WHEREAS , a public - hearing was held and concluded on July 16 ,
1987 in the Matter_ of the Application o_f 'P.AUL AND 'CHARL.OTTE 'GALGAN
under Appeal., No . 36445; and _
WHEREAS; at said hearing a.11 those who desired to be heard
were heard and their testimony- recorded ; and
WHEREAS , the. Board has carefully .considered all testimony,
and documentation submitted concerning_ this application ; and
WHEREAS, the. Board Members have personally viewed and are

WHEREAS , the. Board made the fo.11owfng findings of ,fact:
1 . By this application , appellants request a Variance from
the Pro.vi s i ons of the Zo.n.i ng Code ,. Article XI , Section 10O-.11 9_..2 ( B)
for -permission to construct: (a) an 10 '. wide by 24' addition at
the westerly side of the existing single-family__.dwelling. leaving
a sideyard .at not less than .15 feet a-nd -a set_b_ack from the existing
bulkhead at not less than 56 feet at_ its. closest point ; (b). an
3 ' . wide by 8 '.7" addition at the easterly side of the dwelling
shown to- be set back more than 60 .fe.et from the..- existing ..bulkhead ;
and (c ) 6 ' by 8 ' addition with' 4' 6." 'by 8 ' landing , all as more
particularly shown by construction plan prepared and amended
May 26 , 1987 (No . 85.7F) and .sketched. surv'eys submitted with this
application .
2 . The premises in question Is located along the
south (southeast) side of .Stillwa.ter Avenue , Hamlet of .Cutchogue ,

Decision Rendered July _27 , 1987 _.
Town of Southold , containing a total lot area of 20 ,200± sq . ft.
and lot width of 75 feet , and is improved with a single-family
one-story frame dwelling structure set back 39± feet from the
existing bulkhead along Eugene ' s Creek , as shown on Young &
Young survey filed under this application . The subject
premises is also known as Lots 2 and one-half of 3 , "Map of
M . S . Hand Subdivision" filed in the Office of the Suffolk County
Clerk September 19 , 1930 , Map No . 730 ..
3. Article XI , Section 100,119 . 2 requires a.11 buildings
and structures to be set back not less than- seventy- five .feet
(75) feet from a ti dal. water. body ,... tidal. wetl and edge , or fresh-
water wetland.
4 . It is the position of .t.his Board that the circum-
stances of the property lend to-the granting of the relief
requested , particularly due to the existing bulkhead separating
the wetland areas from the upland and due to the fact that
the new construction is proposed landward of substantial
residential structures immediately upon the premises .
5 . It is the opinion of the Board that :
(a ) appellants request is not unreasonable and is
the minimal necessary ;
(b) the project as proposed is within the character
of the neighborhood since the construction proposed is iandward
of existing construction_ in the area; _-
(c) the circumstances of the property are unique ,
particularly due to the substandard size ;_..
(d) there is no other method feasible for appel -
lants to pursue other than a variance ;
(e ) . the variance will not in turn be adverse to
the safety ,. health.,. welfare, co_mfort , - co.nv.enience or order of
the town.;__ _
M. in view of .all the above factors , the relief
requested will be within -the. spirit of .the zoning ordinance
and will serve the interests of .justi_ce .

Dear Mr. Galgan:
Pursuant to your inquiry received yesterday, this will
confirm that the Board at our Regular Meeting held last evening
had no objection to the subject addition with a setback of 14 or
more feet at the northerly yard area,' as shown on the survey map
of September 29, 1987, prepared by Roderick VanTuyl, P.C. and
which we understand was constructed of the 10 ft. x 24.2 ft.
size (and in the same location and as applied under the above
appeal application. )
It is to be understood, as discussed with you by our
office, that a formal application may be necessary in the
future, particularly when you contemplate a sale of the
property.
A copy of this letter is simultaneously being transmitted
to the Building Inspector' s Office for their information and
record.

The following action was taken by the Board of Town Trustees during
their regular -meeting held_ on July 27, 1987 regarding the above matter.
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area, and
WHEREAS, the Board considered all the documentation submitted concerning
this request, and
WHEREAS, the Board made the following findings of fact:
1. By this request appellant requests permission to construct-- a 10' x 241,
36' x 8'7" and a 6' x 8' with a 416" x 8' additions to an existing residence.
2. The property is located at 4605 Stillwater Avenue, Cutchogue.
3. The project will not affect the health, safety or general welfare of the
people of the Town,
NOW, THEREFORE BE IT .
RESOLVED that Paul & Charlotte Galgan Be and -Hereby are Granted„a Waiver
of the Wetland Ordinance as aforementioned and all- in accordance with the 'Plan....
submitted: on June„26, 1987 along with the application for same.
Please be advised that there is a $25.00 fee for the Waiver due and payable

ered with,or which border on, tidal waters,or-lands
lying beneath tidal waters, which at mean low tide
are covered by tidal water4' to a maximum depth of
five (5) feet, including but -not limited to banks;
bogs, salt marsh, swamps, meadows, flats or other
low lying lands subject to tidal action;
(2) All. banks, bogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following: salt hay, black

defined in Subsection A(2) and lying within seven-
ty-five (75) feet landward of the most landward
edge of such a tidal wetland.
B. FRESHWATER WETLANDS:
(1) "Freshwater wetlands" ;is defined in Article 24, Ti-
tle 1, § 24-0107, Subdivisions 1(a) to 1(d) inclusive,
( of the Environmental Conservation Law of the State
_ of New York;and
(2) All land immediately adjacent to a"freshwater wet-
land,"as defined in Subsection I3(1)and lying with-
in seventy-five (75) feet landward of the most land-
ward edge of a"freshwater wetland."
