GOEHRINGER, CHAIRMAN CHARLES GRIGONIS, JR. SERGE DOYEN, JR. JOSEPH H. SAWICKI JAMES DINIZIO, JR. ACTION OF THE BOARD OF APPEALS Appl. No. 3904 Matter of HARRIET SPILMAN. Variance to the Zoning Ordinance, Article XXIII, Section 100-239. 4 B, for permission to , construct addition to existing dwelling, proposed construction will be less than 75 ft. from the bulkhead. Property Location: 1730 West Creek Avenue, Cutchogue, County Tax Map No. 1000, Section 110, Block 1, Lot 7.3 . WHEREAS, a public hearing was held and concluded on February 1, 1990 in the matter of the Application of HARRIET SPILMAN under Appeal No. 3904; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the west side of West Creek Avenue, Town of Cutchogue, and is identified on the Suffolk. County Tax Maps as District 1000, Section 110, Block 1, Lot 7 .3. 2. This is an application for Variances from the Zoning Code Article XXIII, Section 100-239. 4 B, for permission to construct addition to existing dwelling, proposed construction will be -less than 75 ft. from the bulkhead. Page 2 - Appl. No. 3904 Matter of HARRIET SPILMAN Decision rendered February 15, 1990 3 . Article XXIII, Section 100-239.4 B, All building located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back not less than seventy-five (75) feet from the bulkhead. 4. In considering this application, the Board finds and determines: (a) that the circumstances of this application are uniquely related to the premises and its established nonconformities; (b) that there is no other method for appellants to pursue; and placing the proposed addition in any other location on the premises will require other variance relief; (c) that the area chosen for the addition is not unreasonably located; (d) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (e) that in carefully considering the record and all the above factors, the interests of justice will be served by granting the variance, as applied conditionally noted below. Accordingly, on motion by Mr. Dinizio, Seconded by Mr. Grigonis, it was i jl Page 3 - Appl. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( x) A Variance to the Zoning Ordinance ( ) Mrs. Spilman is requested for the reason that t9 would like to add two additions to the house. The house is approxiinat'Ki 861.12 square feet. One extension is 25' X 6.6' (165 s.giiare feet) and the other extension is 20' X 6.2' (124 square feet) . This represents a 33.56% increase in the livable area of the dwelling. Form ZBl (Continue an other side) )1, REASON FOR APPEAL Continued W 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the existing dwelling does not provide suitable shelter or room for year round, full time use. The house is located approximately 18 feet from the street. Thus, the front yard is too small for additions. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because many of the other dwellings along West Creek have bulkheads, but the bulkhead on this property surrounds the dwelling on three sides. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because many- of the -residences along West Creek, drive were seasonal dwellings which were enlarged and. converted t-o year round use. Property loca- te 3 tion: 1730 West Creek. Avenue, Cutchogue, .i 4 County Tax Map Number 1000 , Section 110 , 5 Block 1 , Lot 7 . 3 . 6 I 've PY a of co of the survey, most g 7 recent dated January 2 , 1990 , produced by 8 Robert Van Tuyl , P.C. , indicating a one and 9 one half story frame house on West Creek i 10 Avenue, in Cutchogue. The house is 11 basically bulkheaded on all sides, except 12 for the road beside the bulkhead. The 13 nature of this application is a proposed 14 addition. In this particular case it would 15 be the side yard of the house, which would 16 be towards the west and on the south side of 17 the house. The west side would be approxi- 18 mately 11 feet at its closest point; on the 19 south side would be about 11 1/2 feet at its 20 closest point . I have a copy of the Suffolk 21 County Tax Map indicating this and 22 surrounding properties in the area and per 23 DEC permits . Is there anybody that would 24 like to be heard on this application? 25 MS. HAGEN: Karen Hagen, P.O. Box - k ., 13 # •? i 1424, Main Road, Mattituck, New York. 3 ! I think the hardship is clear in this case, as you said, because it is surrounded on the three sides by the bulkheads and also ti J because of its proximity to the street . The legal notice reads as follows : 0 21 Application Number 3904, Harriet Spilman, 0 22 variance to the Zoning Ordinance, Article 23 XXIII , Section 100-239. 4 B, for permission 24 to construct addition to existing dwelling. 25 Proposed construction will be less than ,►_ 1 -12 2 75 feet from the bulkhead. Property loca- 3 tion: 1730 West Creek Avenue, Cutchogue, 4 County Tax Map Number 1000 , Section 110, 5 Block 1, Lot 7 . 3. 6 I 've got a copy of the survey, most 7 recent dated January 2 , 1990 , produced by 8 Robert Van Tuyl , P.C. , indicating a one and 9 one half story frame house on West Creek 10 Avenue, in Cutchogue. The house is 11 basically bulkheaded on all sides, except f 12 for the road beside the bulkhead. The 13 nature of this application is a proposed 1. 14 addition. In this particular case it would 15 be the side yard of the house, which would 16 be towards the west and on the south side of 0 0 17 the house. The west side would be approxi- 0 18 mately 11 feet at its closest point; on the s . 19 south side would be about 11 1/2 feet at its W m 20 closest point . I have a copy of the Suffolk o 21 County Tax Map indicating this and u z W 22 surrounding properties in the area and per 23 DEC permits .
