Present owner would like to expand garage as it is too small in depth and create a new kitchen, dining 'room and a screened in porch. Form ZB1 (Continue on other side) *f;yfW, ;i 1. STRICT APPLICATI OF. THE ORDINANCE would produr_ ,,fractical difficulties or unneces= sary HARDSHIP because according to the new R-40 Zoning requirements only '5 ' 0" could betlad'd' & V61 the existing residence in order to conform to the 50 ' required set-back. There is no other method for owner to pursue , and it would benimpractable and architecturally incorrect to construct . 2. The hardship created is UNIQUE and is not shared by; all properties alike in the immediate vicinity of this property and in this use district because adjoining properties have front yard set-backs less than the proposed front yard set-back of this property. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because existing residence in Gardiners Bay Estates encroach on front yard set-backs more than what is proposed for the property in question . The unique setting of the existing resicence would not • change the 'character of the neighborhood with the proposed encroachment on the front yard set-back. SAMBACH: Yes. Warren Sambach, 12 representing Mr. and Mrs. James Mark. 13 Under the original Zoning Code Residence 14 A, the front yard setback of 25 feet would be 15 required. The new Code R-40 requires a 50-foot N 16 setback and only five feet can be added to the w 0 17 o existing residence. a z 18 The proposed extension to the front of 0 s 19 the existing residence will have a 37-foot 20 setback, which would be more than the required z 21 0 under the old Code. The unique setting ofCO g 22 the original residence due to the elevation of U 23 the property and the existing landscaping will 24 not interfere with the proposed front yard,' 25 the proposed front extension will not change 1 14 2 the character of the neighborhood. There are 3 other residences in the neighborhood with less 4 front .yard setbacks than the property in 5 question, and they have not changed the 6 a character- of the neighborhood. U 7 2 On behalf of Mr. and Mrs. James Mark z 8 LL I respectfully ask consideration be given to 9 allow the proposed extension encroachment on 10 the front yard setback. 11 THE CHAIRMAN: On the proposed con- 12 struction, which protrudes 16 feet four inches 13 into the front yard area, is that a two-story 14 addition? 15 MR. You want to call it a two-story a Z 18 extension, it could be. 0 19 THE CHAIRMAN: So, in other words, what 20 Z it is is just pushing that screened-in porch 21 out above the garage and utilizing the present m 22 0 screened-in porch for year-round living pur-. 23 poses. 24 MR.
