Sawicki Southold, New York 11971 James Dinizio, Jr. BOARD OF APPEALS Fax (516) 765-1823 Telephone (516) 765-1809 TOWN OF SOUTHOLD Telephone (516) 765-1800 DELIBERATIONS/DECISION: ACTION OF THE BOARD OF APPEALS Appeal No. 3979: Application of THOMAS J. GORMAN. Variance to the Zoning Ordinance, Article III, Section 100-33 for approval of two accessory (storage) buildings in the front yard, as exist. The lot area of this parcel IS NONCONFORMING IN THIS R-80 Zone District. Location of Property: 18 Crescent Drive, Mattituck, NY; County Tax Map Parcel No. 1000-121-4-23. WHEREAS, a public hearing was held on November 1., 1990, at which time all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises ,in question is located along the west side of Crescent Drive (or Crescent Way) , Mattituck, and is identified on the Suffolk County Tax Maps as District 1000, Section 121, Block 4, Lot 23. Page 2 - Appl. No. 3979 Matter of THOMAS GORMAN Decision Rendered November 15, 1990 2. The subject premises contains a total lot area of approximately one-half acre and is improved with a two-story dwelling and three accessory structures as shown on the survey updated June 5, 1990 prepared by Young & Young, L.S. 1. The two accessory storage buildings which, are the subject of this appeal application are situated in the front yard area survey, and consist of a size of less than 120 sq. ft. each. (see survey for sizes and configurations) . 4. For the record it is noted that one of the accessory buildings was the subject of Board of Appeals action rendered July 1, 1976 under Appeal Application No. 2159 (Thomas Gorman) for a front yard location. 5. Article III, Section 100-33 (referred from Article III-A, Section 100-30A.4) of the Zoning Code allows accessory buildings to be located in the required rear yard area, but does not provide for accessory buildings to be located in any other yard area. Due to the nature of the property and the existing dwelling as located 35.6 feet from tie line along approximately highwater mark of Laurel Lake, the relief requested is not unreasonable. To place the accessory buildings in this limited rear yard area would not be. a better alternative. 6. In considering this application, the Board finds and determines: (a) that the circumstances of this application are uniquely related to the land; (b) that there is no other method for appellants to pursue; and placing the structure in any other location on the premises would require other variance relief; (c) that the area chosen for the accessory structure is not unreasonably located, being 145+- feet .from Crescent Drive and 145+- feet from the highwater mark (tie line) of Laurel Lake; (d) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (e) that precedents have been established in area waterfront communities for the same or similar placement of accessory buildings in a yard area different than the seaward areas of the dwellings; Page 3 - Appl. No. 3979 Matter of THOMAS GORMAN Decision Rendered November 15, 1990 (f) that in carefully considering the record and all the above factors, the interests of justice will be served by granting the variance, as applied and conditionally noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Dinizio, it was RESOLVED, to GRANT a Variance in the Matter of the Application of THOMAS J. GORMAN as applied under Appeal No. 397-Y for the placement of two accessory garagetstorage buildings in- the front yard area (as described in the above Findings) , SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the accessory buildings not be re-located; 2. That the accessory buildings not exceed one-story height (12 feet or less) ; 3 . That the subject accessory buildings not be used for - habitable, sleeping or business purposes (be used for storage purposes) ; 4. That there be no electrical or plumbing facilities placed within the building(s) ; 5. All other provisions of the Code as pertain to accessory uses and accessory buildings for this Zone District . Vote of the Board: Ayes: Messrs. Goehringer, Doyen, and Dinizio. (Members Sawicki and Grigonis were absent. ) This resolution was duly adopted. lk RECEIVED AND FILED BY GERARD P. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties "or unneees= sary HARDSHIP because the property is waterfront property, fronting on Laurel Lake, and the applicant uses what would commonly b'e Cr=ef1`err_6(1:J1 ' to as the back yard under the Zoning Ordinance of the Town of Southold as his front yard. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in..this use district because of the location of the dwelling unit in clos proximity to the Lake, the sheds would be unattractive in _the backyard as designated by the Zoning Ordinance, and is further unique because the property is in fact waterfront property.. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the structures themselves are permitted under the Zoning Ordinance, the garage for the premises is located in the front yard, and other properties in the area also have accessory structures in their front yards. The legal notice reads as follows: 6 (Legal notice read off record. ) 7 THE CHAIRMAN: I have a copy of the 8 survey, from Young and Young, dated June 5, 9 1990, indicating the nature of this 10 application which is a frame shed and 11 aluminum shed equally distanced between the 12 existing garage which is in the front yard 13 area and the two-story frame dwelling which 14 is on Laurel Lake. I have a copy of the 15 Suffolk County Tax Map indicating this and 16 surrounding properties in the area. 17 Is there somebody that would like to 18 be heard? 19 MR. KEVIN McLAUGHLIN: I am here in 20 behalf of Mr. Gorman. Basically, this is a 21 waterfront parcel , and so there is always a . 22 bit of discussion as to what is the front 23 yard and what is the rear yard. Both of 24 these sheds have been on this property, I 25 think one prior to the construction of the I 1 43 . Jacobs , Builder, Depot Lane , Cutchogue, New York) , Mattituck, New York for a var- iance in accordance with the Zoning Ordinance, Article III , Section 100-32 for permission to construct accessory building in front yard area. Location of property: Private Right-of- way, south side Sound Avenue, Mattituck, New York, bounded on the north by right-of-way; east by M. Smith; south by Laurel CLake; west by now or formerly Underwood. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers , and notice to the applicant. The Chairman also read statement from the Town Clerk that potifi.cation by certified mail had been made to: Mr. and Mrs . H. Herfurth; Marion E. Smith. THE CHAIRMAN: The application is accompanied by a survey dated April 5 , 1969 , by Young & Young, indicating that the applicant is owner of the lot including from Crescent Drive to Laurel Lake .- 55 ' on Crescent Drive and 148 ' on Laurel Lake. The house is located 2/3 of the way down towards Laurel Lake. The depth is 290 ' on the east and 65 ' on the west. . Is there anyone present who wishes to speak for .this application? WILLIAM JACOBS : As you can see , there is no other place the garage can be . There is a driveway coming down now that will be used. It is treed all the way around and in that area there is a clearing, so it is the best location. THE CHAIRMAN: We went down there . . . is this the proposed J-D.catiom? (referring to -map. ) Southold Town Board of Appeals -27- July 1 , 1976 WILLIAM JACOBS: Yes, Where it is cleared. (The Board and Mr. Jacobs referred to the map and there was further discussion of the location of the building. ) As I said before, there really is no other place to put it. THE CHAIRMAN: Nobody's cut down a tree here in 20 years, have they? WILLIAM JACOBS : Right. There' s brush on both sides going in_ THE CHAIRMAN: Is there anyone else who wishes to speak for this application? (There was no response. ) Does anyone wish to speak against this application? (There was no response. ) After investigation and inspection the Board finds that the applicant requests permission to construct accessory building in front yard area, Private right-of-way, south side Sound Avenue , Mattituck, New York. The Board finds that the applicant could not place the building anywhere but in the front yard area. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood„and will observe the spirit of the Ordinance. On motion by Mr. Hulse, seconded by Mr. Grigonis , it was RESOLVED, Thomas J. Gorman, Crescent Drive, Mattituck, New York be GRANTED permission to construct accessory building in front yard area, Crescent Drive, Mattituck, New York, as applied for subject to the following condition: The building will be located no closer than 20 ' to the western property line, no closer than 25 ' to the eastern property line, and no closer than 100 ' to the northern line.
