Appeal No. 3843:
Upon application of ADAM ASSOCIATES for a Variance to the
Zoning Ordinance, Article VIII, Section 100-82 for approval of
insufficient lot area and width of proposed Lot No. 4 (which is
located in the LB Zone District) as shown on the subdivision map
pending before the Southold Town Planning Board. Property
location: North Side of C.R. 48, Mattituck, NY; County Tax Map
District 1000, Section 113, Block 12, Lot 10.
WHEREAS, a public was held and concluded on June 29, 1989
in the Matter of the Application of the ADAM ASSOCIATES under
Appeal No. 3843; and
WHEREAS, at said hearing all those who desired to- be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and •are
familiar with the premises in question, its present zoning and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. The subject premises is a described parcel of land
containing a total area of 7. 6797 acres with 150.54 ft. frontage
along the north side of County Road 48 and 363 .36 ft. frontage
along a private right-of-way (to the north) , Hamlet of
Mattituck, .Town of Southold, and identified on the Suffolk
County Tax Maps as District 1000, Section 113, Block 12, Lot
10.
2. Under jurisdiction by this Board in this application is
the requested lot area of proposed Lot No. 4 of 56,029 sq. ft.
with the established 150. 54 ft. lot width. The remaining
section of the premises is proposed for division into three
other lots which will conform to the minimum lot size
requirement for the R-80 Low-Density Residential Zone District
as follows: (a) Lot #1 consisting of 90,182 sq. ft. ;
(b) Lot #2 consisting of 98,275 sq. ft. and (c) Lot #3

consisting of 90,000 sq. ft. , all as shown on the Minor
Subdivision Map prepared by Peconic Surveyors & Engineers dated
May 7, 1987 (revised January 30, 1989) .
3 . Article VIII, Section 100-82 and Bulk Schedule, of the
Zoning Code for this requires a minimum lot area of 80,000 sq.
ft. and 175 ft. width for each newly established parcel in this
Limited Business (LB) Zone District.
4. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises;
(b) that the relief requested is not unreasonable in
light of the circumstances;
(c) that the variance will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience and/or order of the Town;
(d) that although the relief requested is substantial
in relation to the requirements, the grant of the variance will
not create any increase in density since the lots are improved
with residences;
(e) that there is no other method feasible for
appellants to pursue other than a variance;
(f) that in considering all of the above, the
interests of justice will be served by granting the variance, as
applied.
ACCORDINGLY, on motion by Mr. Dinizio, seconded by
Mr. Sawicki, it was
RESOLVED, to GRANT the relief as requested under Appeal No.
3843 in the Matter of the Application of ADAM ASSOCIATES for
insufficient lot area and width of proposed Lot No. 4 of 56,029
sq. ft. and 150. 54 feet, respectively.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Grigonis, Sawicki and Dinizio. This resolution was duly adopted.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sar HARDSHIP because "4'1' :•
Y Lot `4��'on'�the:7minor subdivision map is without any reasonable
use under the current zoning-,1aw unless the size variance is allowed. The zoning
line is 400 feet north of Middle Road and is the dividing line between Lots 3 and
4 on the minor subdivison map. Joining Lot 4 with Lot 3 will. not result in relief
since the only„uses consistent with uses allowed in A-C district are special
exception uses, such as social clubs, religious facilities and the like, which
it is unlikely will be feasible in this area.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because most are large enough to conform
to the requirements or consist of pre=existing non-conforming uses.
3. The Variance would observe the.spirit of.the Ordinance and WOULD .NOT CHANGE THE
CHARACTER OF THE DISTRICT because the use is consistent with the current zoning
and does not interfere or detract from the existing uses - a telecommunications
sales office, a cesspool, and a fence company

Dear Mr. Scheinberg:
It has come to the Planning Board' s attention that the
cross section shown on the approved subdivision map is not in
accordance with the Town Highway Specifications. The Board
stated in their previous correspondence that a 16 foot road,
rather than a 20 foot road is required. It should be noted
however, that the 16 foot road is to be constructed in
accordance with the Highway Specifications, rather than the
cross section shown on the endorsed map.
You should be aware that before building permits can be
issued on either Lots 1, 2 or 3, the lot owners will 'have to
obtain approval from the Zoning Board of Appeals in order to
improve the roadway between your property and Cox Neck Lane.

Dear Sirs:
We are the attorneys for Adam Associates. A copy of your appeal
No. 3834 is enclosed.
We have not been able to ascertain whether or not an extension of
this variance is necessary at this time. Final approval of the
map has not yet been accomplished and we would anticipate an

Variance to the Zoning Ordinance, Article VIII, Section 100=82 for
approval of insufficient lot area and width of proposed Lot No. 4
(which is located in the LB Zone District) as shown on the Subdivi-
sion Map pending before the Southold Town Planning Board. Property
Location: North Side of C.R. 48, Mattituck, NY; County Tax Map
District 1000, Section 113, Block 12, Lot 10.
Present were : All Members of the Board of Appeals : Chairman Gerard
Goehringer; Charles Grigonis, Jr. ; Serge Doyen, Jr. ; Joseph H.
Sawicki and James Dinizio , Jr. Also present were: Linda Kowalski,
Board Secretary, and approximately 30 persons in the audience at the
beginning of the hearing.
The Chairman opened the hearing at 8: 20 o' clock p.m. and read the
legal notice of this hearing and appeal application for the record.
CHAIRMAN GOEHRINGER: I have a copy of a Subdivision Map produced
by Peconic Surveyors dated May 7, 1987 indicating Lot No. 4, which
is the nature of this particular application, as being at 56,029
sq. ft. and I believe the required square footage is. 80, 000. Is
there somebody that would like to be heard in behalf of this?

LYNNE GORDON, ESQ . : Good evening. I 'm Lynne Gordon, One Union
Square, Aquabogue, New York. I represent the applicant, Adam
Associates. The date of the survey is perhaps indicative of how
long we have. been dealing with this problem. Adam Associates
bought this property some time in 1986, and on April 15, 1987,
we had sketch plan approval. Prior to the Zoning change in
January of this year, what is shown as Lot 4 on your map met the
requirements of Business, which at that point in time was 40,000
sq. ft.
Since April of '87, we have been spending a lot of time
because of the right-of-way, and improvements had to be made to
a private right-of-way, getting the Planning Board an engineer 's'
set-up so that they could decide what requirements did need to be
done for this roadway.
In the interim, we obtained the approval of the Department
of Health Services, and we have a SEQRA determination. In March
of 1989, the Planning Board advised us to proceed Lot 4 no longer
conformed to the current zoning requirements .
You will note there are two letters to you in the file. The
first ones say that they did not approve of this and the second
one rescinding the earlier (Planning Board) letter, indicating
there was an error, that they did not have any objection here
granting this variance, and saying that the lots along Middle
Road in the vicinity of the above-mentioned subdivision are all
located in the limited business zone district. These lots were
created by the "arbitrary zoning line" adopted under the new
zoning. I looked up the word arbitrary-- I Im ow what it means
but I want to see what the dictionary says. It says, "not
governed by principle depending on voilition--based on one ' s
preference, notion or whim. CaprLcious . Tyrranical.-" And
unfortunately I think this is one of the spots where the Master
Plan, while drawn on an overall idea, didn't look at the individual
circumstances that were being created. The limited-business
requirements are 80, 000 sq. ft. We have 56, 000 sq. ft. They
are 175 feet in width. We have 1 0 feet in width on Lot 4. The
neighborhood itself, to the east, and I think you have the Tax Map
in front of you-- you will note that there are two substandard
lots to the east and, the next to the east which are less than the
acreage on this , but nevertheless since they're in single-and-
separate, will comply for use and limited business. To the west

there 's a lot of approximately the same size, which is currently
being developed as a mini-mall. At least that's what the sign
says and there is construction underway. Across the street from
this property you're probably familiar, but to place it for you
is what is or has been called "The Hut, " and there 's a fence
company, and a cesspool company shortly to the west of that.
The practical hardship here is very obvious. I 'm not going
to submit appraisals to you, but if we can't use this for limited
business, we can't use it for anything. We can't combine it
with the other lots because of the configuration. And because of
the zoning. Essentially, we have a valueless lot.
The only possible use for it would be to sell it to the
neighbors, and they don't need it, so we 've got nothing without
this variance.
I don 't think there ' s any public harm with keeping with the
intent of the size of the neighborhood. And the Planning Board
has no objection to this variance.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary-HARDSHIP because Lot 4 on the minor subdivision map is without any reasonable
use under the current zoning law unless the size variance is allowed. The zoning
line is 400 feet north of Middle Road and is the dividing line between Lots 3 and
4 on the minor subdivison map. Joining Lot 4 with Lot 3 will not result in relief
since the only.uses consistent with uses allowed in A-C district. are special
exception uses, such as social clubs, religious facilities and the like, which
it is unlikely will be feasible in this area.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because most are large enough to conform
to the requirements or consist of pre-existing non-conforming uses.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF-THE DISTRICT because the use is consistent with the current zoning
and does not interfere or detract from the existing uses - a telecommunications

Dear Ms. Gordon:
The Planning Board has reviewed the above mentioned
subdivision under the newly adopted Master P1an. .Lot #4, which
was previously zoned Business, is now zoned Limited Business
(LB) . The lot size under the LB zone must be 80,000 square feet.
The Planning Board can not proceed with the application as
is, Lot #4 must conform to the Town Code.
Please note also that the proposed road for the residential
lots must be in accordance with the alternate road
specifications. These specifications require a 20 foot wide
wearing course, not a 16 foot wide pavement as shown on the map
submitted. Road profiles for the 20 foot road must be submitted
for review by the Engineer.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR part 617,
Section 617 , Section 617 .10 and chapter 44 of the Code of the
Town of Southold, notice is hereby given that Southold Town
Planning Board, as lead agency for this unlisted action
described below has determined that the project will not have a
significant effect on the environment.
DESCRIPTION OF ACTION
Michael Adams Associates proposes to subdivide 7 . 6797
acres into four ( 4) lots ranging in size from 56,029.
sq.ft. to 98,275 . sq. ft.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted, reviewed
and it was determined that 'no significant adverse effects
to the environment were likely to occur should the project '
be implemented as planned.
Because there has been no correspondence received from the
- Department of Health Services in the allotted time, it is
assumed that there are no comments or objections from that
agency.
Because there has been no correspondence received from the
New York State Department of Environmental Conservation in
the allotted time, it is assumed that there are no comments
or objections from that agency.
