ACTION OF THE BOARD
Appl. No. 40.56.
Upon application of CONSTANTINOS MARKOTSIS. Variance to the
Zoning Ordinance, Article XXIII, Section 100-239. 4B for
permission to approval of screen-enclosed deck addition at less
than the required 75 feet from the bulkhead. The subject
premises is substandard in size and is located in the R-40 Zone
District. Location of Property: Corner of the south side of
Main Bayview Road and the east side of Williamsburg Drive
(private road) , Southold, NY; County Tax Map Parcel No.
1000-78-5-12.
WHEREAS, a public hearing was held on September 26, 1991,
and at said hearing, all those who desired to be heard were heard
and their testimony recorded;
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application;
WHEREAS, Board Members have personally viewed and are
familiar with the premises in. question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. By this application, appellant seeks a variance under
Article XXIII, Section 100-239. 4B for a 30' wide by 1614" deep
screened-in deck addition at the rear (southwest) portion of the
existing single-family dwelling, which, inclusive of wooden
steps, is requested to be set back 7112" from the existing
bulkhead at its closest points (see project plan prepared by
Proper-T Services dated August 14, 1991) .
2. The subject premises in question is identified on the
Suffolk County Tax Maps as District 1000, Section 78, Block 5,
Lot 12, has a frontage of 160 feet along the south side of Main
Bayview Road and 180 feet along the easterly side of Williamsburg
(private) Road. This parcel contains a total lot area of
approximately 28,000 square feet.

3 . The setback distances of the existing dwelling are shown
to be 19. 5 feet from the westerly (front) property line, 17.7
feet from the southerly (side) property line, 78 feet to the
bulkhead/ramp area . at its closest point, and 92+- feet to the
northerly (front) property line. No accessory storage buildings
exist at the premises currently.
4. Article XXIII, Section 100-239. 4B of the Zoning Code
requires all buildings and structures located on lots upon which
a bulkhead, concrete wall, rip-rap or similar structure exists
and which is adjacent to tidal water bodies other than the Long
Island Sound to be set back not less than seventy-five (75) feet
from the bulkhead.
5. The amount of relief requested by this application is a
variance of one foot for the enclosed porch, and four feet for
the step area.
6. In considering this application, the Board finds:
(a) the relief as requested is not substantial in
relation to the requirements;
(b) the relief as requested is not the minimum
necessary to afford relief;
(c) the relief as alternatively granted will not alter
the essential character of the neighborhood;
(d) the practical difficulties are uniquely related to
the property and are not personal;
(e) the relief, as alternatively granted, will not in
turn be adverse to the safety, health, welfare, comfort,
convenience or order of the town, or be adverse to neighboring
properties;
(f) in view of all the above, the interests of justice
will be served by granting the relief as alternatively and
conditionally noted below.
Accordingly, on motion by Mr. Doyen, . seconded by
Mr. Grigonis, it was
RESOLVED, to GRANT relief for a screened-in deck (porch)
addition at the rear of the existing dwelling, SUBJECT 'TO THE
FOLLOWING CONDITIONS:
1. That the construction shall be not closer than 74 feet
(as applied) , at its closest distance to the bulkhead;
2. That the porch (screened-iri deck) addition remain
unheated, as applied;
3 . That the porch (screened-in deck) addition not be
permanently enclosed (i.e. glass or similar enclosure, although
plexiglass will be permitted) ;
4. That the step area be relocated to the northerly or
southerly ends of the deck (rather than on the seaward portion) .
(Any structural enlargement or expansion within the 75 ft.
setback from the bulkhead, or other nonconforming yard areas,
will require further application to and approval by this Board. )
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Grigonis, Dinizio and Villa. This resolution was duly
adopted.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, the following matters
will be held for public hearings before the SOUTHOLD TOWN BOARD
OF APPEALS at the Southold Town Hall, 53095 Main Road, Southold,
NY 11971, on THURSDAY, SEPTEMBER 26, 1991, commencing at the
times specified below:
(1) 7: 30 p.m. Appl. No. 4054 - WILLIAM A. HANDS, JR.
Variance to the Zoning Ordinance, Article X, Section 100-102
(and Article XXIV, Section 100-242A) for permission to' construct
addition at the rear of existing principal building with a
reduced easterly side yard setback and.with an increase of the
degree of setback nonconformance. Zone District: General

the Zoning Ordinance, Article XXIII, Section 100-239. 4B for
permission to construct deck and step area within 75 feet of the
bulkhead along Pipes Cove. The subject premises is referred to
as (combined) Lot Numbers 24 & 25 and is substandard in size.

be applied for in the future to locate a dwelling which shall
not be closer than 45 feet as restricted by Appeal No. 3703
rendered June 2, 1988. Total lot area is substandard at 22,137

substandard in size and is located in the R-80 Zone District.
Location of Property: along the westerly side of a private
right-of-way known as Deidrick Lane, Orient, NY; County Tax Map
No. 1000-18-03-27.

is requested for the reason that the addition of a screen-enclosed deck to the
_ residence existing on the property will provide the opportunity for
greatly enhanced enjoyment -and use of the property by the owner, his
family, and their guests.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE ,would produce practical difficulties or unneces-
sory HARDSHIP because it would preclude the construction of the deck
in the desired size and location,-,since
yminimum setback requirements
behind a bulkhead could not be met.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the configuration of the prop-
erty and its topographical characteristics, together with the size,
configuration, and locationof existing structures on the property,
and the design and floor plan of the house suggest the proposed deck
design and construction as the most practical method of insuring the
. best' use' of. the property. In addition, the only neighboring house,
on the lot to the south, has a setback behind the bulkhead of approx-
- imately 50'
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE,
CHARACTER OF THE DISTRICT because the addition of the deck is in keeping
with the customary uses of property in the Town and in the immediate
area, both from the standpoint of actual use and from the standpoint
of design, construction, and aesthetic appeal. A neighboring house
projects further seaward than the proposed deck.

implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been submitted
with the subject application indicating that no significant
adverse environmental effects are likely to occur should be
project be implemented as planned.
It is determined that this Board' s area of jurisdiction
concerning setback, area or lot-line variances determines this
application to fall under the established list of Type II
Actions. Pursuant to Section 617 .2jj , this Department is
excluded as an involved agency.
This determination shall not, however, affect any other
agency' s interest as an involved agency under SEQRA 617 .233 .

CHAIRMAN: I have copy of sketch of original plan which shows the house that
has been there for many, many years with really no difference in either
situation of the special permits and I have a copy of the Suffolk County
Tax Map indicating this and surrounding properties in the area. Michael ,
would you like to say something for the record?
MICHAEL HERBERT: Nothing other than to say that the apartments worked out
very well. I thank you.
CHAIRMAN: No complaints from the neighbors.
MICHAEL HERBERT: None whatsoever.
CHAIRMAN: I thank you. Anyone else who would like to speak in favor of this
apllication. Anyone against the application. I make a motion withdrawing the
original Bed and Breakfast application.

CHAIRMAN: The plan from Proper T Services by James E. Fitzgerald, Jr. , August 14,
1991 indicating a one story frame house approximately 20' from the right of.
way which is Williamsburg Road and the nature of this application is a completed
or nearly completed proposed covered deck which lacks the roof area but the .
timbers are up. When I s.ay the roof area I am referring to the fiberglass roofing
except for one or two pieces which is at its closest point 71'2" to the steps
or 74'2" to the existing, it appears to be property line. I apologize, the
bulkhead and I have a copy of the Suffolk-' County Tax Map indicating this and
surrounding properties in the area. Mr. Fitzgerald. HOw are you tonight sir.

MR. FITZGERALD: I don't have anythiog to add to that except that it was there
already and Mr. Markotsis built -.it in good faith and we're to fix it. That' s
the situation right now.
CHAIRMAN: So we are in this particular case, notwith standing the steps, we
are about 10" outside of the variance area for the. deck itself and some 3+ feet
if'we included the steps.
MR. FITZGERALD: Yes, so the steps could be moved.
CHAIRMAN: I would assume that in dealing with this application I' ll make
a motion that the deck not be any furthe.r enclosed other than what is there
in the roofing .
MR. FITZGERALD: To finish the roof. Nothing solid.
CHAIRMAN: That's fair. Making it a habitible portion of the house. We thank you
sir. Anyone else who would like to speak 'in favor of this application. Against
the application. Hearing no further comment, I make a motion to close the
hearing reserving decision until later.

CHAIRMAN: This was recessed from March 22, 1991 and is in behalf of the
applicants being represented by Ward Associates. I see that gentleman in the
rear of the room who appears to be from Ward Associates. Would you like to
say something concerning this proposal sir.
LARRY FEELEY: I'm from Ward Associates on behalf of the owners. We have
stated in the letter of August 29 and-I believe you have a copy— Basically
what the owner's position is on behalf of this application is that they believe
the lot coverage being 2% of the lot over the allowable is fairly minimal. in
magnitude and they felt the use being tw.o family. which has a CO prior to ,
I assume the code change,would permit that use and also that the use being
a two family immediately adjacent to the motel unitVas a fairly reasonable
transition between the motel and the single family dwellings in the area. As
a concession the owners are willing to put a covenant restriction on the water
side parcel in order to keep that commonly open as to public access as to the
view of the Sound. It would not be permitted to be built on other restriction,
that the owners would be willing to place on that. Other than that, I think
that is about all I can say. At the last hearing, I apologize, we were not
able to come to, the concern was raised regarding the sanitary system which

is seeking to rectify that violation by the nature of this
application , I assume .
MEMBER : It seems you got the cart before the horse .
BOARD ASSISTANT L . KOWALSKI : When was it built?
CHAIRMAN : Do we have any idea when it was built.
MR. BOYD : It was begun this Spring some time . I don ' t know
exactly when the violation notice was put on it. . I agree it is
the cart before the horse. I apologize for it but I wasn ' t there .
I had nothing to do with that aspect. Certainly if he came to
me I would have suggested it be done the other way around. Again ,
if clients always follow things I told them , I would be out of
business pretty soon .

Attached are the documents prepared in support of the appli-
cation for a variance and appeal from the decision of the
Building Inspector for the construction of a covered screen-
enclosed deck less than 75 feet behind a bulkhead on the
property of Constantinos Markotsis located on Williamsburg
Road in Southold.
Proper-T Services represents Mr. Markotsis in this matter, and
a letter of authorization is attached.
Please note that a Certificate of Occupancy has never been
issued for the residence. If necessary, we will pursue this
with the Building Department at your request.

Mr. Bergen acting Chairman in absence of Mr. Gillespie opened the
meeting by instructing sect'. to read legal notice and affidavit from
the local news paper in connection with appeal #` 46.
PUBLIC HF,ARIIIG; a-peal # 46, application of Alfred Goldsmith,
agent for Wm. Berg, Bay View Road , Southold, 11.Y. for a variance to
the Zoning Ordinance, Article III, Section 304. Mr. Bergen read the
appeal and the Loard studied said a.polication.
Chairman :asked for those who wished to speak "for" the application
Mr. Goldsmith spoke for tr)e application, no one spoke against it.
The Board unanimously granted the appeal. See filed minutes
for details.
Minutes of the Jan. 23rd meeting were read and on motion by
-1r. Roaeaberg, seconded by i1r. Gregonis and carried were approved.
Meeting adjourned 6: 50 PM.
