No. 21, Map of Marion Manor,
East Marion, New York, owned by Andrew Lemon, was discussed.
Mr. Lemon wishes to set his house back 25 ft. from the property
line. He feels if it is set further back it will obscure the
rear view of the adjoining house. After considerable discussion
the Board agreed that Mr. Lemon must set his house back approx-
imately 28 ft. in line with the existing house on the west.

Mr, Terry asked the Board "s cpi_nion on the following : Mr.
Frank Tlanella owns property on-the ,,rest side of Horton Lane to
the property of Mr. H. Jennings. The parcel where the Manella
dwelling is located' (on the corner) is in Mrs. Manellats name
and has been since the purchase of the property. In 1955 Tarr®
Manella leased, with an option to purchase , the westerly portion
of land to Kr. M. Freeman. After two years, possibly three , Mr.
Free��an sold , or assigned his lease to Coast Line Growers Coop,
who picked, up the option to purchase and bought the parcel and
building under lease and option. This leaves Mir . Manella with a
lot of approximately 95 feet frontage anC 11.7 ft. rear and approx-
imately. 137 ft. depth. would it be possible to use this for a
building lot and secure a building permit or would a variance be
necessary first.
After considerable discussion it was the opinion . of the Board
of .Appeals that a. variance would have to be secured before a "red
dence could be erected on the- lot.
TN�r. PancoastIfather-in-law of Mr. William Rogner appeared before
the Board to learn their Final opinion in the matter of selling the
former Mahlon Dickenson house at Bayview,Southold, which is ol,,med
by Mr. Rogner. Arc. Rogner has a buyer (the Christian Science Church)
and they propose to use the house as a home for retired people. At
the last meeting of the Board of Appeals it was decided -tha.t they
would consult the Town Attorney to determine what the lair is in this
case. They then informed T,'Ir. Pancoastthat it is not permissible to
use the premises as a multiple residence without securing a change
of z one
