At a Meeting of the Zoning Board of Appeals held on June 9, 1988 the above appeal was considered, and the Action indicated below was taken on your Request' for Variance to the Zoning Ordinance, Article III, Section 100-32: Upon application of RUSSELL E. PLANITZER to locate pool, fence enclosure, pergola structure and part of garden structure, in the frontyard area. Location of Property: Private Road, Wilderness Point, Fishers Island, NY; 1000-12-2-6. 5, 6.9 (prev. 6.6) . WHEREAS, a public hearing was held on June 2, 1988 , in the Matter of the Application of RUSSELL E. PLANITZER under Appeal No. 3721; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: (CONTINUED ON NEXT PAGE) Page 2 - APpl. No. .3721 Matter of RUSSELL E. PLANITZER Decision Rendered -June 9, 1988 1. The property in question is identified on the Suffolk County Tax Maps as District 1000, .Section .12, Block 2, Lot . 6. 5, 6.9 (prev. . 6.6) ; and contains a total area of 5.75 acres. 2. The subject premises is presently. improved with a dwelling structure presently under construction pursuant to Building Permit #15495 issued November 15, 1,986. 3. By this application, appellant- proposes to locate the following accessory structures: (a) 29 ft. x 50 ft. inground pool; (b) 12 ft. x 51 ft. long pergola structure 10 ft. in height; (c) garden structure approximately 50' ft. square with 30" high wood fence on 18" stone retaining wall; (d) 48" high fence for pool enclosure and garden connettions, all as more particularly shown on Site Plan revised May 12, 1988, prepared by , Robert A.M. Stern Architects (L1) . 4. The setbacks proposed between the closest accessory structure ( 48" high wood fence and pergola structure) and the southerly property line (near the right-of-way) is six feet. 5. Article III, Section 100-32 requires accessory buildings to be located in the rearyard area with a minimum of three feet from the side and rear lot lines. 6. It is the consensus of the Board Members that most of the property appears to be frontyard area, technically, and freshwater wetlands do exist over a large portion of the yard. 7. It is the position of this Board that: (a) the relief requested is not unreasonable; (b) the project as proposed is not within the character of the general neighborhood; (c) the circumstances of the property are unique; (d) the variance, if granted as applied, will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town; (e) there is no other method feasible for appellant to pursue other than a variance; (f) in considering all the above factors, the Board finds it will be within the interests of justice to grant conditional approval, as further noted below. PLANITZER Decision Rendered .June 9, 1988 Accordingly, on motion by Mr. Goehringer, seconded by Mr. Sawicki; it was RESOLVED, to GRANT a Variance from the Provisions of Article III, Section 100-32 of the Zoning Code for the placement of - acces- sory structure(s) located as shown on plan revised May 12, 1988 and prepared by Robert A:M. Stern Architects, and SUBJECT TO THE FOLLOWING CONDITIONS: 1. Screening by evergreens or shrubbery shall be planted at a 6 ft. height and at a setback of five feet from the front property line for a minimum length of 190 feet along the front property line near the right-of-way (see sketch attached with subject 190 ft. length highlighted) ; {No fences as screening will be permitted to be substituted).; 2. No obstructions by screening or otherwise which. cause disturbance into the right-of-way area. 3 . No excavating or similar activities which will disturb land area between new construction and the bluff. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Doyen, Douglass and Sawicki. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli- cation. c. The work covered by this application may not be commenced before issuance of Building Permit. d. As we look up at their house I am; of course, interested .in all aspects of their construction program. I have personally visited the site a number of times and reviewed plans and schematics of their design. I have been favorably impressed with Mr. and Mrs. Planitzer's sensitivity to the site characteristics and neighbors' concerns in terms of the siting of their house and associated gardens and pool, as well as the construction and planting materials,. I might make several points in support of their appeal: 1) While their house is reasonably large it is by no means larger than many of the houses in the area. For example, our house is as large or larger, and the Noyes house, which is immediately west of us, is of comparable size. Looking east toward Isabella Beach there are a number of visible, equally large houses. In addition, the Planitzers, with two small children and the possibility of more to come, are likely to need the room. 2) . The Planitzers have approximately eight acres of land (more than twice as much as we own) but are restricted in its use because of current DEC restrictions which require stringent setbacks from wetlands. These restrictions of course did not apply when the existing houses in the neighborhood were built and hence new B OSTO N WAS H I N GTO N, D.C. -2- owners face a hardship that old owners did not face when they built their houses. Having reviewed the site and the Planitzer's plans, I feel they have been scrupulous in their concern towards the environment and that the zoning variance they are seeking is reasonable, especially in light of their careful attention to how their plans might affect their neighbors. Although the plan is a slight improvement and gives more detail I remain opposed. The petitioners claim a unique hardship because there is riot enough room on the lot legally to construct the proposed accessory structures in the proper place. The legally useable part of the property is indeed quite large -- at least as large or larger than most similar sites in the neighborhood. The petitioners chose to build a very large house -- larger than any in the vicinity -- which occupies almost all of the available land. The house is over 42 feet high on the east elevation, as reconstructed by bulldozer, and over 46 feet on the west elevation. It is approximately 150 feet long and because of the way in which it is angled it is approximately 72 feet wide. Its size it out of keeping with any structure in the vicinity. Now, because of the exceptional size of the building, the owners are claiming a hardship. This seems unreasonable since the owners themselves chose to build a huge structure which prevents the property being used for any other purpose. In any case, of the ten other houses overlooking or adjacent to the petitioner's house, all of which are built on substantial lots, only two have a swimming pool and both are in the back of the house and not visible from the road or the front of the house. It is not clear that even the existing pools would be allowed under current regulations since they are both built within a few yards of the sea. The petitioners are not being denied a use consistent with the neighborhood in which they are building. The proposed swimming pool and pool equipment are very close to the boundary of the property on the south, running right next to the access road and close to my property. While there is no longer a generator the plan transfers the ugliness and noise of the pool's mechanical devices to the neighbors, rather than have them near the house of the petitioners. Should the board of appeals nevertheless feel the petitioners are indeed suffering a hardship with respect to the lack of a swimming pool , they should at least be required to build an attractive J If Ct_q Page 2 opaque fence of natural materials at least ten feet high between the pool and the road and to locate the pool 's auxiliary mechanical devices near their house rather than near their neighbors' property and access road. Further, and this is critical for the environment, no provision has been shown for draining the large pool , whose chlorinated water might end up in the surrounding wetlands and/or in our well . The proposed garden will run within only 23 feet of our property. All of us like gardens, but the real problem with the garden is that it will tower over our property but 23 feet away (36.5 feet finished elevation over the 24 feet elevation of our property at that point -- all the existing elevations are not shown in the proposed plan which is therefore misleading) , and above that a pergola of 11 feet. There is also to be a fence of 2 and 1/2 feet on top of at least a nominal 2 1/2 foot retaining wall . In other words, within 23 feet of the property line they are proposing a structure of 50 by 50 feet and between at least 5 feet and 16 feet above the existing elevation and between 15 and 26 feet over the elevation of our yard only 23 feet away. The bulk of the proposed "accessory" structure is thus larger than our entire house and it is taller by two feet ! I can see no hardship to the petitioners which this very large structure right next to our property is supposed to relieve, but it will surely dominate our yard and house.
