REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (x ) A Variance to the Zoning Ordinance is requested for the reason that applicants premises both rear and south side of property is within 25 feet of Brushes Creek and does not consist of sufficient area to construct a garage. The only accessible and available space is in the front yard. The proposed site is the only one that would be located at more than 75 feet from Brushes Creek Form zs1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because it would deny applicant the use of any garage+ fac alihies. Applicants are making the premises their primary residence and require space for two automobiles. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because of the configuration and location of the premises on Brushes' Creek. It is bounded by water on the west and south (Brushes'. Creek) and by PEconic Bay Blvd and a private road on the north and east sides. 3. The Variance would observe the spirit of. the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because all houses have garages and my plan, copy of which is enclosed, would be in keeping with the character of the main house and the community. No. 3944. The Board Members have indicated that they are not permitted by law to vary, modify or .change its original decision without a new application. The above decision was limited to the request filed at that time and approved plans for an . accessory building different, structurally, than that you are. now proposing. The Board. Members have indicated, however, that if you file a new or amended application with a $150.00 filing _fee, your request will be entertained in the same manner of procedure as the first application (after ipublic notice, hearing, etc. ) . Very truly yours, GERARD P. GOEHRINGER CHAIRMAN By Linda Kowalski Enclosures (New Application Porms) MAR 291991 ANTHONY J. MERCORELLA L__ __ March 26, 1991 Mr. Gerard P. Goehringer, Chairman Board of Appeals, Town of Southold P. O. Box 1179 Southold, NY 11971 Re: Appl. No. 3944 (Variance) Dear Mr. Goehringer: I am a retired Justice of the Supreme Court, State of New York, and am planning to. permanently reside in Laurel. I refer to your determination of July 11, 1990 wherein the Board granted me a variance to construct a garage but limited the height to one story. May I respectfully request that you reconsider your decision and allow me to construct a two- story garage for the following reasons. 1. As my home is located on Brushes Creek, it did not allow me to construct a basement. Thus, I have absolutely no storage or crawl space. 2. My attic space is very limited (we have vaulted ceilings) and can only house air- conditioning equipment. 3 . My neighbor, James Murray, was issued ' " a permit and did construct a two-story struc- ture as per the enclosed plan. u,,N It .would be a hardship if I could not create a storage area for so much of my personal property that cannot be placed within my home. Variance to the Zoning 22 Ordinance, Article III, Section 100-33, as 23 disapproved, for permission to construct a two- 24 car accessory garage in the front yard area. 25 Proposed construction only permitted in the 1 25 2 required rear yard. Property Location: 2260 3 Peconic Bay Boulevard, Laurel, County Tax 4 Map No. 1000 , Section 145, Block 04, Lot 04. " 5 We ha-d : an application for a deck, 6 which I think is presently constructed -- 7 2 F approximately two meetings ago. Is there Z . 8 , somebody that would like to be heard? 9 MRS. MERCORELLA: Maria Mercorella. 10 We just finished. We. .are in the process of 11 reconstructing our home. Hopefully, y, my husband 12 is going to retire. We would like to build 13 a garage for our home but the house is situated 14 with water on both sides, as you can see. 15 Peconic Bay Boulevard bounds one side and N 16 W Edgemere Park Road (phonetic) bounds the o , 3 17 o other. So the front is, you know, not realljr a Z 18 on Peconic Bay Boulevard. It is on Edgemere, 0 9 - 19 but that is really not the question. 20 If we put it in the rear, it will be Z 21 cc near the lake and the Department of Environ- ° 22 mental Conservation won' t allow us to build 23 within 75 feet. If we put it in the rear, 24 Peconic Bay Boulevard is the front. If we put 25 it on Edgemere and the rear is Edgemere Road, 1 26 2 then Brushs Creek is the road and that also 3 poses a problem with the Department of Environs 4 mental Conservation. We have a little building 5 there, but we can't replace or put it on that 6 side. We have cesspools all around that. THo a Z 7 land near the lake slopes from the house, and Z 8 when we rebuilt the house the land was very 9 soft over there. So we had to put all 'fill 10 in, and that was the south side.. 11 THE CHAIRMAN: Is there any reason .why 12 you didn't think of attaching it: to the house, 13 on that side where the cutout is basically? 14 MRS. MERCORELLA: I have a bedroom 15 there and we have windows, and that is also N 16 - where the cesspool goes. W 0 3 17 o THE CHAIRMAN: What is the approximate Z Z 18 size of the garage? 0 19 MRS. MERCORELLA I really don' t remember s 20 it. Z CL 21 THE CHAIRMAN: Give us a call. with that. cc 22 You've got to tell us what the distance is, 23 from Edgemere Park and the distance from Peconic 24 Bay Boulevard, and you will tell us where you 25 . are going to have the doors open. Are they 1 27 2 going to open towards the road of Edgemere 3 Park -- or Edgemere Avenue? 4 MRS. MERCORELLA: No. No, towards the 5 house, probably, because we would like to put 6 a driveway in. So that you go into the 7 driveway, ;then into the garage. 8 THE CHAIRMAN: Take one of these copies 9 out of here and mark that up with the size 10 and where the garage doors are going to go, 11 and the distances between both, and give us 12 a call or bring it back in. If you call us 13 tomorrow, the phones may not be operating. We 14 are going to be across from the Supervisor' s 15 office. So you can always get them over there. 16 By Monday or Tuesday we should be operating. e z ' 0 17 MRS. MERCORELLA: You want the distance 0 18 from both roads. s 19 THE CHAIRMAN: I want the distances W _ m 20 from both roads and where the garage is going 0 21 to be put. I want to know if it is one story,. _ ; V _ W 22 or two stories, and what the approximate 23 height is. 24 MRS. NIERCORELLA: Just utilities that 6 we need for storage, because we have no base- ment there and we have no attic in the house 8 either. 9 THE CHAIRMAN: Thank you. 10 MRS. Page 2 - Appl. No. 3905 Matter of ANTHONY J. MERCORELLA Decision rendered February 15, 1990 3 . Article XXIII, Section 100-239. 4 B, All building located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back not less than seventy-five (75) feet from the bulkhead. 4.
