ACTION OF THE BOARD OF APPEALS
Application for VALERIE KRAMER. Variance to the Zoning
Ordinance, Article XXVIII, Section 100-281 and Article XXIII,
Section 100-239.4B for permission to construct new dwelling
structure with an insufficient setback from the existing
bulkhead and from the easterly (front) property line along
Manhanset Avenue. Lot area of parcel is nonconforming in this
R-40 Zone District.. Location of Property: 730 Robinson Road
and 980 Manhasset Avenue, Greenport, NY; County Tax Map Parcel
No. 1000-34-5-20.
WHEREAS, a public hearing was held on November 1, 1990, at
which time all who desired to be heard were heard and their
testimony recorded;
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the. Board made the following findings of fact: .
1. The premises .in question is located at Greenport, Town
of Southold, with frontages along two streets: Manhanset Avenue
and Robinson. Road, and with frontage along a dredged canal. of
"Sterling Creek." The premises is more particularly identified
on the Suffolk County Tax Maps as District 1000, Section 34,
Block 5, . Lot 20.
2. The premises is presently vacant and is quite unique in
its size, shape and location. Its size is 13,350 sq. ft. ; its
dimensions are 30 ft. (along Robinson Road to the west) x 209.96
ft. in depth x 93.86+-. ft. along Manhanset Avenue. The parcel
has limited building area due to its frontage along the dredged
canal .(which is bulkheaded) .and two front yard areas.
3. By this application, appellant requests variances for ,
permission to locate a new dwelling structure with a setback of

'21+- feet to the bulkhead as initially submitted with this
appeal application.
4. On November 15, 1990, an alternative sketch was
submitted for board consideration, at the Board's request,
shifting the proposed house approximately 10-12 feet toward the
westerly property line in order to try to gain a greater
distance from the bulkhead. One foot was gained on the bulkhead
setback, but the side yard setback was reduced from the
originally proposal of 16-1/2 feet to 10 feet from the southerly
side property line. The front yard setbacks would be in
conformance with Section 100-244B as pertains to nonconforming
lots. Although the amount of relief requested by this
application is substantial in relation to the requirement, the
setbacks requested are not out of character with those generally
existing in the immediate neighborhood.
5. For the record it is noted that permits have been
issued by:- (a) the Southold Town Trustees on Septem-
ber 27, 1990; (b) Suffolk County Health Department under Permit
No. 88-SO-147; ."(c) N.Y:S. * Department of Environmental :.
Conservation by Permit No. 10-88-1400 dated January - 25, 1990.
6. In considering this application, the Board also finds
and determines:
-_- . (a) the nonconformities of the land and building in
question lend to the practical difficulties;
(b) the difficulties cannot be obviated by some
method feasible for appellant to-pursue other .than a variance;
1 -(c) _. -the alternative location of the dwelling as
approved will not change the essential character of this
residential community;
(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience or order of the
town;-:
(e) in- carefully considering the entire record and
all the above factors, as well as viewing the land and general
character of the neighborhood, it.is within the best interests
of justice to grant the variance, as conditionally noted below.
_Accordingly, on motion by Mr. Goehringer,. seconded by
Mr. Dinizio, it was
RESOLVED, to GRANT the relief requested under Appeal .
No. 3971 and shown on the "alternative sketch" for the location

of .a new dwelling structure, SUBJECT TO THE FOLLOWING:
1. That the setback from the existing bulkhead be not
closer than 22 feet;
2. That hay bales be placed prior to commencement of
foundation or other construction activities approximately 15
feet from the house towards the water and extending a distance
:of not less than 60 feet wide to the southerly and easterly
portions of the dwelling and remain until such time that an
adequate ground cover can be grown to prevent disturbance of the
land between the proposed dwelling structure and the existing
bulkhead and to prevent run-off into the canal. (There must be
also no disturbance to bulkhead tie backs) .
3. That the side yard setbacks be not less than ten (10)
feet on each side (and minimum total side yard setbacks at 20
feet) .
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, and
Dinizio. (Absent werq: Members Grigonis and Sawicki. ) This
resolution was unanimdusly adopted.

18 survey, most recent date September 5, 1989.
19 It appears it is a Van Tuyl survey
20 indicating a parcel of approximately 110
21 feet on Manhanset Avenue and quite irregular
. 22 in reference to size, with approximately 30
23 .. feet on Robinson Road and approximately 50
24 feet on the diagonal of Sterling Creek. I
25 have a copy of the Suffolk County Tax Map

4 Is there anybody that would like to
5 be heard, in behalf of the application?
6 MR. KRAMER: John Kramer. I am
7 Valerie's husband. I just wanted to add, we
8 bought the lot with the expectation it is
9 buildable. In the last 25 years all the
10 other lots of similar size have been getting
11 building permits. I think this is one of
12 only three vacant lots left in the
Cl13 subdivision shown.
14 THE CHAIRMAN: When did you buy the
15 lot, Mr. Kramer?
16 MR. KRAMER: I think it was 1980.
17 THE CHAIRMAN: 'And the nature of the
18 size of the house you are anticipating
19 putting on., I see it is 1, 962 square feet;
20 is that approximately the situation?
21 MR. KRAMER: Yes.
22 : THE CHAIRMAN: It is a two-story
23 house?
24 :MR. KRAMER: Approximately one and. a
25 ha 1 f.

2 THE CHAIRMAN: Is there any way of
3 shimmying in that house in reference to
4 width, so that we could get a little more
5 distance from the bulkheads?
6 MR. KRAMER: As you can tell from the
7 map, it is a triangular lot and -- there is
8 not very much face there. I don't think we
9 are doing anything that is -- you know, more
10 recently there was a house built right on
11 the -- not a house, but something right on
12 Manhanset, right on the water.
13 THE CHAIRMAN: That was the nature of -
14 a lawsuit before this Board.
15 MR. KRA14ER: If I go any further
16 back, then I am going onto Manhanset, which.
17 is a very busy street. I am saying the
118 triangle gets bigger towards Manhanset, and
19 I want to get it, towards Robinson. So I am
20 losing the apex in getting tighter towards
21 Robinson.
22 THE CHAIRMAN:. I wouldn't have any
23 objection to .that. I would rather see you
24 shim the side yards more if you've got to
25 Robinson. My concern is the 21 feet from

2 the existing bulkheads right now. In other
3 words, if you are holding -- you have a 10-
4 foot side yard at this particular time to
5 the north --
6 MR. KRAMER: Yes, it is approximately
7 to the north.
8 THE CHAIRMAN: Meaning closer to the
9 north side.
10 MR. KRAMER: Closer to the west.
11 Moving it down further may give us greater
12 distance for the diagonal , for the bulkhead.
13 Well , it is a tiny parcel and Manhanset is a
14 very busy road. I would like to stay as
15 much off that as possible.
16 THE CHAIRMAN: I couldn't agree with
17 you more.
18 MR. KRAMER: I don't think we are
19 going to do anything to the bulkhead. It is
20 new and it would be ecologically sound and
21 certainly aesthetic.
22 THE CHAIRMAN: Would you do me a
23 favor? Could you reduce the side yard and
' 24 give us a sketch, reducing the side yard on

25 the south side, which is the side closest to

2 the water and to the Tro an y (phonetic
3 spelling) property, to 12 feet, moving the
4 house closer to Robinson's Road and see if
5 we can get an idea what that would look like
6 in reference to distance from the bulkhead?
7 MR. KRAMER: How much closer would
8 you want that?
9 THE CHAIRMAN: Well , you are 16 1/2
10 now. Reduce it to 12 and bring the house
11 closer to Robinson Road. Maybe we could get
12 a better distance from the bulkhead, moving
13 it towards the west, sliding it all this
14 way.
15 We will leave the hearing open until
16 the special hearing we are having on the
17 15th and if you give it to us before then we
18 can take a look at it and we can run back
19 down. I will be there Saturday. I will
20 take more measurements when I go down there..
21 MR. KRAMER: Do you want me to stake
22 that out?
23 THE CHAIRMAN: It is not necessary.
24 We can get an idea.. I am just concerned
25 that we are trying to maximize as much

2 distance from the bulkhead, as much as we
3 possibly can.
4 MR. KRAMER: Okay. Thank you.

I am presently applying for a variance in order to get a
building permit on my property(sec 34 block 5 lot 20) , which has
been denied by the bui1ing department as I need to build 751from
the bulkhead in order to construct a home on this property. When
I bought the land in 1982 I bought it as a buildable lot.
I improved the lot in 1983 by bulkheading it wiht permission
from DEC and the trustees.
I presently have a DEC permit and Health Dept . permit and a
waiver from the trustees to construct a single family home on
this property, which I have enclosed copies of.
I am also enclosing a copy of a survey done in 1961 which
shows single and separate ownership of this property.
I am requesting your granting me a variance on this
property.

GENERAL CONDITIONS
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict c mpli-
ance with the ECL,all applicable regulations and the conditions specified herein or attached hereto.
1 The permittee shall file in the office of the appropriate regional permit administrator,or other office designated in the special conditions.a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify him/her promptly in writing of the completion of-the work.
2 The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL§71-0301 and SAPA§401(3).
S 1 he permittee has accepted expressly,by the execution of the application,the full legal responsibility for all damages,direct or indirect,of whatever nature,and by whomever
suffered,arising out of the project described herein and has,agreed to indemnify and save harmless the State from suits,actions,damages and costs of every name and descrip-
tion resulting from the said project.
4. The Department reserves the right to modify, suspend or revoke this permit at any time after due notice, and, if requested,hold a hearing when:
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found;or
b) the permit was obtained by misrepresentation or failure to disclose relevent facts;or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
5. The permittee is responsible for keeping the permit active by submitting a renewal application,including any forms,fees or supplemental information which may be required
by the Department,no later than 30 days(180 days for SPDES or Solid or Hazarduous Waste Management permits)prior to the expiration date.
IS This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights,title or interest in real or personal property held or vested in a person not a party to the permit.
7. The permittee is responsible for obtaining any other permits, approvals, lands,easements and rights-of-way which may be required for this project.
8 Issuance of this permit by the Department does not,unless expressly provided for,modify,supersede or rescind an order on consent or determination by the Corlmissioner
