Variance to the Zoning Ordinance Article XXIII, Section 100-239d, A.1, for permission to construct a one family dwelling with insufficient setback and within 100 feet from Long Island Sound in this R-40 Zone District. Location of Property: 90 Petty' s Drive, Orient, County Tax Map No. 1000, Section 14, Block 2, Lot 2.4. WHEREAS, a public hearing was held and concluded on September 21, 1989 in the matter of the Application of CIPITELLI BROS REALTY, under Appeal No. 3849; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning; and the surrounding areas; and WHEREAS, the Board made the following findings of fact: I. The premises in question is located along the east of Petty' s Drive, Town of Orient, and is identified on the Suffolk County Tax Maps as District 1000, Section 14, Block 2, Lot 24. 2. This is an application for Variances from the Zoning Code Article XXIII, Section 100-239d A.1, for permission to construct a one family dwelling, proposed construction will be within 100 feet of the Sound. Page 2 - Appl. No. 3849 Matter CIPITELLI BROS. REALTY Decision rendered October 12, 1989 3 . Article XXIII, Section 100-239d A.1, requires all building located on lots adjacent to Long Island Sound and upon which there exists a bluff or bank landward of the shore or beach shall be set back not less than one hundred ( 100) feet from the top of such bluff or bank. - 4. The subject premises for the one family dwelling is known and referred to as being built within the building envelope, as identified on the site plan from Ward Associates, also a copy of the Survey from Roderick Van Tuyl, Dated 4/17/89. 5� In considering this application, the Board finds and determines: (a) that the circumstances of this application are uniquely related to the premises and its established nonconformities; (b) that there is no other method for appellants to pursue, and placing the proposed dwelling in any other location on the premises will require other variance relief ; (c) that the area chosen for the dwelling is not unreasonably located; (d) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (e) that in carefully considering the record and all the above factors, -the interests of justice will be served by granting the variance, as applied conditionally noted below. Varionce to the 7onincg Ordinance Articles XXI I T , Sec+ior„ 100 2onu, n ( )r, 1 is requested for the reason that the existing front yard and top of bluff setback requirements have increased since the original file map was approved rendering the parcel unbuildable. Form ZB1 ' (Continue on other side) 4b REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because''-Town `Zoning Ordinance requires a 100 foot setback for building purposes from the tpp.pf. blyff along the Long Island Sound; and that said setback, coupled with the front yard set-tack provides an unrealistic and unworkable building envelope. See attached survey with setbacks indicated. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the building lot configuration was approved prior to the 100 foot top of bluff setback requirement imposed by the Town. Petty' s Drive also runs at a converging angle with the L.I . Sound which makes this lot, although 40,000 + s.f. , impossible to build upon based on the front yard and top of bluff set back requirements. See attached survey with setbacks indicated. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the use of the property would be for a single family residence; the top of bluff is approximately 15' above mean sea level and is stable (not a very high bluff) ; the Owners intend to stabilize the toe of slope in an approved NYSDEC stabilization method to further protect the top of bluff; other lots in the immediate vicinity show similar problems. First, the nature of the subject area is still essentially unimproved open space (there are three houses to the east of the subject parcel, and a few houses to the west) . There is a significant amount of vacant land abutting the Sound which has apparently been granted subdivision approval. Because of the undeveloped nature of the area, this granting of a variance could set a precedent which would place a burden on the Board to grant future variances of a similar nature. Failure of the Board to act consistently could result in allegations of arbitrary and capricious decisions. If such were to occur, the basic purpose and intent for increasing soundfront set-backs to 100 feet would he frustrated, defeat--ng t:e purpose for the amendment. It is therefore incumbent on the Board to deny this application. In addition, the aesthetic quality currently enjoyed by my client's would be changed. Now, there are panoramic views of the cove. If the surrounding properties are improved in such a way that 50 foot set-backs were permitted it would appear that my client would be adversely affected. The vacant lot is heavily vegetated with grasses, weeds and shrubs. The existing slope of the lot is towards the north west corner of the bluff. At the bluff top there is a vertical lip of one to two feet which is actively eroding. The bluff face has gravelly loamy soils on it, sloughing off from above. About sixty to seventy percent of the bluff face is vegetated with grass and weeds. There is no toe stabilization present. At the toe is a large amount of litter, including tree trunks, branches and garbage. The bluff face appears relatively stable, however, the vertical lip should be re- moved to give the face a continuous slope approximately at it's natural angle of repose. A small berm should be installed along the top to stop runoff from flowing over the bluff face. Lastly, plant in the bare areas to 'Cape' American Beachgrass.
