Variance to .the Zoning Ordinance Article III A, Section 100-30 A.3, Article XXIV, Section 100-244 B, as disapproved, for permission to construct an addition to a one family dwelling. Proposed construction will have insufficient rear yard setback. Property Location: 155 (Pvt. Road #6) Birch Drive S, Laurel, County Tax Map No. 1000, Section 128, Block 4, Lot 4. WHEREAS, a public hearing was held and concluded on June 27, 1990 in the matter of the Application of MATTHEW KAR, under Appeal No. 3946; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the south side of Peconic Bay Boulevard, Hamlet of Laurel, and is identified on the Suffolk County Tax Map No. 1000, Section 128, Block 4, Lot 4. 2. This is an application for Variances from the Zoning Code Article III A, Section 100-30 A.3 , Article XXIV, Section 100-244 B, for permission to construct an addition to a one family dwelling. Proposed construction will have insufficient rear yard setback. 5 � Page 2 - Appl. No. 3946 Matter of MATTHEW KAR Decision rendered June 27, 1990 3. Article III A, Section 100-30 A.3, No building or premises shall be used and no building or part thereof shall be erected or altered in the Low-Density Residential R-40 District unless the same conforms to the requirements of the Bulk Schedule and of the Parking Schedule, with the same force and effect as if such regulations were set forth herein in full. Article XXIV, Section 100-244 B, A nonconforming lot separately owned and not adjoining any lot or land in the same ownership at the effective date of this Article and not adjoining any lot or land in the same ownership at any time subsequent to such date may be used, or a building or structure may be erected on such lot for use, in accordance with all the other applicable provisions of this chapter, provided that proof of such separate ownership is submitted in the form of an abstract of title showing the changes of title to said lot, which abstract shall be in the usual form, shall be certified by an attorney or a company regularly doing such work in Suffolk county or by a corporation duly licensed to examine and ensure title to real property in Suffolk County and shall contain a certification that no contiguous property was owned by an owner of the property involved since the date of any previously applicable Zoning Law. Such lot shall be granted relief for front side and rear yard dimensions as follows: 4. The subject premises is improved with a one (1) story framed dwelling with a screened porch towards the southern side of the existing dwelling. The proposed 16' X 37' addition will be towards the westerly side of the existing dwelling in this R-40 Zone District. 5. In considering this application, the Board finds and determines: (a) that the circumstances to this application are uniquely related to the premises and its established nonconformities; (b) that there is no other method for appellants to pursue; and placing the proposed addition on this property will require other variance relief; (c) that the area chosen for the addition is not unreasonable located; (d) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; Page 3 - Appl. No. 3946 Matter of MATTHEW KAR Decision rendered June 27, 1990 (e) that in carefully considering the record and all the above factors, the interest of justice will be served by granting the variance, as applied conditionally noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr.Dinizio, it was RESOLVED, to GRANT a Variance in the matter of the application of MATTHEW KAR as applied under Appeal No. 3946, . SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the 16' X 37' addition be located as indicated in on the survey submitted. 2. That the proposed addition not extend any closer than eleven (11+-) ft. to the rear property line and fifteen (15+-) ft. to closest side yard on north side of property. GRANT M.MEISELS 516-742-6365 Town of Southold Board of Appeals Main Road Southold, NY 11971 Re: 4900 Peconic Bay Blvd. District 1000 Section 128 Block 4 Lot 4 Dear Sirs: It has been brought to my attention that the adjacent property owners to my Southold premises are seeking a variance to permit them to construct a rear addition on their premises which would violate set back requirments. My wife and I are in full support of the variance request. Mr. and Mrs. Kar have transformed this residence from a down-trodden summer home which was kept up poorly in the last few years into the jewel of the neighborhood. Furthermore, they are the only year-round residents in our Homeowners Association. It is beneficial to us to have Matt and Gail living year round in this area. They keep an eye on everyone else' s property and contact us if there are any problems or unusual occurrences. The economics of real estate on -the North Fork, especially for property close to the Bay, make it extremely difficult for a young couple to purchase a home in this day and age. Matt and Gail have been able to do so but unfortunately their family has outgrown this Town of Southold May 18, 1990 Page 2 --------------------------------- home. Therefore, they are presented with a financial hardship of either improving. or finding another suitable residence. Obviously, improving their curent home is the more economic solution. This then creates a practical hardship in that the home is placed on the lot in such a manner that they cannot add an addition to the rear of the premises without violating setback requirements. It is my wish and I am sure the wish of everyone in our Homeowner' s Association that the Kar '"s be granted the relief they seek. The foundation inspection was 10 performed without any problem. 11 The next inspection was a tarring 12 inspection around the cinder blocks. At that 13 point the inspector stopped the work, saying 14 we did not have a sufficient rear setback. 15 THE CHAIRMAN: Rear yard setback? N N 16 MRS. KAR: I guess there was a discrepancy W O 0 17 as to where the front of the house was, because a Z 18 it is a unique neighborhood. We do have a o _ 9 19 water view, and most of the houses -- we s 20 consider that the front of our house. If that Z 21 was the case, then apparently we would have 22 made all the setback requirements. So the work 23 has been stopped and I have some PP pictures here. 24 There are 10 homes in the community going from 25 Peconic Bay Boulevard to the water. We are 1 18 2 kind of in the middle. 3 Even with the addition, we have got more 4 space in between our house to the other pro- s perty lines than any of the other houses. It 6 is just the way it works out. The houses Z have been there a long time. Some people are Z Z cc cc 8 within one foot of the property line rear yard. 9 I guess another point is that our rear 10 yard is next to an open lot. The person that 11 is behind us also owns the property behind us. 12 So she owns all the property going from the 13 boulevard to the bay. The people 13 behind us, they were given space by the Conklin 14 (phonetic) -- by our neighbor on the side. It 15 is a vacant lot. They set their fence on the N 16 property another foot, because their foundation w 0 17 is on the property line. So they gave them a Z 18 six or eight inches.
