SAWICKI Appeal No.. 3735: At a Meeting of the Zoning Board ,of Appeals held on July 14, 1988, the above appeal was considered, and the Action indicated below was taken on your Request for a Variance to the Zoning Ordinance, Article XI, Section 100-119. 2A: Upon application of DINO AND LYNN ROSSINI for a Variance to the Zoning Ordinance, Article XI, Section 100-119.2 for permission to construct deck addition, landing and stairs near and along bluff of the L.I. Sound, at premises known as 755 Soundview Avenue, Mattituck, NY; County Tax Map Parcel No. 1000-94-1-6. WHEREAS, a public hearing was held and concluded on July 14, 1988 in the Matter of the Application of DINO AND LYNN ROSSINI under Appeal No. 3735; and WHEREAS, at �said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are • familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The property in question is identified on the Suffolk County Tax Maps as District 1000, Section -94, Block 1, Lot 6, and is a described parcel of land containing a total area of approximately 40,000 sq. ft. with frontage of 100.56 feet along the north side of Sound View Avenue, depth of 364.0 feet, and frontage along the Long Island Sound mean highwater mark of 99. 13 feet. 2. The subject premises is improved with a single-family, one-story framed house as more particularly shown on the copy of a 1981 survey prepared by Robert A. Kart, Land Surveyor. page 2 - Appl., No. ' 5 Matter of DINO AND N ROSSINI Decision Rendered August 18, 1988 3 . By this application, appellants propose to construct accessory stairs and platform structures as shown by the sketch submitted, extending from the area of the existing deck at the rear of the dwelling, along the bluff toward the bulkhead at the bottom of the bluff. 4: Article XI, Section 100-119:2, subparagraph A(1) .requires- all buildings and structures proposed on lots adjacent to the Long Island Sound to be set back not less than one-hundred (100) feet from the top of the bluff, or bank. No other sections of the Zoning Code appears to provide for the type of construction proposed herein, with the exception of 100-119.2A. 5. In considering this appeal, the Board finds and determines: (a) the activities required for the placement of this structure will be constructed on piers without disturbance to the vegetation of the bluff or be adverse to the character of the immediate area; (b) the percentage of relief in relation to the requirement is substantial; however, there is no other alternative for appellants to pursue other than a variance; (c) the practical difficulties are related to the land and are not personal in nature; .(d) the grant of this variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order° of the town; (e) in considering all the above factors, the interests of justice will be served by granting the application, as conditionally noted below. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was RESOLVED, to GRANT a Variance from Article XI, Section 100-119. 2A of the Zoning Code for the placement of an accessory stairway and platform in the Matter of Appeal No. 3735 - DINO AND LYNN ROSSINI, .. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Stairs must be detached from the top platform (although • it may be near same - not physically attached) ; 2. Deck platform and all related construction must remain open and unroofed (except for railings) ; 3 . Structures must be constructed in the best way possible to avoid disturbance to the existing vegetation within this bluff and immediate surrounding area; 4. Area around the "stringers" or poles which will hold the stairs must be replanted, if necessary, with additional ground cover as' recommended by the N.Y.S. Goehringer, Chairman Southold Town Board of Appeals Main Road Southold, New York 11971 Dear Mr. Goehringer: Regarding your request for our assessment of Appl. No. 3735 - Dino and Lynn Rossini (Variance) , please be advised that a site-inspection was conducted on July 15, 1988. During the inspection it was noted that the bluff, which the proposed stairs and landing are to be built upon, has no toe protection and is flanked by properties with existing wooden bulkheads at the toe of the slopes. Almost vertical slopes were noted in sections at both the top and along the toe of the bluff. This indicates soil erosion and bluff recession is occurring. The bluff face is at an approximate slope of 73 percent or a horizontal to vertical ratio of 1.5: 1. Existing vegetation on the bluff face is pre- dominantly annual weeds and grasses. There has also been much debris de- posited on the bluff face. Adjoining property to the west is apparently owned by the Saltaire Property Owners' Association and has access to the beach from an existing stairwell. I hope this information wil be useful to you. Kart dated July - 9, 1981 indicating approximately one-story framed house located approxiffiateiy three-quarters of the way north of the property or the Soundview Avenue I should say. Extending three quar- ters of the way into the property. And the-,.applicant proposes an ex- tension of the.-.deck-that 's on the front: of . the house now- going out to a. landing and then steps going down to the Sound. And I' have a copy of the Suffolk County Tax Map indicating this and surrounding proper- ties in the area. Would you- like to be heard'? MR. ROSSINI: The very fragile nature of this cliff. . . CHAIRMAN GOEHRINGER: I don't know if that' s on: You might want to check that. MR. ROSSINI: So I have been talking, .the •D•.E..C. has :required and they were concerned as I- about some of the details of construction. And as a result, the drawing was altered to reflect three clarifications, four as a matter of fact. One, the basic supports for the deck must be at least five -feet back from the bluff line so as -not to complicate the erosion problem which has always been going on in this area. Also, the deck is going to have a pitch in the rearward direction so that the drainage would be favorable and so the water would cascade toward the Cliff. And the third, the change that the D.E.C. and I had discussed is that the planks would run in the east west direction so that there wouldn 't be a runoff even- if the pitch contained an excessive drain; the runoff would not be • in the direction of the cliff. CHAIRMAN GOEHRINGER:_ Let me just ask you a question because I was up to see you last Saturday and I failed to ask you at that time, and of course I'm interjecting it into the hearing anyway, if you were going to sink four by 'fours into the- cliff to support the stairs or were you going to support the stairs on steel cables? MR. ROSSINI: Four. by, fours. CHAIRMAN GOEHRINGER: We have most recently asked Suffolk County Soil and'.'-Water Conservation which is an organization which we usually refer most of these applications. to. They have not given us their input yet. So the closing of this hearing , is subject, to receipt of that. Once we receive .it, we'll send you' a copy. But if I. should happen to forget, I am closing the .hearing with that in mind. And of course, the only other .conversation was that the linking-of the deck, attaching the house keeping it succinct from the- platform that you have going out to the front platform. So that if anything was to fall. away, it would not drag a portion of the house with it. MR. ROSSINI: I had felt that the intention would be favorable because there would not be any structural -'necessity of any structural supports. right at the bluff line. The. bluff line is extremely fragile. And to put any supports at ..that area,. would compromise it. It was my thought that -the cantilever deck which really- is structurally . supported of' a very very heavy extremely limited house and the..cantilever section would support or attach directly- to the stairs and you don 't have to sink verticals at the cliff line. " It can structurally be handled without molesting the bluff line which I'm concerned about. That ' s. my feeling about the most favorable way to handle it. It' s the bluff line that I 'm concerned about. CHAIRMAN GOEHRINGER: I understand that. The only thing I wanted to mention to you was that 'we did grant an application for a deck for a gentleman in Orient and it was very very similiar to this. except .that he didn 't have as much ground cover up above. And there was no deck on the house at .all and we asked him not to attach the deck to the house. We asked him to make it free-standing. So 'the only thing, I don 't think we're going to do that to you because you already have a deck attached to the house.. What you're doing mainly is modifying that deck. However, the, I. guess you would call it a ramp, ramp leading to the platform is what we 're asking you not to attach to the deck if .'' the Board is. so inclined. to grant this application. That . would be the one prohibitive thing that we would be excluded at this point. I thank you very -much.. As soon as we get that letter from Soil and Water which will primarily address the way which way .the 'piles- should be placed in the cliff I hope.
