Matter of WALTER RAFFERTY - Application for a Variance to the Zoning Ordinance, Article XXIV, Section 100-241A, (Article XXVIII, Section 100-281 (3) as disapproved by the Building Inspector) for permission to construct additions and alterations to "garage with apartment" structure. Property Location: East End Road,' Fishers Island, NY; County Tax Map District 1000, Section 003, Block 07, Lot 005. WHEREAS, public hearings were. held both on March 15, 1990 and on May 15, 1990 under this application, and -as amended to include not only a variance as to proposed .ad'aition's, 4n'd :;alterations - but ' also to reinstate use of said garage structure as a legal nonconform - ing second dwelling; WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the immediate surrounding areas; and 1. The premises in question is situate along Middle Farms Pond at the East End of Fishers Island, Town of Southold, and is identified on the Suffolk County Tax Maps as District 1000, Section 003, Block 07, Lot 005. 2. The subject premises contains an area of 6 .23+- acres (includ- ing wetland and upland areas) and is improved by two buildings, as follows: L ti _ Page 2 - Appl. No. 3911 Appl. of Walter Rafferty Decision Rendered May 30, 1990 (a) principal (main) single-family dwelling situated at the northern portion of the premises (at elevations above 35 feet above mean sea level) and near center between the two side property lines (the setbacks of the buildings have not been provided for reference) ; (b) separate "garage" or accessory structure containing approximately 616 sq. ft. of first floor area, and situated easterly of the principal dwelling and closest to the east property line. The dimension of the accessory structure as exists is 22 ' x 28' 3. This application is an appeal from the January 2, 1990 determination of the Building Inspector and from the April 13, 1990 determination of the Building Inspector based on a "permit to alter and make habitable" requested caretaker garage for living quarters which has been dormant for more than two years and has lost its legal nonconformity and use thereof as living quarters. 4. Article XXIV, Section 100-241A of the Zoning Code provides as follows: " . . .Except as provided hereinafter, nonconforming use of buildings or open land existing . . .may be continued indefinitely, except that such building or use : A. Shall not be enlarged, altered, extended, reanstructed or restored or placed on a differ- ent portion of the lot or parcel of land occupied by such use on the effective date of this chapter, nor shall any external evidence of such use be increased by any means whatsoever. . . . " 5 . The building plans dated November 29, 1989 prepared by James Volney Righter Architects show substantial renovations and an addition for two stories approximately doubling the existing floor area of the accessory building. The size of the building would also be increased from the existing 22 ' x 28' to 22 ' x 5632' (without the deck extension at the southerly end of the building. The uses of the rooms in the proposed addition are for two new bathrooms, two new bedrooms, laundry room, and the remaining sections of the building would be substantially renovated and renewed to provide a full kitchen with cooking and electrical facilities and living room. For the record it is noted that the February 21, 1989 survey prepared by Chandler Palmer & King, L.S. show an "existing garage" and proposed new location of new septic system to be located north of the structure. 7. It is also noted that copies of a modified survey were submitted showing all structures on the property; however, the original survey as prepared August 1957 (without recent modifica- tions by JVR Architects for the subject addition) was not furnished 8. It is the position of this Board that the record herein clearly shows that the subject building has for more than two -- years, in any continuous period of time from 1958, and perhaps before 1958, remained dormant and has not been used a habitable quarters, with the exception for possibly several hours, or even a day, as "sleep" or "playing" area for one or more children. No proof has been submitted for the record to show that there was clear intent to use this building for habitable quarters for any period of time. It is the Board' s knowledge that the building has depreciated by 50/ or more, and that the building is in an-aban- doned`.state, :and:'hasiebeen for at least 30 years. 9. Accordingly, it is the determination of this Board that (a) sufficient proof has not been furnished to warrant a grant of the variances requested; (b) the relief requested is substantial in relation to the zoning requirements; (c) the proposal is not consistent with those generally existing in the neighborhood; (d) that there is another method available for appellants to pursue other than a variance; (e) the spirit and intent of the zoning ordinance will be served by denying the :relief in this request, as presented; (f) the relief requested is not minimal, and the variances are substantial in relation to the requirements; (g) the spirit of zoning is to restrict and not increase (or add) nonconforming uses, and to eliminate such uses as speedily as possible except in cases where great hardship has resulted. NOW, THEREFORE, on motion by Mr. Di n i z i o , seconded by Mr. Goehringer, it was a; Page 4 - Appl. No. 3911 in the Application of Walter Rafferty to reinstate nonconforming accessory garage structure .for habitable quarters and to DENY the relief requested to enlarge and substantially alter garage structure for said requested habitable quarters. We will ask Brooke Travis if 22 she would like. to continue with her 23 presentation. 24 MS. TRAVIS: I don' t know where to 25 begin, but I guess there are two issues I I 1 83 �a 2 involved. One is to reinstate the non- 3 conforming use and then after we reinstate 4 the non-conforming use, then we are going to 5 ask. if we can add, alter and change the non- 6 conforming building. 7 I think that we have found that there 8 is considerable precedence of two dwellings 9 on a parcel on Fishers Island. To our 10 knowledge, all of the abutting neighbors 11 have at least one other dwelling on the 12 site. Very few houses on the Island have 13 parcels of this size. This is approximately 14 6. 2 acres, and those who do have parcels 15 this size have at least one or two other 16 accessory buildings on the site. 17 We do realize that there might be 1s alternatives to granting this variance, such 19 as subdivisions, but this case has been in 20 our architectural office for almost three 21 years at a considerable expense to the 22 clients . I am just concerned that going 23 through and applying for a subdivision will 24 increase that in addition to a considerable 25 increase in property taxes . 1 84 2 So we hope that we can resolve this 3 through variances and not through the 4 subdivision, again, because there is a 5 precedent of this kind all over the Island. 6 THE CHAIRMAN: What is the zoning in 7 that area? Is it 80 ,000 square feet? 8 MS. TRAVIS: I think it is three g acres. 10 THE CHAIRMAN: Three acres, and we 11 have a total of what? Approximately 6. 2 12 acres , okay. 13 MS. TRAVIS: I mean, I don't even 14 know if it is necessary to. go through. all of 15 the things that we do during construction 16 . . . after construction, maintaining the 17 quality and integrity of the site, and also lg John Thatcher (phonetic spelling) sent a 19 letter. 20 We are building away from the 21 wetlands . Again, we are taking all the 22 necessary precautions during construction. 23 We used two rows of hay bales during 24 construction. There is an existing one 25 foot wall which wiL1—help with the runoff . .: h44d�G7 1 85 2 We are not using piers . We are using 3 the foundation wall . We feel that using 4 piers would not allow for the growth to be 5 continuous underneath the house. So, we 6 will use the foundation instead as a 7 barrier. We have all the approvals from 8 the agencies, the health conservancy, g Department of Environmental Conservation, 10 and the Trustees . 11 THE CHAIRMAN: Can I ask you what the 12 purpose of. this second dwelling is? 13 MS. TRAVIS: The purpose is that Mrs . 14 Rafferty has five children. All of her 15 children have grandchildren at this time 16 and, frankly, when the family gets together 17 on the Island, they can' t fit in the house. 18 Now, I guess they could put five or six 19 people in a room, but it' s simply for that _. 20 purpose and not for guests , but really the 21 immediate family. Every child has, I think, 22 a minimum of two children. So she does have 23 quite a large family. 24 THE CHAIRMAN: Is the main house 25 heated? 1 86 2 MS. TRAVIS: I believe it is heated, 3 but I don' t know. So I would have to 4 determine that for you. 5 THE CHAIRMAN: Is the proposed . 6 structure, and I am referring to it as a 7 structure because it is not a dwelling yet 8 and it may not be a dwelling okay? Is 9 that going to be heated? 10 MS. TRAVIS: It doesn' t have to be. 11 I mean, typically we don't heat buildings . 12 We have small wall unit kind of heaters , 13 forced air. 14 THE CHAIRMAN: We didn' t receive a 15 letter from Mrs . Rafferty. I believe it 16 says that this letter had been used for 17 overnight sleeping arrangements by some of . 18 the children. 19 MS. TRAVIS: Right . - 20 THE CHAIRMAN: Does she have any 21 indication on how long ago that was? 22 MS. But 3 she did indicate, as I said, that ,the 4 children did stay inside this dwelling . . . 5 structure. 6 THE CHAIRMAN: For the record and continue the record, upon this investigation 8 of this premises, we did indicate that the 9 lower floor of the building was used 10 apparent•ly as a carriage house, so-to-speak, 11 which probably either housed a carriage at 12 one time, or an automobile. There was an 13 old, very old kitchen with an existing stove 14 which is vented through a chimney and has at 15 least two bedrooms and an antiquated bed or 16 fragments of those antiquated beds in the 17 building itself . 18 The request of this Board and of Ms. 19 Travis as agent for the Raffertys, was a 20 former denial of the Building Inspector who 21 denied the property and that was basically 22 what we were looking for between the last 23 hearing and this hearing. Our question is ; 24 that there is definitely an establishment of 25 the pre-existing use of the dwelling �► 1 88 I� 2 referred to on the survey as an existing 3 garage apartment , and there is concurrence 4 with that at this particular point by either 5 the application maybe just the applicant 6 and not necessarily the agent for the 7 applicant. g MS. TRAVIS: Well , it depends on how 9 you define that and if it is defined by long 10 stays obviously we couldn' t . . . neither the 11 agent nor Mrs . Rafferty would indicate that 12 that has occurred. But as I said in the 13 letter and Mrs . Rafferty did indicate that 14 the house would . . . someone did stay. 15 THE CHAIRMAN: Is there any 16 electrical service that is in operating 17 condition to that structure? 18 MS. TRAVIS: I don' t know. 19 THE CHAIRMAN: It certainly didn' t 20 appear so when I looked at it . All right , I 21 guess we can wrap it up at that point . 22 Is there anybody in the audience that 23 would like to say anything concerning this? 24 For the record, it is a beautiful spot . TRIVAS: I guess the only thing I 16 would want to add for the record would be 17 that we would take all necessary precautions 18 in building a project, since it is close to 19 the wetlands . There is, as noted in the 20 plan, an existing one-foot concrete wall 21 which we think would help to create a bar- 22 rier during construction. We would also use 23 two rows of hay bales during construction. 24 The project was originally cori- 25 structed in the Twenties. The house and 1 27 2 caretaker's house was part of the original 3 plan and we just wanted to revise that 4 intended original use. 5 THE CHAIRMAN: I feel kind of bad 6 asking you to come all the way down here 7 from Boston to represent Mr. Rafferty in the 8 respect that it appears on this particular 9 application the cart was placed before the 10 horse, in respect that it appears that this 11 building structure has lost its conformity 12 as a building to be used or to house per- 13 sons , habitable dwelling-wise, and I think 14 possibly what should be dealt with in this 15 particular case is an application to 16 reinstate that nonconformity rather than to 17 deal with the setback first . And that is 18 where the problem is at this particular 19 point . 20 But if you would like, you are very 21 welcome to reflect anything in that letter 22 that you just received into the record 23 before we close this hearing. If you want 24 to look it over for a little while, we can C1 25 reconvene the hearing. 1 28 2 MS. TRIVAS: Are you suggesting it is 3 a setback problem issue? 4 THE CHAIRMAN: No . I am saying it is 5 not a nonconforming. It has lost its non- 6 conforming at this point . It has not been 7 denied, but I discussed that with the prin- 8 cipal Building Inspector yesterday and 1 9 told him it should have been denied for the 10 lack of nonconformity at this particular 11 point, and then we would go into the other 12 aspects of the case. 13 In climbing up there last Saturday 14 morning, it appears it has not been used. for 15 about thirty years . . . I mean, just as a 16 guesstimate, and you will see in that letter 17 that it probably . . . I think it reflects 18 thirty years in there, but it 's probably as 19 much as fifty years it has not been used. 20 MS. TRIVAS: What are you suggesting, 21 at this point , in terms of . : . 22 THE CHAIRMAN: I am suggesting that 23 we deny this case without prejudice and if v 24 you would like to come back and deal with 25 any aspects of the fact that the building t 1 29 -' 2 doesn' t conform presently, we will deal with 3 that first and then we will go back to the '4 setback situation. 5 Okay. But do you want me to recess 6 and you want to reflect upon that? 7 MS. TRIVAS: Yes . I would like to 8 read the record. 9 MR. DINIZIO: . The letter that he just 10 handed you indicates that the building has 11 not been occupied for thirty years . 12 Is there proof that it has been 13 occupied within that time period? I mean, 14, can you show us that it has not lost its 15 nonconformity due to nonuse? 16 MS. TRIVAS: At what point is that? 17 THE CHAIRMAN: Two years . 18 MS. TRIVAS: I would have to check on 19 that . I couldn' t , at this point, tell you 20 if it has been occupied within the last two. 21 So if the only way this can go through is if 22 it has been occupied within the last 23 MR. DINIZIO: No. It certainly would t 24 help matters . 25 THE CHAIRMAN: No. Probably .that 1 30 I2 really is the case, but there has been some 3 mention that it has been used as a bunk 4 house. The question is to what extent and 5 for what period of time? g Remember, this application came 7 before us as Notice of Denial .from the 8 Building Inspector, denying this particular 9 addition. So we are not denying for any 10 particular conformity or nonconformity. 11 What we are reflecting here, really what we 12 should do is , it should be redenied for that 13 particular nonconforming issue. That would 14 be added to this application. It does not 15 mean we would readvertise it . 16 We really have two options . We can 17 close the hearing after you speak and 18 reflect upon the. letter from Mr. Thatcher 19 (phonetic spelling) , or we can recess the 20 hearing without a date and then add to the 21 file and readvertise for both the setback 22 and nonconforming. 23 MS. TRIVAS: I guess this is in 12 regards to the setback issue from the wet- 13 lands, and I just want to raise one issue. 14 I did speak with John Thatcher (phonetic 15 spelling) several days ago and he was look- 16 ing at the wrong site plan. I don' t know 17 if the Board members know about that . He 18 was. looking at the site plan for a different 19 project and he was concerned we were build- _ 20 ing towards the wetlands . As you know, we 21 are building away from the wetlands . 22 It seems he outlined three issues in 23 here; that it is close to the reservoir and —, 24 he makes recommendations no pesticides or i 25 herbicides be used and that 's in the 49 2 building. When I spoke with him several 3 days ago, he indicated he did not have a 4 problem with this as long as we were not 5 using pesticides or herbicides on the g property, and which we. are not . 7 It is a cottage in the woods and we 8 are keeping it as it is . He did not have a 9 problem with it . So, I am not sure. I 10 don' t understand what this setback issues 11 are involving. The septic is a minimum of 12 110 feet from the wetlands and the new 13 addition is . . . we are building away from 14 the existing house. 15 THE CHAIRMAN: I am just saying we 16 can' t address those issues until we address 17 the use. If you were to come to us and say, 18 "We just want a .storage building, " all 19 right, we could grant it tonight or deny it 20 tonight . But you want a specific use. You 21 want to use it for a habitable dwelling. 22 Regardless of its use, summer, 23 seasonable, or whatever, it is used whenever 24 the people are there or whenever they want 25 to use it. In propping myself up in that ,t 1 50 r 2 building, as best as I possibly could, and 3 avoiding the nails and so on and so forth, I 4 can tell you the building was not used for 5 thirty years . If it has, you are going to 6 have to tell me. I don' t know. 7 MS. TRIVAS: I heard rumors it had g been used. I am just saying in general I 9 couldn' t . . . you know . . . 10 THE CHAIRMAN: It is a situation that 11 we cannot deal with in reference to the ' 12 setback now. So we deal with . . . until we 13 deal with the use of it . What you are 14 going to do is come back, if you want to 15 address it in this form. We can recess this 16 hearing without a decision. 17 You can ask the Building Inspector 18 for another noti..ce of disapproval for the 19 conformity in this particular case.
