WHEREAS , at said hearing no': one appeared either in behalf of
or against the ap.plication; _and
WHEREAS , the board has carefully considered all testimony and
documentation submitted conce.rning . this application.; and
WHEREAS , the 'board members have personally viewed and are
familiar with th& premises in question , its present zoning , Iand
.the surrounding areas ; and
WHEREAS , the board made the following findings of fact:
1 . By this application , appellants request a Variance from
the Provisions ofIArticle VI , Sect.ion 100-60C (2 ) [a] , to replace
an existing ground sign , the lower edge of which.- would be not less
than twelve inches (12" ) above the ground and the upper edge of
which will extend not more than five feet above the _ground .
2 . The premises in question is located along the north
side of the Main Road in th.e Hamlet of Southold , Town of Southold ,
containing an area of 7500± sq . ft. ,. 50 ft . lot width (_frontage_.)
and. lot depth of 150± feet , and i..s more particularly shown on the
Suffolk County. _Tax Maps as District 1000 , Section 52 , Block 1 , Lot 5 .
3. The subject premises is improved with a 25-ft . wide by
65 ft . deep one-story frame building set back 35 feet from the
front property line along the Main (State ) Road.

Decision Rendered June 10 , 1987
4. The on-premises business advertising sign proposed by
this application will have an advertising area of 36" high by
96" wide , together with a 3" high skirt and 12" high base .
The 12" high base will not exceed 1.2 feet in width , and the
total solid construction area (top and bottom) shall not
exceed a total area of 81 . 25 sq . ft.
5. The setback of the existing sign and proposed sign
replacing same is shown to be not less than eight feet from
the front property line along the Main Road a.nd the sidewalk
and a greater distance from the easterly side property line .
6 . In considering this application, the Board finds
that the proposed sign is better aesthetically and the
adverti sing .-area is _Less than that normal ly_ permitted by
the Zoning- Code .
7 . In considering this appeal , the Board also finds and
determines :
(a) the relief requested is not substantial in relation
to the requirements_;
(b) the relief .requested is minimal ;
(c ) the circumstances of .the . property are unique ;
(d ) the variance if allowed will not have an affect- of
- increasedpopulation density thus produced on availa..ble govern-
mental facilities ;
(e ) there will be no change in the character of the
neighborhood or substantial detriment to adjoining p.roperties
(f) the interests of justice will be served .

REASON FOR APPEAL
( ) A Variance to Section 280A Subsection 3
( X1 A Variance to the Zoning Ordinance
is requested for .the reason that The sign height permitted by the zoning code
is less attractive than what we propose. Our property is small, our
building is low, what we propose is much more pleasing to the eye,
more in keeping with the professional image we wish to project, and more
in keeping with the aesthetic nature of the landscape.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSH I P because
The sign raised 4 ' off the ground (as it is now) looks too commercial
creates a bill board competition on main street that is similar to
Jericho Turnpike: We have a sign in compliance with the code now,
we seek to do something that will look prettier, and make the village
look nicer too.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
Not all property owners care about t1�e' overall aesthetic impression
created by their sign when it is viewed in the context of all
Main Street signs, such as a visitor passing through the village would.
We are upgrading our sign and have the opportunity to do something
more tasteful than what the code allows .
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
There is no reason for us to have a sign 4 ' off the ground as long
as. .a car. leaving our parking lot can see over it and it is far enough
away from the sidewalk to allow clear visability in all directions. It
does.

THURSDAY, MAY 21 , 1987, PUBLIC HEARING
8 :15 p.m. Appeal No. 3630 - Public Hearing commenced in the
Matter of JOHN KRAMER AND WAYNE DEPETRIS. Variance to replace
existing ground sign, the lower edge at less than 4 feet above
ground. Main Road, Southold.
The Chairman read the legal notice and application for the record.
CHAIRMAN GOEHRINGER:. . I have a copy of the Suffolk County Tax Map
indicating this and surrounding properties in the area and I have
a copy of the original survey done on this property which ;.a;s:,4pprct
mately 50 by 150 and a sketch of the sign which appears to be 9 feet
6 inches by 36 inches and approximately 12 inches off the ground.
The location of the sign is approximately 8 feet from the inside of
the sidewalk and the present building sits approximately 36 feet 5
inches from the existing property line. Is there somebody here who
would like to be heard on behalf of this application? Either Mr.
Kramer or Mr. DePetris? Is there anybody who would like to speak
against the application? The only information. I 'd like to have for
the record is that I'd ask you to send a letter to Mr. DePetris and
Mr. Kramer asking them to contact,the Chief of the Southold Fire De-
partment asking him if he has any objection to the lowering of the
sign and asking them if they have any objection to the sign being
lower based upon the visibility, fire trucks !entering and exiting
from the fire house. Hearing no further questions, I' ll make a
motion closing the hearing reserving decision until later.

TRUSTEES — The Board of Trustees of the Town of

85 by L.L.No.6-1985]:
-A. TIDAL WETLANDS:
(1) All lands generally covered or intermittently cov-
ered with,or which border on, tidal waters,or-lands
lying beneath tidal waters, which at mean low tide
are covered by tidal water4' to a maximum depth of
five (5) feet, including but not limited to banks, .
,bogs, salt marsh, swamps, meadows, flats or other
low lying lands subject to tidal action;
(2) All banks, bogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following: salt hay, black
( grass, saltworts, sea lavender, tall cordgrass, high
bush, cattails, groundsel, marshmallow and low
march cordgrass; and/or
(3) All land immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-
ty-five (75) feet landward of the most landw:u•d
edge of such a tidal wetland.
B. FRESHWATER WETLANDS:
(1) "Freshwater wetlands" as defined in Article 2.1, Ti-
tle 1, §'24-0107, Subdivisions 1(a) to 1(d) inclusive,
of the Environmental Conservation Law of the State
of New York;and
(2) All land immediately adjacent to a"freshwater wet-
land,"as defined in Subsection I3(1) and lying with-
in seventy-five(75) feet landward of the most land-
ward edge of a"freshwater wetland."
