Vari.ance from Condition No . 1 rendered July 8 , 1965 under Appeal No. 785 , and Article III , Section 100-32 for approval of the construction of accessory storage shed in frontyard area as shown on survey prepared by Roderick VanTuyl , P. WHEREAS , a public hearing was held and concluded on August 20 , 1987 in the Matter of the Application of ELLEN HOPE DeMARIA under Appeal No . 3655 ; and WHEREAS ,--at said hearing all those who desired to be heard were heard and their testimony recorded ; and WHEREAS , the Board has carefully considered all testimony and documentation submitted concerning this application ; and WHEREAS , the Board Members have personally viewed and are familiar with the premises in question , its p.r_esent zoning , -and the surrounding areas ; and WHEREAS , the Board made the following findings of fact : 1 . By this application , appellant requests a Variance from the Provisions of Article III , Sec.tion 100-32 , and Article XIV , Section 100-141 (C ) for approval of the construction of an accessory storage shed of a size 20 ' by 12 ' and as more parti - cularly shown on survey prepared by Roderick VanTuyl , P. C . dated April 9 , 1984 . 2 . The premises in question is a described parcel of land containing a total area of one acre with frontage of 155 . 52 feet along the west side of "Private Road" located off the.. westerly end of South View Drive', Orient. 3 . The subject premises is improved with one single-family dwelling house with a setback of 94± feet from the front property (CONTINUED ON PAGE TWO ) DATED: September 10 , 1987 . CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Form ZB4 (rev. 12/81) Page 2 - Appl . No . 3655 Matter of ELLEN HOPE DEMA.RIA D cision Rendered September 10 , 1. 987 line (along Private Road ) and the subject accessory storage shed , all as shown by the April 9, 1984 VanTuyl survey. 4. The subject premises is located in the "A-40 " Residential and Agricultural. Zoning District . 5 . For the record it is noted that under Appeal No . 785 rendered July '8 , 1965 , a conditional variance was rendered for the placement of the subject accessory building in the frontyard area as applied therein with a setback of 30 feet. from the front property line. 6 . Certificate of Occupancy #Z4778 was issued August 30 , 1972 for a "private one-family dwelling " without reference to the subject acces.sory building. 7 . By building-permit application of recent date , it was noted that the accessory building was located was a setback of less than that required by the 1965 variance , requiring this additional variance application . 8. The accessory building as exists is used and will continue to be used for residential storage purposes incidental to the existing residence and 'not to be operated for gain , and shall not exceed the present height of 11 feet (which exists , at the present time ) . 9. It is . the opinion of this Board that : (a ) appe-llant ' s request is not unreasonable and the - circumstances of the past history in this matter lends to the difficulties ; (b) -the variance will not in turn be adverse to the safety , health , welfare , comfort , convenience , or order of the town ; (c ) the relief requested is not substantial in relation to the requirements ; (d ) there is no other method feasible for appellant to pursue other than a variance ; (e ) there will be no detriment to adjoining properties ; . (f) in view of all the above factors , the interests of justice will be served by granting the variance as applied. Accordingly , on motion by Mr . Goehringer , seconded by Mr . Sawicki , it was RESOLVED , to GRANT the relief requested under Appeal No . 3655 in the Matter of the Application of ELLEN HOPE DeMARIA for - the placement of an accessory storage building with a setback, of 20± feet from the front property line , as exists and more particularly shown on survey prepared by Roderick VanTuyl , P . C . dated April 9, 1984 , and SUBJECT. TO' THE :FOLLOWING -. CONDITIONS: 1 . No expansion or increase in height without prior Z . B. A. approvals ; 2 . Accessory building shall be for storage use incidental to the existing dwelling only; 3. Accessory building shall contain no habitable facilities ; 4. Accessory building is approved with a setback as applied with limitations on the setbacks and size . Vote of the Board : Ayes : Messrs . Goehringer , Doyen , Douglass and Sawicki . PREVIOUS APPEAL A previous appeal (has) (has hot) been made with respect to this decision of the Building Inspector or with respect to this property. Such appeal was ( ) request for a special permit ( ) request for a variance and was made in Appeal No. ................................Dated ...................................................................... REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (X) A Variance to the Zoning Ordinance is requested for the reason that In 1965 when an application was filed for a.-variance_.for a.shed. (accessory: bldg) the estimated distance from the property line was incorrectly listed as 30feet instead of. 20feet because of the roughness of terrain and missing markers. After that variance request was approved in 1965, an official survey indicated the true figure to be 201 . The shed was never moved before or after this Form zsi (Continue on other side) request. REASON FOR APPEAL Continued 1.. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties,or.unneces-, . sary HARDSHIP because The shed has been in place for 22 years and is grown in with trees and gardens. It would be expensive to move. Denial of a C.O. will make it impossible to complete thesale of the-'-property. The right of way listed on the map .as 509 has ,;actually;_never been cleared wider than about 121 , and it has always been difficult to bring up heavy equipment. Over the years the brush and woods have grown thicker. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because The original variance was granted for front.. yard.. because .the uneven terrain made any other placement practically impossible. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE _THE "CHARACTER OF THE DISTRICT because the shed has been there for 22 years and is made- of traditional materials, and is practically invisible because of the brush and trees. In the original appeal all the neighbors and the Browns Hills Association had not objection to the structure or the placement., STATE OF NEW YORK ) P/I L, ) s5 L/Y........ .1/............................... The Chairman opened the hearing at 8 :22 o ' clock p .m . and read the notice of hearing and application for the record . CHAIRMAN GOEHRINGER: I have a copy of survey produced by Roderick VayTuyl., P.C. ;-"-the most recent date -is mentioned in the application as April 19, 1984, indicating the approximate placement of a storage shed at 20 feet from the private road as indicated in the application. And I have copy of the Suffolk County Tax Map indicating this and sur- rounding properties in the area. Is there somebody who would like to be heard? Mr. DeMaria, is there anything you'd like to say sir? MR. DEMARIA: No. I think you said it all. I think the original ap plication for a variance was in error as far as the measurement was. concerned because the shed -was already on the land. It came from Bob' s farm I think in 1965 and it was set down there and then we were. told we needed a variance. So we were only -asking for a variance. to approve it where it already was and we tried to measure the distance to the. . . . There was no marker. I used a telephone pole, ..a:s you can see right there, instead of that marker. I mis-measured. So. I, asked for 30 feet and I should have asked for 2.0. If I, had gotten VanTuyl up there in 165, instead, he came up and did another survey in 166' the following year. It turned out that there was a ten foot difference., CHAIRMAN GOEHRINGER: Mr. DeMaria, is this property used for anything other than a storage shed? MR. DEMARIA: No. CHAIRMAN GOEHRINGER: This building I . should say. And you have no ob, jection to the re-enhancement if the, Board so desires to grant this in the area of where it ' s granted or where it' s placed..ri.ght now? That the building not be used for anything but a storage. sh.ed.. You have no objection? MR. Zoning Map ( ) A 'VARIANCE due to lack of access (State of New York Town .Law Chap. ,62. Cons. Laws Art. 16 Sec. 280A Subsection 3 4. PREVIOUS APPEAL A previous appeal (has) (has not) been made with respect to this decision of the Building Inspector or with respect to this property. Such appeal 'was ( ) request for..o special permit ( ) request fora variance andwas made in Appeal No. ................................Dated ...................................................................... REASON FOR APPEAL ( ) A Variance..to Section'280A Subsection 3 (X) ` A Variance to .the Zoning Ordinance is requested for the reason that In 1965 When an application was filed for a variance for a shed (accessory bldg) the estimated distance from the property line was incorrectly listed as 30£eet instead of 20feet because of the roughness .of terrain and missing markerr Form zsi (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary-HARDSHIP because The shed has been in place for 22 years and is grown- in with trees and gardens. It would be expensive to .move. Denial of a C.O. will make it impossible to complete ,thesale of the property. The right, of way listed on the map as 509 has actually never been cleared wider than about 121 , and it has always been difficult to bring up heavy equipment., over' the years the brush and woods have grown thicker. 2. The hardship created is UNIQUE and is not shared by all properties alike .in the immediate vicinity of this property' and in this use district because The original variance was granted for front yard because the uneven terrain made any other placement practically impossible. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the shed has .been there for 22 years and is made of traditional materials, and is practically invisible because of the brush and trees. In the original appeal all the neighbors and the. Browns Hills Association had not objection to the structure or the placement. STATE OF NEW YORK 7) M.
