WHEREAS , a public hearing was held and concluded on April 23 , 1987 in the Matter of the Application of MICHAEL S. GILLILAND under Appeal No . 3621 ; and WHEREAS., at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS , the board has carefully considered all testimony and documentation submitted concerning this application ; and WHEREAS , the board members have personally viewed and are familiar with the premises in question , its present zoning , and .the surrounding areas ; and WHEREAS , the board made the following findings of fact : 1 . The premises in question is located along the north .side of Sound Drive , Greenport , is identified on the Suffolk County Tax Maps as District.100Q_., Section 33 , Block 1 , Lot 8 , and is known and referred to as Lot #109 , Map of Eastern Shores , Section Four , filed March 7 , 1966 . 2 . The subject premises consists of a total area of 30 ,984 sq . ft. with frontage along Sound Drive of 100 feet , and average lot_ depth . of 328± feet . The premises is presently vacant and is located in the "A" Residential and Agricultural Zoning Dis- trict . (CONTI.NUED ON PAGE TWO ) DATED: May 18 , 1987 . The relief requested by this application is a setback of not less than 55 feet from the 45-foot contour line along the Long Island Sound Bluff as more particularly shown by sketched survey (amended October 7 , 1986 ) prepared by Roderick VanTuyl , P . C . The distance below the 45 ' contour to the ordinary high- water mark at its closest point is 57± feet . The proposed house location is 125± feet to the ordinary highwater mark at its closest point and is fairly level , as compared to the remainder of the property . The bluff face and toe appear fairly stable. There is some vegetation on the bluff face . At the toe of the bluff and on the beach (north of the 45 ' contour ) , there are numerous large -boulders aiding in stabilizing the bluff. The lot does contain depressions along .the southerly areas . 4. Article XI , Section 100-119. 2 , subparagraph A[l ] requires all buildings proposed on lots adjacent to the Long Island Sound to be set back not less than one-hundred (100 ) feet from the top of the bluff , or bank . The Board finds that although it may be possible to construct the dwelling with a minimum setback of 100 fe-et from the top of bluff (without a variance ) , the proposed location is more feasible in light of the above factors . 5 . For the record , it is noted that the dwelling on the easterly parcel (presently of Ehrenreic ) is setback 45± feet at its cloest point to the top of bluff/bank-as shown by survey dated January 24 , 1975 . The premises to the west (Lot 108 ) is vacant . In considering this appeal , the Board also finds and determines : (a ) the relief requested is substantial in relation to the requirements , being a variance of 45% , or 45 feet ; (b) the placement of the new dwelling at a point not closer than 55 feet from the top of bluff is not unreasonable and will not be detrimental to adjoining properties or change the character of the districts ; (c ) the circumstances of the property are unique ; (d ) the `practical difficulties are sufficient to warrant a conditional granting of the variance , as noted bel-ow ; (e ) the difficulty cannot be obviated by some method feasible for appellant to pursue other than a variance ; (f) the granting of the relief requested is within the spirit and intent of the zoning .ordinance and maps ; (g ) in view of the manner in which the difficulties arose and in view of the above factors , the interests of justice would be served by granting the relief, as indicated below. Accordingly , on motion by Mr . Grigonis , seco.nded by Mr. Goehringer , it was RESOLVED , to GRANT a Variance under the Provisions of Article XI , Section 100-119. 2 (A) for permission to locate new dwelling (with all structural attachments ) , in the Matter of the Application of MICHAEL S . GILLILAND under Appeal No . 3621 , SUBJECT TO THE FOLLOWING CONDITIONS : 1 . Goehringer, Chairman Southold Town Board of Appeals *'lain Road Southold, New York 11971 Dear Mr. Goehringer: Regarding your request for our assessment of Appeal Yo. 3621 - P-Zichael Gilliland (Variances), please be advised that' a site inspection was conducted an April 1, 1987. During the inspection it was noted that the lot contains a depression along the south end, is fairly level at the proposed house location, and along the north end there is a bluff. Construction of the proposed garage will require some filling and land grading. A plan should be developed to specify fill or cut changes in grade, finished grade slopes, and type of vegetation to stabilize slopes. This office could review and comment on such a plan upon request. Since the proposed house location is fairly level, there should be few problems regard- ing soil erosion and slopes. The yard area north of the house should be graded away from the top of the bluff to prevent runoff water from flowing down the bluff face. The septic system for the house should be located south of the house to prevent adding excess weight (seepage) on the upper portion of the bluff. The bluff face and toe appear fairly stable. There is some vegetation on the bluff face. At the toe of the bluff and on the beach, there are numerous large boulders which are aiding in stabilizing the bluff. However, along the top of the bluff there is an overhanging lip approximately 3 -. 4 feet higli. 71iis lip should be removed or we allod to fall off to form a continious slope with the bluff face. A continious bluff face slope would result in the top edge of the bluff being S - 6 feet south of where.it is presently. Vegetating the remaining bare areas of the bluff face will reduce soil erosion on the bluff. : Reclnmoendations are available through this office upon request. Board of Appeals Main Road Southold, New York 11971 Dear Mr. Goehringer: Regarding your request for our assessment of Appeal No. 3621 - Michael Gilliland (Variances) , please be advised that a site inspection was conducted on April 1, 1987. During the inspection it was noted that the lot contains a depression along the south end, is fairly level at the proposed house location, and Along the north end there is a bluff. Construction of the proposed garage will require some filling and land grading. A plan should be developed to specify fill or cut changes in grade, finished grade slopes, and type of vegetation to stabilize slopes. This office could review and coment on such a plan upon request. Since the proposed house location is fairly level, there should be few problems regard- ing soil erosion and slopes. The yard area north of the house should be graded away from the top of the bluff to prevent runoff water from flowing down the bluff face. The septic system for the house should be located south of the house to prevent adding excess weight (seepage) on the upper portion of the bluff. The bluff face and toe appear fairly stable. There is some vegetation on the bluff face. At the toe of the bluff and on the beach, there are numerous large boulders which are aiding in stabilizing the bluff. However, along the top of the bluff there is an overhanging lip approximately 3 - 4 feet high. This lip should be removed or allowed to fall off to form a continious slope with the bluff face. A continious bluff face slope would result in the top edge of the bluff being 5 - 6 feet south of where it is presently. Vegetating the remaining bare areas of the bluff face will reduce soil erosion on the bluff. Recommendations are available through this office upon request. The location of the house; 55 feet at its closest point and a garage approximately 25 feet from Sound Drive. The side of the garage is approximately 13 by 24 it appears to be. And I have a copy df the Suffolk County Tax Map indicating this and surrounding properties in the area. Is there somebody who would like to be heard on behalf of this application? Anybody f6r this? Good. Would you kindly state your name. MR. GILLILAND: I ' m the owner, Michael Gilliland. CHAIRMAN GOEHRINGER: How are you? MR. GILLILAND: Fine thanks. CHAIRMAN GOEHRINGER: Now, what can you tell us about your property that ' s unique? MR. GILLILAND: Well , I guess I said a lot of it in the application. But I have since, received from the County of Suffolk, an analysis of the bluff and they state it ' s very stable from the bottom to the top and there are bolders in front of it. There presently has not been,. in recent history, any kind of erosion. I have the same problem as another lot that we discussed earlier this evening which had to be graded down 9 feet . Because if you built back behind the swell , you ' d have no choice. So what I ' ve done there to conform the house with the house next door and to avoid having to build behind that, is to apply for a variance that would allow me more than 55 feet , as close to 55 feet from the water. CHAIRMAN GOEHRINGER: That would not require any regrading of that area then? MR. GILLILAND: Not only. would it not require`; I 'm going to try to avoid it. My intention is not to change any of the vegetation on the bluff at all if possible. I -don ' t want to change any of the trees or any of the bushes.. According to the DEC, they recom- mended that you can hand put ' them back so that -you are pruning your own hedge so you might see- the water. A great concern 'to us ,,is that we do not disturb the bluff or..any of the surrounding Vegetation at all . Page 2 - April 23 , 1987 Public Hearing lichael S. Or are you still going with that idea of placing the garage in the front yard area? MR. GILLILAND: Marty and Agnes _ Ehrenbach are here. They are the neighbors to the east and they made a very good suggestion which was that garage should not probably be built on that side- It might be moved over to another side because there is ( they observed for my benefit) a curb there and .so it might be a better idea rather than having the exit for the garage right near a curb out where the road is straighter and that ' s fine. CHAIRMAN GOEHRINGER: So you' re going to come back with another application some time in the future for the garage? MR. GILLILAND: I would prefer not to. I don ' t think, unless it matters for the purpose of the town trustees , I would rather you give us a blanket approval for the garage in the backyard. CHAIRMAN GOEHRINGER: You can ' t do it. You have to tell us where you want to put it. MR. GILLILAND: What I ' ll do is just withdraw the application for the garage. And then in a separate application, perhaps, at a later time, make an application for the garage because it ' s not essential to the house. I ' d like to get going with the plans. I 'd also like to point out to the Board that; although it ' s 55 feet at it ' s closest point, the bluff steeply angles off. So that if I were to build my house (roughly) on a parallel with the house next door, luckily that would be to a much greater distance at most points from the house. Although I don ' t know what that would presently be, it would bet.o a greater distance. CHAIRMAN GOEHRINGER: You are aware that you must maintain the side- yards if the Board so grants this house in its present location or its proposed location. And you can not encroach on either one of those sideyards because you have -to be able to gain access to the bluff area if `you have to do any work up there. In other words, you have 15 feet on both sides at their closest points and you would have to maintain that 15 feet. MR. GILLILAND: Fine. CHAIRMAN GOEHRINGER: Thank you. I have not yet received a copy of the building plans for the garage and, as I advised you, submit the plans for the house subject to future changes after consultation with my architect. (f) I have visited the site and flagged the corners of the house nearest the bluff. The undergrowth and vegetation of the site makes it virtually impossible to flag precisely where the house will be located without actually clearing the site. The white stakes that I have used to mark those portions of the house closest to the bluff could not be seen if placed where the house will be. Thus, those white stakes are located 55 feet southward of the bluff. One stake is located 55 feet south of the bluff at the eastern property line and the other stake is j/ located 52 feet westward of that stake. Both stakes are located in areas where brush has been cleared. If this is not adequate please advise me immediately so I can make arrangements to restake the area (if possible) . As indicated by the enclosed Notice of Disapproval, I had applied to build the residence closer than 100 feet to the edge of the bluff and had applied to place the garage in the front yard rather than the back yard. As you can see by the enclosed survey, my lot ( indi- cated Lot 109, Eastern Shores Subdivision) abuts Long Island Sound on 45 foot cliffs rising above the water line. Eastern Shores, which is a relatively old subdivision, is entirely built out except for two lots: my lot 109, and lot 108, immediately to the west. All other lots are either built or currently being built upon. The lot immediately to my right, occupied by Mr. and Mrs. Martin Ehrenreich, was built prior to the recent restriction requiring that residences be built 100 feet or more from the top of the bluff. If I were to construct my house more than 100 feet back of the bluff, my view of the sound would be substantially obscured by the Ehrenreich' s residence. { Zoning Board of Appeals 2 March 10, 1987 Moreover, because of the topography of my lot (as shown in the enclosed topographical survey) , the lot drops off into a deep hole, so that complying with the 100 foot requirement would force me to construct the house in a deep depression. The Ehrenreich's house is built in some places approxi- mately 35 feet from the bluff and, where it abuts my lot, approximately 50 feet from the bluff. I am proposing in my application that I be permitted to build 55 feet from the top of the bluff, even with that residence. I am also requesting that the garage be placed in the "front" yard, as all garages are placed on waterfront lots. My building plan in general is to leave the lot as undisturbed as possible. I will not grade the top of the bluff, other than to place the foundation and basement, and will disturb little of the natural vegetation. As you can see by the enclosed topographical survey, I have also, at the request of my architect, Mr. Norman Jaffe, required a site location of all trees having a diameter greater than eight inches. I plan to locate the house in a manner to avoid these trees . If I were compelled to fill in the ravine to build the house, numerous large trees would have to be destroyed. In particular, those trees that block the house from the road would have to be torn down, thus marring, in . my opinion, much of the beauty of the neighborhood. I enclose in connection with my application the fol- lowing: 1.
