JOSEPH H. SAWICKI
JAMES DINIZIO, JR. ACTION OF THE BOARD OF APPEALS
Appeal No. 3761:
Application of ELSIE D. YOUNG for a Variance to the Zoning
Ordinance, Article III, Section 100-30(15) (M) to allow
conversion of dwelling for Accessory Apartment with Certificate
of Occupancy dated after January 1, 1984, although Affidavit of
Building Inspector indicates dwelling met the requirements of a
Certificate of Occupancy had application been made in a timely
fashion. Location of Property: 480 Grissom Lane, Southold,
NY; County Tax Map Parcel No. 1000-78-1-10.3 .
WHEREAS, a public hearing was held and concluded on Octo-
ber 6, 1988 in the Matter of the Application of ELSIE D. YOUNG
under Application No. 3761; and
WHEREAS,. at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. By this application, appellant requests a Variance from
Article III, Section 100-30, Subsection B{15} (M) of the Zoning
Ordinance, which provision states as follows:
. . .The building which is converted to permit an acces-
sory apartment shall be in existence and have a valid
certificate of occupancy issued prior to January 1,
1984. . . .
1 _

Matter of ELSIE D. YOUNG
Decision Rendered November 16, 1988
2. Under Application for a Special Exception filed and
considered under same dates herewith, (File No. 3760) , applicant
proposes to establish a new "Accessory Apartment" within the
existing principal (dwelling with garage) structure, as more
particularly shown on the sketched plans submitted with the
application prepared by William Young.
3. The premises in question is located in the "A-40"
Residential and Agricultural Zoning District, containing a total
area of approximately 40,000 sq. ft. and road frontage of 135+-
feet along Grissom Lane.
4. The subject premises is improved with a single-family
dwelling structure with attached garage as more particularly
shown on the survey prepared by Roderick VanTuyl, P.C. , revised
April 8, 1985.
5. The area to be occupied as an "Accessory Apartment" is
at the northerly end of the existing structure and will contain
a living area of approximately 528 square feet (within an area
2416" x 221 ) as shown on the sketch floor plan submitted with
this application. The remaining floor area will continue to be
used as the principal single-family residence of the owner.
6. Article III, Section 100-30(B) permits the
establishment of such use, subject to conditions (a) through (p)
thereof.
7. Subsection "m" thereof provides that " . . .the building
which is converted to permit an accessory apartment shall be in
existence and have a valid Certificate of Occupancy issued prior
to January 1, 1984." Although a Certificate of Occupancy was
not validated until after January 1, 1984, it is hereby
determined that the documentation submitted is sufficient and
the applicant has complied with this specific requirement,
entitling her to same (see Affidavits, etc. ) .
8. It is the position of this Board that this variance
application must be dismissed since the Board is without
jurisdiction. to vary the conditions of a Special Exception;
(Knadle v. ZBA of Huntington, 121 A.D. 2d 447 (1986) ; Roginski
v. Rose, et al. , 63 N.Y. 2d 735 (1984) .
9. A parking plan has been submitted in behalf of the
applicant depicting the area immediately east along the front
section of the dwelling. The Bulk and Parking Schedule of the
Code requires two spaces for the one-family principal use, and
the Accessory Apartment will be required to have two parking
spaces, for a total of four. (Each available garage space would
be permitted as one parking space, when appropriate. )

REASON FOR APPEAL Continued
Y,
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sory HARDSHIP because
Without rental income from the proposed accessary apartment,
there would be insufficient resources to sustain the household
and maintain its premises adequately for any extended period
of time.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
Resident/owner is recently widowed and has at her disposal only
limited monthly income available primarily from part-time employ-
ment and partial social security benefit payments.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE-DISTRICT because
Only one or a maximum of two adults would be permitted to
reside within the accessary apartment. This would make
the total number of full-time residents at 480 Grissom
Lane less than the typical number of inhabitants of other
houses in this subdivision.

REGULAR HEARING OF THURSDAY, OCTOBER 6, 1988
Appl. No. : 3760 & 3761
Applicant(s) : . ELSIE D. YOUNG
Location of Property: 480 Grissom Lane, Southold
Tax Map ID' No. : 1000- 78-1-10.3
October 6, 1988 Regular Meeting
Present were: Chairman Gerard P. Goehringer; Member Charles Grigonis,
Jr. ; Member Serge Doyen, Jr. ; Member James Dinizio, Jr. Absent was:
Member Sawicki (due to serious family- illness) . Also present were:
Board Assistant Linda Kowalski , and approximately 40 persons in the
audience.
. The Chairman read the Legal Notice for this hearing , as published
in the suf,folk Times and L. I. Traveler-Watchman, Inc.
CHAIRMAN GOEHRINGER: And I have the affidavit in the file from
Curtis W. Horton indicating the nature of what I had read in the
legal notice.. I have a letter from the next door neighbor. And
I have a copy of a survey dated. April 8 , 1985 indicating the ap-
proximate placing of the house on said parcel. I have the plans
of the house and we'll ask the applicant questions concerning the
accessory apartment. And I have a copy of the Suffolk County Tax
Map indicating this and surrounding properties in the }a-rea. Is
there somebody who would like to be heard on behalf of this appli-
cation? Mrs. Young, is she available? Mr. Young. How do you do
sir?
MR. YOUNG: Mrs. Young is my mother. I 'll try to answer whatever
questions you might have. %h addition, I might say before you
start, there should also be an affidavit from Ed Williams.
CHAIRMAN GOEHRINGER: Yes there` is. The nature of this applica-
tion is for an accessory apartment for what use sir? Is it a
rental use?
P1R. YOUNG: Yes it would be a rental to provide lessee accommoda-
tions for one or a maximum of two adults.
CHAIRMAN GOEHRINGER: And this is primarily the utilization of the
garage area?
MR. YOUNG: It will be strictly the garage. It ' s just a matter of
converting a two-garage to a one bedroom, one living room, bathroom
and combination kitchen/dining room. The exterior, there should be
some diagrams here included in the application. It shows essenti-
ally the only alterations visible from the road would be two sliding
glass doors that replace an 18 foot fiberglass garage door. And es-
sentially the driveway remains the same except for a sweep across the
front of the porch to provide a turn around. But again, from the : ;

road, those would be the only visible differences to the present ap-
pearance of the house or garage.
CHAIRMAN GOEHRINGER: Will there be any fireplace or chimney added
to the structure at all?
MR. YOUNG: No. At present we're contemplating electric heat and
that will not involve an. additional furnace or gas heating system.
CHAIRMAN GOEHRINGER: And the bathroom facilities or lavatory fa-
cilities will be utilized, you' ll be utilizing the same cesspool
system that exists.
MR. YOUNG: Yes. I called the Department of Health to inquire as
to the possibility of using the current septic system and they in-
dicated that they had no problem with that as long as the Building
Department found it acceptable. In addition, the .same thing with
domestic water from the well in the front of the property.
CHAIRMAN GOEHRINGER: We thank you very much for coming in Mr. Young.
Is there anybody else who would like to speak in favor of this appli-
cation? Anybody like to speak against the application? Questions
from Board members. Hearing no further questions, I 'll make a motion::.:
closing the hearing reserving decision until later.
All in favor - AYE.
