Location of Property : South Side of Sound Avenue , Mattituck , NY ; Lot #4 , Minor Subdivision of Strawberry Fields , which received Sketch Plan approval July 8 , 1985 by the Town Planning Board; County Tax Map Parcel No . 1000-121 -3-5 (containing 12 . 6± acres ) . WHEREAS , a public hearing was held and concluded on Decem- ber 11 , 1986 in ,the Matter of the Application of EUGENE DAVISON under Appeal No . 3216 ; and WHEREAS ,—at said hearing all those who desired to be heard were heard and their testimony _recorded ; and WHEREAS , the board has carefully considered all testimony and documentation submitted concerni_ng .this application ; and WHEREAS , the board members have personally viewed and are familiar with the premises i,n question , its present zoning , and the .surrounding areas ; and WHEREAS , the board made the following findings of fact : 1 . This is an appeal from 'a Notice of Disapproval from the Building Inspector dated November 10 , 1986 , under Article III , Section 100-30 (A) . Appellant requests permission to build living quarters. for one-family unit at the east section of the second floor of an existing horse stable structure . 2 . The subject premises contains a total area of 12 . 6372 acres , which has received a four-lot minor subdivision sketch map approval by the Planning Board as more particularly shown by map_ surveyed by Roderick VanTuyl , P. C. , amended January 7 , 1.986 .. The second-floor apartment under consideration is proposed on the 9.8-acre parcel referred to as Lot No . 4 . (CONTINUED ON PAGE TWO) DATED: January .8 , 1987 . CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Form ZB4 (rev. 12/81) Page 2 - Appeal No . 3216 Matter of EUGENE DAVISON Decision- Rendered January 8 , 1987 The subject premises is located in the ".A-80" Residential and Agricultural Zoning District . 3. For the record it is noted that Article III , Section 100-31 , Bulk Schedule of the Zoning Code requires a minimum habitable area of 850 sq . ft. , and appellant proposes 1 ,020± sq . ft. of living area . 4. The premises has been and is used for the keeping , breeding , raising and training of horses , domestic animals and/or fowl , as regulated by Subsection (b ) of Section 100-30 (A) [ll of the Zoning Code . It is the understanding of this Board and the' Building Inspector that a variance is requested for this single-family apartment over the stable in. addition to the present use occupying this 9 . 80 acre parcel . A conditional variance was approved by this Board on June 13 , 1985 under Appeal No . 3254 for the 9. 8- acre parcel as noted therein . 5. It was also noted that an application for the "proposed house" as shown on the January 7 ; 1986 survey. has not been submitted to the Building Inspector for his determination and has not been included in the Notice of Disapproval rendered November 10 , 198-6 . In considering this appeal , the board finds and deter- mines : (a ) the relief requested will not be adverse to the safety , health , welfare , comfort , convenience or order of the town ; (b ) there will be no substantial increase in population density and this project will not produce an undue burden on available governmental facilities ; (c ) the circumstances of the property are unique ; (d ) the difficulty cannot be obviated by a method feasible for appellant to pursue other than a variance ; (e ) that .in consideration of the above factors , the interests . of justice will be served. Accordingly , on motion by Mr . Goehringer , seconded. by Mr . Sawicki , it was RESOLVED-, -to GRANT.- a Variance for the establishment of a single-family dwelling unit at the east end of the second floor of the existing.. horse stable structure applied under Appeal No . 3216 in the Application of EUGENE DAVI.SON , SUBJECT TO THE FOLLOWING CONDI.TIONS.: I . That this dwelling unit not exceed 1 ,000 sq . ft. in livable floor area; 2 . The grant of this variance is li.mit.ed to this single - family dwelling unit (apartment ) at the east end of the second floor of the existing horse stable structure as applied. The Chairman opened the hearing at 7 : 35 p .m. the read the notice of hearing _ and appeal application for the record . Present were : Gerard P. Goehringer , Chairman , Robert J . Douglass , Serge DoYen , and _J.oseph H . Sawicki , Members . Absent was MLmber _Gri goni s' (due_ to illness ) : -Also present were the applicant-and approximately. 25 persons in the audience . CHAIRMAN GOEHRINGER,: I have a copy of the subdivision map dated January .7, 1986:', prepared by Roderick_ VanTuyl , P. C. which shows this 9_. 8-ac.re parcel , which comprises of many paddocks , a training area and a lar.ge stable which has been mentioned in the application . And I have a copy of the Suffolk County Tax Map indicating this .and surrounding properties in the area. Mr . Davison , would you like to explain to the board why it has taken since 1984 to hear this case so that we don ' t confuse anybody . EUGENE DAVISON : Our farm is. 12- 1./3 acres and it has three dwellings from ma�ny' years , 50 .years ago some of them , on there , and _I asked for this.. variance ,__ on that date which seems like years ago , and I got tangled up with the Planning Board that I should get a subdivisio.n before this go _through . So this is what has happened . I got caught up in Planning Board and Suffolk County Board of Health and everything is resolved finally as far as the subdivision goes ,_ so I put this through again . This variance for the dwelling . CHAIRMAN : I just didn ' t. want the public to think we were holding it up, since 1984. ' MR. DAVISON : No , no . Page 2 - Eugene Davison Hearing Transcript-ZBA Regular Meeting 12/11 /86 CHAIRMAN : Can I just ask you while you ' re standing . What is the approximate square footage of the living quarters going to be? MR. DAVISON : It ' ll come out 1 ,020 feet , something like that . CHAIRMAN : And will the ingress and egress for those quarters be on the outside of the building or the interior of the building? Will the stairwell going to the quarters be inside-- MR. DAVISON : Inside the building. Actually the whole part will be inside the building. There are no additions or anything needed for it . CHAIRMAN : You have potable water in that building already. So it only ' requi.res a-- MR. DAVISON : Potable water; toilet and sanitary system and everything that we will connect to . CHAIRMAN : I see . Thank you very much . Let ' s see what develops in the hearing . Is there anybody else that would like to speak in favor of this application.? . Anyone against the application?.. (No o_ne ) . This_ will be on the east side of the building , is that correct? MR . DAVISON : Yes . CHAIRMAN : There was one other question . Are you going' to provide any type of parking for the use of this stable , or will it be just. th_e__ normal parking that you have up there_ now presently . MR. DAVISON : I think the parking there now is more than adequate . CHAIRMAN : Ok . I thank you again . The Appeal under #3216 rendered January 8 , 1987 is conditioned upon the single- family dwelling unit at the east end of .t-he second floo-r of -horse stable , as applied . This variance was necessary since the 9 . 8±-acre parcel was to be established as a. principal use for the keeping , breeding , raising and training of horses _(Article III , Section 100-30A(2 ) [b] requiring ten acres ; the minor subdivision involved a clustering from the area require- ments for Lots 1 , 2 , and 3 (which are less than the minimum 80 ,000 requirement). ; the apartment in the horse stable structure woul.d. have:.required an additional 80 ,000 sq . ft . without a variance . A's you know , the total acreage before the Minor Subdivision was 12 . 6± acres . The total acreage required under the zoning code for those uses established is 18 acres -- a variance was obtained . (Also see Appeal No . 3254 rendered 6/13/85 ) . 2 . Inasmuch as Mr . Davison is proposing an amendment to Appeal No . 3216 to relocate a dwelling unit from the stable into a newly proposed dwelling structure , formal action i.s required by this Board for modification . 3. In the interim , please advise Mr. Davison that he must request this modification in writing to the Board of Appeals , we must hold a public hearing , and then appropriate action may be taken . New owner now wishes to construct a new one family dwelling, using variance to justify stable apartment . , I have determined , as the Zoning Administrator , that the variance no longer pertains and instructed owner as to his alternatives . He may appeal my decision or apply for a new variance ; or convert the apartment back to a non- habitable accessory building and he could then construct a one family dwelling .
