Variance to the Zoning Ordinance, Article III, Section 100-30 for permission to replace nonconforming trailer with new single-family dwelling, in addition to the established structures and uses. . Location of Property: - 66075 C.R. 48, Greenport, NY; County Tax Map District 1000, Section 40, Block 2, Lot 7. WHEREAS, a public hearing was held on October 26, 1988 in the Matter of the Application of MARION SACCONE under Appeal No. 3786; and WHEREAS, at said hearing all those who desired to be heard were heard and -their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question contains a total area of 19,940 sq. ft. with 143 .09 ft. frontage along the north side of County Road 48 (Middle Road) in the Hamlet of Greenport, Town of Southold. 2. The subject premises is located in the "A" Residential and Agricultural Zoning District and is -improved with the following structures as shown on the August 19, 1988 Survey Map prepared by Roderick VanTuyl, P.C: (a) single-family, two-story frame house situate 25 feet+- from the north side .of the front {southerly} property line; (b) seasonal 1-1/2-story frame structure (c) one single trailer; (d) one accessory storage shed. • 'Page 2 - Appl. By this application, the appellant requests a Variance for permission to replace existing single-trailer structure with a new single-family dwelling; and its proposed relocation as shown on the above-mentioned August 19, 1988 Survey Map. 4. For the record, it is noted the existing trailer was granted by the Town Board by Trailer Permit No. 8, on September 4, 1958. 5. Chapter 100 of the Town Code defines the term "trailer" as follows: " . . .Any vehicle mounted on wheels, movable either by its own power or by being drawn by another vehicle, and equipped to be used for living or sleeping quarters or so as to permit cooking. The term 'trailer' shall include such vehicles if mounted on temporary or permanent foundations with the wheels removed. . . . " 6. Chapter 100 of the Town Code defines a single or one-family dwelling as a detached building containing one dwelling unit only and specifically excludes a house trailer. 7 . It is the position of the Board Members that the grant of the subject variance under the present terminology and definitions of the current zoning code is not appropriate. 8. In considering this application, the Board also finds and determines: (a) the sufficient proof has not been demonstrated as required by the statutes; (b) the trailer permit does not fall within the definition of "dwelling unit" as stipulated in the current zoning ordinance; (c) the use of the trailer was permitted only by Trailer Permit by the Southold Town Board; (d) the current uses of the property are not so restricted that it cannot be used for reasonable purposes; (e) the circumstances and nature of the uses of the property are unique; Page 3 - Appeal No. 3786 Matter of MARION SACCONE Decision Rendered December 16, 1988 (f) the property is located in an area consisting of lots containing single-family dwelling uses or vacant lots located in the "A" Residential and Agricultural Zoning District, which district permits one dwelling on each lot {Article III, Section 100-30A) ; (g) this Board cannot under the semblance of a variance exercise legislative powers. . Accordingly, on motion by Mr. Grigonis, seconded by Mr. Dinizio, it was RESOLVED, that the relief requested under Appl. No. 3786 in the Matter of MARION SACCONE to replace existing trailer with a new single-family dwelling, be and hereby is DENIED WITHOUT PREJUDICE. Vote of the Board: Ayes: Messrs. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the subject parcel is already improved by three dwelling units, including.a non-conforming trailer. Without this variance the applicant would not be able to remove the trailer and replace it with a dwelling unit in better con- formity with the neighborhood. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the property is presently improved by three dwellings, including a prior non-conforming trailer. Applicant is unaware of any other lots in the immediate vicinity similarly improved. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the property .is presently improved by three dwellings, including a trailer. Variance to the Zoning Ordinance, Article III, Section 100-30 for permission to replace nonconforming trailer with new single-family dwelling, in addition to the established dwelling structures and uses. Location of Property: 66075 C.R. 48, Greenport, NY; County Tax Map District 1000, Section 40, Block 2, Lot 7. Present were: Chairman Gerard P. Goehringer; Charles. Grigonis, Jr. ; and James Dinizio, Jr. , constituting a quorum of the five-member Board. (Absent were: Serge Doyen due to serious family illness, and Joseph H. Sawicki. ) Also present were: Linda Kowalski, Board Secretary, and approximately 40 persons in the audience at the beginning of the meeting. The Hearing commenced at 8:24 p.m. and the Chairman read the Legal Notice of Hearing for the record. CHAIRMAN GOEHRINGER: I have a copy of a survey produced by Roderick VanTuyl, P.C. dated August 19, 1988 indicating the normal structures and dwellings on this particular parcel of property, and I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Is there somebody that would like to be heard? Mr. McLaughlin. J. KEVIN McLAUGHLIN, ESQ. : Thank you, Mr. Chairman, Members of the Board. I am here representing the applicant, Marion Saccone, the owner of the subject premises. The property is currently improved by two one-family residences and one permanent trailer for a total of three dwelling units on the property. There's a .C.O. that I believe you have in your possession to cover all of these structures. The application before the Board this evening is for an approval to replace the existing nonconforming trailer, with a small house, which Ms. Saccone intends to occupy as her own residence. It would not be any increase in the density of the use on the property since there are already three existing dwelling units thereon. We're simply going to be replacing one with another. I think understandably this is a fairly unique situation. Unique in the number of units that are there now on the property. Then I think it requires a unique approach to it. I think it' s also important to notice that the property is serviced by Greenport Water, and the existing trailer, I believe, is still using a well, but it would be our intention to hook up the house if we got approval to put it up with the Greenport Water System. That' s basically what we're here for, asking for your approval to do this, both myself and Marion Saccone are here to answer any questions you might have about this application. CHAIRMAN: I have stopped walking up to people's houses in early morning and late in the afternoon and measuring them. I would like a measurement of the trailer if you could give it to me. You don't have to give it right now, but if you would call the office if you wouldn' t mind. We still measure setbacks and so forth, but in this particular case-, because of the fact that the trailer is in the rear of the property, both myself and Mr. Dinizio did not go into the rear of the property and measure it. MR. McLAUGHLIN: Did you want to measurements for the existing trailer and the current setbacks from the property lines? CHAIRMAN: Yes. That would be helpful. This is a unique situation in the respect that the proposed dwelling, which is a third dwelling on the premises, appears to be quite a bit larger than the existing trailer--so that's something we're going to have to rationalize ourselves in dealing with this particular application. And I'm living right now in a summer place, but I do need a permanent residence, and from the moment I bought it in 1979,. it was my plan to retire here. I have the tenant in the front house. (e) Board of Department of Public Health shall mean any such Board or Department established pursuant to the laws of the State of New York and entrusted with the regulation, control and supervision of matters pertaining to and affecting the public health in the Town of Southold. Section 2. It shall be unlawful for any person, persons , firm, assoc- iation, corporation or co-partnership to establish , main- tain, or oiler-.te within the limits of the Town of Southold any tourist camp on any location or plot • of ground for use of transients by the day, week, month, or season, whether a charge is or is not made, who does not possess a permit From the Depa.rtmuent of Health and Town Board of the Town of South- old. The permit of the Town Board of the Town of Oouthold shall expire on December 31st following the date of issuance. Such permit shall not be transferable or assignable. All Tom Board permits may be revoked for cause by such Board after a hearing. Section 3. Any person or persons , firm, association, corporation or co-partnership hereafter applying for a permit and/or a license to establish and operate a tourist camp must first file with the Board of Health and the Town Clerk a complete copy of the plan of the proposed camp. All land used as a tourist camp shall be located on well drained sites of ample size, free from heavy or dense growth -..of brush or weeds. The land shall be free from marsh and shall be graded to insure rapid drainage during and following rain. .' Section 5. Each site used as a tourist camp shall be provided with an ample and adequate supply of eater of safe sanitary quality, approved by the Board of Health. Where water from other sources than that of the municipal supply is proposed to be used, the sources of supply shall first be approved by the Board of Health. - ` Section 6 . Each tourist camp shall be provided with safe and adequate - provision for the collection and removal of garbage and shall provide a proper' and acceptable sewer system either by corn ection to a municipal sewer system' where such is available, or to septic tanks; all of which shall comply fully with all laws , ordinances and/or requirements prescribed by the Board of Health. Section 7. :;Each unit in any tourist camp upon which a tent, tent house, camp cottage, trailer or house car is erected or placed shall :not be less than 40x 50 feet in area clearly defined by markers in each cormer and no single family cottage used for living or sleeping quartBrs shall be less than 2k square feet or less than 14 feet wide at its narrowest point or less than `7 feet high from floor to plate or shall have less than 2-7 "square feet of ventilating opening or windows properly and fully screened. J'Section 8. - -- ''Each cottage site or location shall be well drained and the floor of each cottage shall be raised not less than four inches above the ground level to' permit free and uninterrupted vent- ilation. If floor be of wood it shall be raised not less than 12 inches above the ground level. Section 9. The roof cover of each cottage shall extend sufficiently beyond the exterior wall line so that all roof water shall fall free of walls. Section 10. No cottage shall be erected or placed upon any site at less . distance than 15 feet from any other building or cottage. Section 11. No trailer or camp car shall be located on any site where there is less than 15 feet between the trailer or camp car and other buildings , trailers ,, or camp cars included in the camp area and no cottage .site or location of trailer or camp car site shall be placed or erected within less than q0 feet from the property line separating the camp from adjoining Property, measuring from the nearest point of the cottage site or location, t_�-3iler of camp car site. Section 12. Roadways or driveways shall be provided not less than 25 feet in width, well marked in the day time and lighted at night. Said roadways , or driveways to be so located that each unit of the camp is easily accessible. Said roadways or driveways shall be so constructed that a dust nuisance will not be created. Each camp upon which two or more tents , tent houses , camp cottages , trailers or camp cars are erected or placed and where private conveniences for each site or cottage are not provided shall provide at locations hereinafter defined, toilets , urinals , wash basins , slop basins , showers , or baths , water faucets or spigots in accordance with the following: (a) One toilet or stool for each unit. (b) Each toilet room provided for men shall: have in addition urinal stalls. (c) Each toilet room shall be provided with one lavatory or wash basin for every five toilets or fraction thereof. . (d) One shower or bathtub shall be provided for each sex for each 10 units or fraction thereof. (e) All Toilets , basins and showers , shall be placed in properly constructed buildings conveniently located as to .each cottage or unit. (f) Buildings shall be well lighted at all times , day or might, well ventilated with screened open- ings , and constructed of such moisture-proof material as shall permit rapid and satisfactory cleaning , scouring and washing. Section 14. Each tourist camp shall be under the direct management of the owner or licenses or his agent or representative for whose acts he or they shall be fully responsible. The names of the person entrusted with the direct management of the camp shall be filed for reference with the Board of Health and with the Police Department of the Town of Southold. Such person or persons must be of good reputation and character and shall satisfy the public authority of their' experience and capacity to supervise, manage, regulate, control and maintain good order in the camp. Section 15. Each tourist camp shall be provided with a building to be known as the office in which shall be kept copies of all records pertaining to the management or supervisor of the camp , such records to be available for inspection by the Board of Health or by the Police Department, Section 16. It shall be the duty of the owner , his ageht or manager, to keep a register of all persons accommodated in the camp, said register to include the names of all persons , their home addresses , the registration numbers and description of their automobiles or other vehicles ; to prescribe rules and regulations for the management of the camp; to make adequate provision for the enforcementdfsuch rules; to subscribe to and adopt such general rules and regulations which may be hereafter adopted for the management of such camps . Further , it shall be the duly of the owner , his agent or ) manager to: �a) Provide for regular inspection of the water and . the sanitary conveniences . (b) Provide for the collection and removal of garbage or other waste material. (c) Prohibit the placing or storage of unsightly material or tehicles of any kind. (d) Provide for the regular cleaning, Painting , repairing disinfecting of all buildings , and �e) Provide at least one 2-�'- gallon soda and acid fire extinguisher , or its equivalent , for each 5 units , so located that all units shall be within 200 feet of an extinguis4g7. 67 TOWN BOARD MEET OF JUNE 30, 1953 (f) Take such other measures as may be deemed to be necessary by the Board of Health to preserve the health, comfort , and safety of all persons residing in the camp and the genera.l. public. (g) Cause each dog, cat , or other pet animal to be kept under control at all times , either by being tied up or confined in proper enclosure. (h) Repo}t to the Board of Health all cases, of communicable disease or suspected cases of communicable disease affecting any occupant of the camp. (i) Report immediately to the public authority all acts of disorderly character committed by any person or persons inside the camp; and (j ) See that copies of Standard Rules and Regulations shall be prepared and posted in conspicuous locations throughout the camp. Section 17. .Each tourist camp shall clearly indicate one or more .en- trances and exits the use -of which shall be enforced. Where it is established by complaint of adjoining property owners that their property is being trespassed upon by inmates of any tourist camp: it shall be the duty of the owners , manager or other person responsible to provide - fence or other effective barrier to insure such owners of adjoining property protection against trespassing. Section 18. The provisions of this ordinance shall be in addition to and supplementary to the provisions of all other ordinances of the Town of Southold and where there is any conflict be- tween the provisions of this ordinance and any other ordin- ance then the ordinance providing the stricter regulation shall prevail. Section 19. On every Trailer Camp a suitable planting not less than five ( 5) feet high, sufficient to screen the Trailer Camp . from view shall be erected along all lines of public lands and public highways and such fence shall be not less than 'ten (10) feet from such public lands or highway lines . Section 20. On receipt of any application for a permit, other than a renewal under this article the Town Clerk shall cause a notice of public hearing thereon specifying the time and place thereof tQ be published once in the newspaper pub- lished in the Town at least 10 days before the day of the hearing. Section 21. This ordinance shall not apply to any territory included within the limits of the incorporated village of Greenport. This ordinance shall not apply to any tourist camp, unit, camp cottage, or house trailer camp in operation on or be- fore July 1, 1953. Spicer Your Appeal No. 3786 Marion Saccone You have inquired whether or not the trailer permit should be treated as an additional single family dwelling use for the purposes of the zoning code, and in consideration of replacing said trailer with a new house. Under. chapter 100 of the Town Code, the term "trailer" is defined as follows: "Any vehicle mounted on wheels, movable either by its own power or by being drawn by another vehicle, and equipped to be used for living or sleeping quarters or so as to permit cooking. The term "trailer'." shall include such vehicles if mounted on temporary or permanent foundations with the wheels removed." You inquire whether this trailer may be considered a single family dwelling. A single or one-family dwelling is defined as a detached building .containing one dwelling unit only. The definition of,"dwelling unit" specifically excludes a house trailer. In light of the above, a house trailer can not be considered the equivalent of a single family dwelling.
