It is 25 Appeal Number 3933, in behalf of Pamela 1 4 C2 Valentine. Is she in the audience? 3 Could I ask you to use the mike, please? 4 At the least hearing we did open, I ' realize . 5 there was a problem with advertising .and 6 sending -- MS. VALENTINE: Pamela Valentine. It 8 was not advertised and we were not properly 9 notified. 10 THE CHAIRMAN: Would you give us any 11 statements that..you'would like for the file, 12 please? 13 MS. VALENTINE: Yes. I would like to 14 make one statement about the description of 15 our application for permission to build an 16 eight-foot fence. The application was actually e 0 17 for a six-foot fence, except for the limited 18 area on that front of Main Road and that was s 19 the only frontage where we applied for an W Z m 20 eight-foot fence. In fact, it may be a seven- o 21 foot fence in that limited area, but the fence u z W L 22 is going to be a six-foot fence if it is 23 approved. 24 THE CHAIRMAN: I wanted to have the 3 25 Town Attorney speak to the Board, because we do 1 5 2 not normally grant these. You are going to 3 have to tell us why you want it. This 4 definitelyis in the front yard area. It is 5 on the main road and you have got to explain 6 to us why you want it. MS. VALENTINE: Well, we want it: F S 1) Because of the increasing traffic from the 9 ferry which I think is pretty noticeable. There 10 was an article in the Suffolk Times just last } week. It is not only us, but a lot of people 12 are realizing that the traffic is just becoming 13 a problem. There is a lot. This lot in par- 14 ticular suffers because it is closer to the 15 ferry than -- it is not in Orient Town itself. 16 It is way outside of the town. We don' t have 0 g 17 any neighbors who would be able to see the 0 18 fence from their yard or their home. The 19 ferry traffic at that point isn' t broken up, 20 at all. We .just- have strings of traffic. 0 21 Quite frequently it is strings of commercial _ W 6 22 traffic. 23 THE CHAIRMAN: You presently have there 24 a split rail fence and there are bushes around 25 this split rail fence. 1 6 2 MS. VALENTINE: Yes . 3 THE CHAIRMAN: What are you doing? Are 4 you taking out the split rail fence and putting 5 in a stockade fence .in place of that? 6 MS. VALENTINE: The fence we propose 7 to put in would be in the exact location of 8 the split rail fence, which I believe is about 9 10 feet from the road, and the fence would be - 10 I really don' t know if stockade is the right - 11 it would be a tongue and groove cedar fence. 12 THE CHAIRMAN: You mean like a woven 13 fence. 14 MS. VALENTINE: Can I approach? 15 THE CHAIP24AN: Sure. That' s why we 16 asked you to come. ° 17 MS. VALENTINE: It would be kind of 18 like this. 0 __. 19 (Ms. Valentine providing the Chairman W o ° 20 with a picture) m o 21 (Discussion held off the record) u z W 22 THE CHAIRMAN: Thank you. Would you 23 be planting? First of all, I was over there 24 and we are familiar with the property. We `°` 25 had litigation on this before. 1 7 2 MS. VALENTINE: I am aware of that. 3 THE CHAIRMAN: I was unable to pick..up 4 any monuments to locate, to see where the 5 actual property line started. So that is the 6 reason for my question, in reference to place- 7 ment of where the split rail fence is, 8 because with the copy you can see it from there 9 It really _just takes the property line. and 10 draws a red line through it, and I do not 11 know the exact placement of where the fence 12 is going to be. mould you be planting anything 13 in front of this fence so as to shield it, 14 in any way? 15 MS. VALENTINE: I don' t believe we 16 would be planting anything in front of it. 0 17 There are flowers and low, very low plantings r 18 in front of the fence where it is. To the S 19 extent that -those could be saved, we would W m 20 save those and to the extent that we can save o 21 any plantings that are presently there, it V Z W 6 22 would remain. 23 THE CHAIRMAN: What is the purpose of 24 the eight-foot fence in front of the easterly 25 lot? 1 8 2 MS. VALENTINE: The seven or eight-foot 3 fence in front of the easterly lot is because 4 when we initially purchased the property we 5 were hoping to put a tennis court in that lot. 6 As it stands now, I don' t think either of us could go out. and play tennis because of the m . 8 traffic out there. If, in fact, we do decide 9 to put a tennis court, we would like a slightly 10 higher fence in that area: 1) For the 11 protection and because it wouldn' t be seen 12 from the house as much as you would see the 13 seven-foot area fence. If you are going to 14 deny our application because you object to 15 the eight-foot fence, what we would be willing 16 to do is listen to your proposal on limiting 0 f A 0 17 it to a six or seven-foot fence in that area. 0 18 THE CHAIRMAN: The fence is for the S - 19 sole purpose of keeping balls off the road, Z 20 evidently, or is it for the purpose of 0 21 shading the property from the viewer? u z W 6 . 22 MS. VALENTINE: I think it serves both 23 purposes, actually. 24 THE CHAIRMAN: I thank you very much. 25 I don' t have any further questions. We will 1 9 2 see if anything develops. I don' t know if 3 there is anybody else here in the audience 4 that is going to discuss g g your application, 5 but we thank you for coming in. 6 MS. VALENTINE: May I ask the same 7 question the gentleman before me did?- Do you 8 have any idea when the decision will be made? 9 THE CHAIRMAN: We would dearly like to 10 make all these decisions tonight. It depends 11 on how late we get with the remaining hearings 12 we have and, if not, we will definitely 13 make it within-:=. the next week or so. 14 MS. VALENTINE: Thank you. 15 THE CHAIRMAN: You' re welcome. 16 Is there .anybody else that would like 0 a 17 to speak in favor of this application? Anybody 0 18 that would like to speak against the appli- 0 19 cation? Any further comments from anyone, m 20 Board members? 0 21 MR. LARK: Richard Lark, Main Road, 14 Cutchogue. 15 I have read over the minutes of the 16 last hearing. I have one correction. I 0 17 stated the erosion that has taken place is 18 about a foot. a year on top of the bluff. That" s 19 is incorrect. It is about a foot every two m 20 years . I have remeasured that. I have been 0 21 up there since 1968 , and we just replaced the V ' Z W 22 deck on the association property. It was 23 about 10 years ago we had replaced it. The property in question contains a total area of 48 ,839 sq . ft. , total lot width (frontage ) of 242 . 10 feet , and average . lot depth of 220 . 07 feet. The subject premises (CONTINUED ON PAGES TWO AND THREE) DATED: October 12 , 1986 . CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Form ZB4 (VGV• lzi ol) Page 2 - Appeal No . 3477 Matter of WILLIAM-. The premises was conveyed to Katherine Heins by deeds : (a ) at Liber 5129 cp 89 dated January 31 , 1962 by W . C . Duvall , and . (b ) at ..Liber 5487 cp 487 dated 3 , 1964 by W . C . Duvall . 3. Appellants request area variances -of two proposed parcels in this pending .division of land as follows : (a ) the westerly portion of 27 ,742 sq . . ft . in area , .133 . 99 feet along the Main Road and 146 . 53 feet along the Old Main Road , and 193 . 62 feet in depth , retaining the two existing residential dwelling structures and accessory storage buildings ; (b ) the easterly portion of 21 ,097 sq . ft . in area , lot width of 108 . 11 feet and average lot depth of 242 . 11 feet . It appears that the nonconforming status of the existing dwellings will not be upgraded by this application , and a third dwelling structure is anticipated . 4. On October 11 , 1983 , under Appeal No . 3144 , appel - lants were denied area variances in a proposed .division of . this property for the reasons stated therein ; and on November 2 , 1983 , the Suffolk County Department of Planning disapproved same after review in accordance with the requirements of the Suffolk County Charter . To date , there has been no change concerning these actions . 5 . On October 16 , 1984 , the Suffolk County Department of Health issued approval .of construction after application by the appellant (s ) .for the .proposed new dwelling under #14-SO-208 . 6. On March 22 , 1985 , a building permit was issued by the Town Building Department after .application by the appellant ( s ) for a new single-..family residence under #13778Z , on a parcel of an area of 18 ,,984 sq . .ft . as shown by the building-permit application and survey. prepared October 12 , 1984 -by Roderick VanTuyl , P . C .. 7 . On November 29 , 1985 , Long Creek Homes was engaged by the applicants , who advanced to him a check of $11 , 983 -00 . 8. By early December 1985 , the lot had been cleared and a portion of, the footings installed . There has been no other construction to this date . 9. On or before December 24 , 1985 , Building Permit #13778Z was properly revoked by the Building Department . 10 . On February 28 , 1986 , this application for a variance was filed in compl.ete form with the Southold Town Clerk for processing by the Board of Appeals . 11 . It is further noted for the record that to .date no subdivision or set-off approvals have been rendered by the Southold Town Planning Board , concerning this pending division of. .land. 12 . In viewing the character of the area,, the board finds Page 3 - Appeal No . 3477 Matter of WILLIAM AND KATHERINE HEINS Decision .Render.ed .October 10 , ..1986 a majority of the parcels in the area contain an area of 40 , 500 sq . ft . or. more : (a ) to the north , a 3 . 3-acre parcel , (b) to the east , a 1 . 6-acre parcel , (c.) directly south along the south side of the. Main Road , an 18. 2-acre parcel , (d ) .west of the westerly side of the Old Main Road , a 1 . 9-acne parcel ; (e ) two lots east , a 40 , 500± sq . ft . parcel , and a 44 ,000± sq . ft . parcel . 13 . The percentage of the lot area required in the zoning code by this application is : (a ) 73% for the proposed easterly parcel , (b ) .6.5% for the proposed westerly parcel . In considering this application , the board also finds and determines that: (a ) the relief requested is .subs.tantial in relation to the requirements , . (b ) that the difficulties claimed are not sufficient to warrant a granting of the relief requested , (c ) the character of the immediate area would be adversely affected by the granting of the variance , (d) tKe variance will in turn cause a substantial effect on the safety , health , welfare , comfort , convenience , order of the town , (e ) in. view of the manner in which the difficulties arose , the interests of justice will best be served by .denyi.ng the variances applied . . Accordingly , on motion by Mr. Douglass , seconded by Mr . Sawicki , it was RESOLVED , that the relief requested under Appeal No . 3477 in the Matter of the Application of WILLIAM AND KATHERINE HEINS BE AND HEREBY IS DENIED. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (Mr. William Heins was present to .speak for the applica- tion) . THE .CHAIRMAN: There is a note in the file dated January 23 , 1975 : "To Whom It May Concern: There is no objection on my part regarding a building of Mr. Hein' s being too near the property line. The house is eleven feet from Old Main Road and, it is on an irregularly shaped lot. I think that the reason why the date of the original applica- tion for a Building Permit is 1969 and this violation that the Building Inspector found is dated 1975 is that in the meantime you were trying to buy some property. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) Southold Town Board of Appeals -5- January 30, 1975 After investigation and inspection the Board finds that applicant requests permission to maintain existing addition to garage located on Route . 25 and Old Main Road, Orient, New York. The findings of the Board are that applicant is the owner of a building which pre-existed the Zoning Ordinance and which is on an irregularly shaped lot. The Board feels that the addition will not change the character of the neighborhood, and agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared 'by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood; and .will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED, William -Heins, Main- Road, Orient, New York, be GRANTED permission to maintain existing addition to garage which is situated on property located at Route 25 and Old Main Road, Orient, New York, as applied for. Main Road, Orient, NY for a Variance to the Zoning Ordinance, Article III, Sections 100-30 and 100-31, Bulk Schedule, for permission to reseparate two parcels having insufficient area and/or width, located at the north side of Main Road, Orient, NY; more particularly identified as County Tax Map Parcel Nos. 1000-19-2-5 & 6. The public hearing on this application was held on September 29, 1983, at which time the hearing was declared closed pending deliberations. The board made the following findings and determination: This is a variance from Article III, Sections 100-30 and 100-31, C Bulk Area Schedule, which requires a minimum of 80, 000 square feet for each parcel of land and a minimum lot width of 175 feet. The applicant presently owns a parcel of land containing approximately 52,000 square feet in area. Applicant proposes a division of this parcel into two lots, the most westerly parcel would contain an area of approximately .33,000 square feet and the easterly parcel would contain an area of approximately 19,200 square feet with 88-foot frontage along the Main (State) Road. Existing at the northwesterly section of the subject premises is a lZ-story, one-family, frame dwelling with accessory garage. For the record it is noted that at a meeting held August 17, 19'83, the Southold Town Planning Board disapproved the project as proposed. The public hearing on this application before the Zoning Board was held on September 29, 1983, and the board is familiar with the state- ments and circumstances herein. The members of this board have per- sonally visited the site and are also familiar with the property as well as the surrounding neighborhood. A majority of the parcels in the immediate neighborhood contain an area of 40, 500 square feet, or —more. In considering this appeal, the board determines: (1) that the practical difficulties are not sufficient to warrant the granting of this application; (2) that the variance request is substantial in relation to the requirements of the zoning code; (3) that the circumstances . are not unique, and that a precedent may be set if granted, for. other parcels in the neighborhood; (4) that the relief requested will not be in harmony with or promote the general purposes of zoning; (5) that the interests of justice will not be served by allowing the. variance applied for. Now, therefore, on motin by Mr. Douglass, seconded by Messrs.. Grigonis and Goehringer, it was Southold Town Board of Appeals -6- October 11, 1983 Special Meeting (Appeal No. 3144 - KATHERINE 'HEINS, 'continued: ) - F RESOLVED, that Appeal No. 3144, application of KATHERINE HEINS'' for approval of insufficient area and width of two proposed parcels, BE AND HEREBY IS DENIED.
