Matter of GEORGE REINHARDT. Variance to the Zoning
Ordinance, Article III, Section 100-31, as disapproved, for
permission to .construct a deck addition, proposed construction
exceeds permitted lot coverage and has insufficient setbacks
from property line. Property Location: 1380 Pvt. Road, #3
Trumans Path, East Marion, County Tax Map No. 1000, Section 3.1,
Block 12, Lot 10.
WHEREAS, a public hearing was held and concluded on March
15, 1990 in the matter of the Application of GEORGE REINHARDT,
under Appeal No. 3916; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The. premises in question is located along the. south
side of Main Road, Hamlet of East Marion, and is identified on
the Suffolk County Tax Maps as District 1000, Section 31, Block
12, Lot 10.
2. This is an application for Variances from the Zoning
Code Article III, Section 100-31, for permission to .construct_
deck addition, proposed construction exceeds permitted lot
coverage and has insufficient setbacks from property line.

3. Article III, Section 100-31, In A-C, R-80, R-120,
R-200 and R-400 Districts, no building or premises shall be used
and no building or part of a building shall be erected or
altered which is arranged, intended or designed to be used in
whole or in part for any uses except the following.
4. The subject premises for the house is approximately 26
ft. by 50 ft. , the deck is 7+- ft. from the south property line,
20 ft. from the west property .line and the house and deck is
2,000+- sq. ft. in this R-40 Zone District.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed deck in any other location on
the premises will require other variance relief;
(c) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(d) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Dinizio, it was
RESOLVED, to GRANT a Variance in the matter of the
application of GEORGE REINHARDT as applied under Appeal No.
3916, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the deck indicated on survey dated remain
unroofed and opened.

10 indicating this and surrounding properties ,
11 and I was just wondering if we have a per
12 centage of your lot coverage? We do here.

16 MR. REINHARDT: Thomas Reinhardt.
17 THE CHAIRMAN: These decks are exist-
18 ing at this particular time; are they not?
19 MR. REINHARDT: Yes.
20 THE CHAIRMAN: When were they built,
21 Mr. Reinhardt?
22 MR. REINHARDT: Originally built in
23 the spring of ' 89, and the addition in
24 question was built in late summer fall

J 2 _ THE CHAIRMAN: Tell us what the
3 reason is, or the need for this particular
4 deck.
5 MR. REINHARDT: Well , there is a
6 patch of land between the end of the deck
7 and the outdoor . shower. It was built bet-
-8 ween the deck and the shower.
9 THE CHAIRMAN: How high above the
10 ground would you say these were?
11 MR. REINHARDT: The original deck is.
12 about, I would say, no more than eight
13 inches and the addition is maybe two inches .
14 THE CHAIRMAN: You do not have a
15 percentage of the lot coverage of how much
16 you are over.
17 MR. REINHARDT: No, I don' t .
18 THE CHAIRMAN: Maybe you could do
19 some calculations , and we' ll do some also,
20 and see if we can arrive at a figure. Only
21 because we would like to incorporate that in
22 the decision. You have the figures here. I
23 mean, you can multiply and divide them
24 yourself .
25 I would just like to confer with you,

2 that we are arriving at the same figures .

4 as well . Whenever you can, within the next
5 couple of weeks .
6 MR. REINHARDT: If I could just say
7 that my father wanted me to state that he
8 had spoken to Victor Lessard, who approved
9 the original permit , and he told him that as
10 long as the deck blended in with the grounds
11 or remade the 'grounds the blend in with the
12 edge of the deck there would be no need for
13 another permit for that addition.

A. TIDAL WETLANDS:

ered with,or which border on, tidal waters, or lands
lying beneath tidal waters, which at mean low tide
are covered by tidal waters to a maximum depth of
five (5) feet, including but not limited to banks,
bogs, salt marsh, swamps, meadows, flats or other
low lying lands subject to tidal action:
(2) All banks, bogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following: salt hay, black
grass, saltworts, sea lavender, tall cordgrass, high
bush,.cattails, groundsel, marshmallow and low
march cordgrass;and/or
(3) All land immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-
ty-five (75) feet landward of the most landward
edge of such a tidal wetland.
B. FRESHWATER WETLANDS:
(1) "Freshwater wetlands" as defined in Article 24, Ti-
tle 1, § 24-0107, Subdivisions 1(a) to 1(d) inclusive,
