Matter of RALPH & PATRICIA PUGLIESE. Special Exception to
the Zoning Ordinance, Article III, Section 100-30B ( 14) , for a
Winery for the Production, Storage and the Retail Sale of Wine.
Property Location: 34876 Main Road, Cutchogue, County Tax Map
No. 1000, Section 097, Block 01, Lot 12.1.
WHEREAS, a public hearing was held and concluded on June
27, 1990 in the matter of the Application of RALPH & PATRICIA
PUGLIESE under Appeal No. 3831; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and-are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings. of fact:
1. The premises in question is located along the north
side of Main Road (Route 25) , Hamlet of Cutchogue, and is
identified on the Suffolk County Tax Maps as District 1000,
Section 097, Block 01, Lot 12.1.
2. This is an application for a Special Exception from
the Zoning Code Article III Section 100-30 B ( 14) , for a Winery
for the Production, Storage and the Retail Sale of Wine.

3. Article III, Section 100-30, The purpose of the
Agricultural-Conservation (A-C) District and the Low-Density
Residential R-80, R-120, R-2&0 and R-400 Districts is to
reasonably control, to the extent possible, prevent the
unnecessary loss of those currently open lands within the town
containing large and contiguous areas of prime agricultural
soils which are the basis for a significant portion of the
town' s economy and those areas with sensitive environmental
features, including aquifer recharge areas and bluffs. In
addition, these areas provide the open rural environment so
highly valued by year-round residents and those persons who
support the Town of Southold' s recreation, resort and second-
home economy. The economic, social and aesthetic benefits which
can be obtained for all citizens by limiting loss of such areas
are well documented and have inspired a host of governmental
programs designed, with varying degrees of success, to achieve
this result, For its part, the town is expending large sums of
money to protect existing farm acreage. At the same time, the
town has obligation to exercise its authority to reasonably
regulate the subdivision and development of this land to further
the same purposes while honoring the legitimate interests of
farmers and other farmland owners.
4. The property in question is improved with an existing
one family dwelling with a barn located towards the north of the
dwelling and a shed being relocated on the premises. This
parcel contains an area of 22+- acres in this A-C District.
5. In considering this application, the Board finds an
determines:
(a) that the use will not prevent the orderly and
reasonable use of adjacent properties or of properties in
adjacent use districts;
(b) that the Special Exception will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience and/or order of the Town;
(c) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the Special Exception, as applied conditionally noted
below.

RESOLVED, to GRANT a Special Exception in the matter of the
application of RALPH AND PATRICIA PUGLIESE as applied under
Appeal No. 3831, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the Winery/Barn only be used for the production, \
storage and the retail sales of wine and not be used for
habitual dwelling.
2. That the Winery/Barn not exceed 4,221+- sq. ft. in
size, that the portion of the barn being used for the Retail
Sale of the wine product not exceed 726+- sq. ft. and that the
storage area not exceed 3,500+- sq. ft.
3 . That the Parking area be designed by the Southold Town
Planning Board in the Site Plan evaluation.
4. That the buildings be located on this parcel as. shown
on the survey dated June 22, 1990 by R. Van Tuyl, showing a ten
(10) foot Right-of-Way leading to the rear of the property:

a. This application must be completely filled in by typewriter or in ink and submitted to the Building Inspector,with 3
sets of plans,accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

The Planning Board has reviewed your site plan application
and has the following comments:
1. The site plan map as submitted is not a parcel in an
approved subdivision. Your pending application for a
minor subdivision must be approved before the parcel
shown. on your site plan becomes a lot on an approved
map.
2. You should be aware that if your pending minor
subdivision is approved, it will separate the vineyard
from the winery. The Town Code says that the
production and sale of wine must be from grapes
primarily grown in the vineyards on which such winery
is located.

Dear Mr. and Mrs. Pugliese,
The above-referenced site plan is being reviewed by the
Planning Board. However, the fee that was submitted with the
application was not correct. The new fee can be computed as
follows:
"The application fee for a new site plan shall be one
hundred and fifty dollars ( $150. 00) per acre or any
fraction thereof, plus two and one-half cents ( 2.5)
per square foot of building area. "
Please submit a check for -the difference between the
one-hundred (1.00) dollars that was submitted under the old fee
schedule and the amount due under the new schedule. Upon receipt
of the remainder of the fee, the Board will proceed with your
application.
However, before proceeding, you should be aware that under
the zoning code, a winery is permitted "for the production and
sale of wine produced from grapes grown in the vineyards on
which such winery is located. " (Section 100-31 B. ( 13) . ) . At
this point in time, the property that you wish to use for the
winery is currently contiguous with the vineyard.
This property is also the subject of a minor subdivision
application before the Board. If you and your partner proceed
with that application, the proposed winery will become
physically separated from your vineyard, since your partner will
own the parcel that lies between the house (proposed winery
site) and the vineyard.
The end result is that your proposed winery will not be on
or contiguous to the vineyard, hence not in compliance with the
zoning code.
It is suggested that you consider the following options
before proceeding with your application. One is to subdivide
the property differently so that the portion with the house and
the proposed winery will be contiguous with the vineyard. The
second. is to place the winery on the vineyard portion of the
,property.
For your convenience, the application is being returned to
you in case you wish to make major changes. Please feel free to
contact the planning staff for more information or assistance.

We have been requested by Mr. & Mrs. Pugliese -to represent
them with respect to their application for a special exception to
permit a winery on their property which is also the subject of a
site plan application and subdivision application before the
Southold Town Planning Board.
We are in receipt of your letter dated March 31, 1989. in
which you advise the Puglieses to proceed with the Planning
Board on their site plan review process. However, by a letter
dated April 14, 1989 (copy enclosed) the Planning Board has
returned the site plan application to Mr. and Mrs. Pugliese on
the basis that the winery as proposed is not in compliance with
the zoning ordinance.
We respectfully request, therefore, that your board proceed
with its review of the special exception proposed winery on a
two-acre site. A determination is needed from your board on the
question of whether a winery can be located with a vineyard on a
two-acre parcel before the Planning Board will proceed with its
site plan review of the proposed winery.
-Your cooperation in permitting us to move forward before
your board would be appreciated. If there is additional

10 a 22-acre piece of property, by way of running
11 a 10-foot strip of land. The issue that comes
12 up is the question about the winery being
13 located on -the property, and working on grapes_
14 primarily grown on the premises. The Planning
15 Board suggested, and we go along with it, to
16 run a 10-foot strip clear up.

3 It is located on State Route . 25, as are many
4 of the other wineries in town. Mr. Pugliese
5 points out to me the speed zone in that area
6 is 35 miles an hour. So we are not going- to
7 have people speeding by.

The proposed winery is located behind
9 the residence, well off the property. Again,
10 as many of the wineries, it is an agricultural
11 building that will be converted, as were the
12 others, assuming the use is granted by the
13 Board for the winery. It has been used in the
14 past as trucking, in the more recent past, with
15 Mr. Pugliese' s grapes being grown to the north.
16 We think we have satisfied the criteria of the

17 Code that would properly locate it, with the

A. TIDAL WETLANDS:
(1) All lands generally covered or intermittently cov-
ered with,or which border on, tidal waters, or lands
lying beneath tidal waters, which at mean low tide
are covered by tidal watery to a maximum depth of
five (5) feet, including but not limited to banks,
bogs, salt marsh, swamps, meadowv, flats or other,
low lying lands subject to tidal action:
(2) All banks, bogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following.: salt flay, black
' grass, saltworts, sea lavender, tall cordgrass, high
bush, cattails, groundsel, marshmallow and low
march cordgrass; and/or
(3) All land immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-

B. FRESH WATER WETLANDS:
(1) "Freshwater wetlands"as defined in Article 24, Ti-

BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Chapter 100 (Zoning) of the Code of the Town of .Southold is hereby
amended as follows: .
1. Section 100-31 .B(13) is hereby amended to read as follows:
(13) Wineries for the production and sale of wine produced from
:}� grapes primarily grown in the vineyards on which such
winery is located.
2. Section 100-42.B is hereby amended by adding thereto a new
subsection (4) to read as follows:
f (4) Wineries as set forth and regulated by Section
100-31 .B(13) of the Agricultural Conservation Distri:,1.
3. Section 100-61 .B(1 ) is hereby amended to read as follows:
(1 ) Any special exception use set forth in and as regulated by
�+ Section 100-31 .B(1 ), (6). (7), (13) and (14) of the
Agricultural- Conservation District.
4. Section 100-71 .B is hereby amended by adding thereto a new
subsection (6) to read as follows:
` (6) Wineries
5. Section 100-81 .B(1 ) is hereby amended to read as follows:
(1 ) Any special exception use as set forth in and regulated by
Section 100-31 .B of the Agricultural Conservation
-1-J District, except wineries are not required to be in
connection with a vineyard.
6. Section 100-91.B is hereby amended by adding thereto a new
F� subsection (10) to read as follows:
(10) Wineries
7. Section 100-101_.B(1 ) is hereby amended to read as follows:
(1 ) Any special exception use as set forth in and regulated by
Section 100-31 .B(2) to (13), except wineries are not
required to be in connection with a vineyard.
8. Section 100-131 .B is hereby amended by adding thereto a new
subsection (14) to read as follows:
