Variance to the Zoning Ordinance, Article III, Section 100-33 for permission to locate accessory garage structure in an area other than the required rear yard. Premises is nonconforming as to lot area in this R-40 Zone District and fronts along Jockey Creek. Location of Property: 2725 Wells Road.,- Southold, NY; County Tax Map Designation 1000-70-4-16. WHEREAS, public hearings were held on February 22, 1991 and March 22, 1991, at which time all those who desired to be heard were heard, and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the easterly side of Wells Avenue (also referred to as Wells Drive on the town assessment records) , having a road frontage of 91. 82 feet, having a frontage along Jockey Creek of approximately 115 feet (along a tie line) , and having a total lot area of 23,9665 sq. ft. 2. The subject premises is improved with a single-family dwelling structure situated 67. 4 feet from the front property line along Wells Avenue and 65 feet from the rear property line (at its closest points) . Building Permit #19569 dated Decem- ber 10, 1.990 is pending at this time for the reconstruction and alteration of the subject dwelling structure. Page 2 Matter of THOMAS M. KELLY AND NANCY IANNICELLI Decision Rendered April 10, 1991 3 . Article III, Section 100-33A of the Zoning Code provides that: . . .accessory buildings and. structures or other accessory uses shall be located in the required rear yard. . . . 4. In this appeal, the applicant requests a variance to place a proposed free-standing accessory garage to be located in specifically one of two locations: (a) either in the front yard area at 14.1 feet from the westerly property line and 40 feet from Wells Avenue, or (b) in the front yard area at 20 feet from the front property line along Wells Avenue and 15 feet from the westerly property line: 5. During the process, it was suggested by the Board to locate the accessory building in an area closer to the dwelling near the north end of the (existing) driveway shown on the sketch. 6. In response, two reasons for limiting the request to two specific locations are, in appellant' s claim, due to the architecture of the building and the curvature of Wells Avenue along the front yard line. 7. Concerns were addressed during the hearing process from the westerly landowners adjacent to the subject house, and suggestions were again made to locate the accessory building toward the existing driveway area, either near the dwelling or in that general area. 8. The agent for the applicant and the applicants would not agree before concluding the record to any other alternatives, except as applied. 9. It is the opinion of the Board Members that the areas chosen are not most suitable, under the circumstances, and find that there are other areas which may be less offensive in general. 10. Since the Board has not been authorized to amend. the application for alternative relief, the ,application is denied in its entirety, without prejudice to the filing of another formal application with proper notice and under the same procedures as the filing of this application. Also in considering this application, the Board finds: (a) that the relief requested is substantial in relation to the requirements; (b) that the reasons furnished by appellants are not sufficient to warrant a grant of the variance requested; (c) there are alternative locations for appellant to pursue which would be more feasible, under the circumstances; (d) the locations requested are not within the character of the immediate area; (e) the practical diffi- culties claimed are self-created since the dwelling is and has been under reconstruction and alterations without plans for a full garage addition, which would have been an alternative to the relief requested for a separate accessory structure more than 15 feet distant from the dwelling. ACCORDINGLY, on motion by Mr. Dinizio, seconded by Mr. Villa, it was RESOLVED, that the relief requested under Appl. No. 4005 in. the Matter of the Application filed by Peix & Crawford Architecture in behalf of THOMAS KELLY and NANCY IANNICELLI, be and hereby is DENIED IN ITS ENTIRETY, without prejudice to a separate future application. The second proposal was significantly different from the first. It positioned the garage not 15', but approximately 60' away from the house. This move sub- stantially widened the views available to the Wickbolts to the South into and across the Kelly/Iannicelli's property. 2. In response to;the Wickbolt's original objection,:the Chairman of your board suggested tliat the rules for set backs could be=relaxed. . Specifically I under- stood the Chairman to say that the normal 40' set-back could be reduced to 20', and the side yard set back could be made as narrow as 10'., The second pro- posed location stayed within the Chairman's guidelines. 3. There are a good number of neighboring houses on Wells Road that have free standing garages located in their front yards. Building the garage in the rear yard would lower the property values. 4. The original placement of the garage was in full compliance with the 40' front yard and other side yard set backs. It was only in consideration of the Wickbolt's complaint and the Board's relaxation of these rules that the second position was proposed. 5. Kelly/Iannicelli applied for and were granted on 10 December 1990 a Build- ing Permit (# 19569 Z) to "construct an attached garage addition, deck addition and alterations to an existing one family" house. 6. Placing the garage in the front yard, close to the South property line will create a dangerous condition for the driveway access since it will be particularly close to a major curve [around which drivers commonly speed] in Wells Road. Additionally, such a position will not maximize the Wickbolt's view, but instead will mean that they will look at the front of the garage from their house. The second position proposed by Kelly/Iannicelli permits landscaping at the North side of the garage. This could soften the Wickbolt's view of the structure. I also would like to point out that the second position proposed by the Kelly/Iannicelli's responded directly to the Board's expressed preference for the garage doors not to face the street. In their letter they . have indicated a continuing objection to our request for a variance to the zoning code for the construction of a detached garage on our property, next to theirs on Wells Avenue. They have raised seven points to which our architect, Doug Peix, has responded per the enclosure. However, we would initially like to provide a general response. At the two public Board meetings and in conversations with Mr. and Mrs. Wickboldt, we, as good neighbors, have made every effort to treat their concerns seriously. We believe that if our garage were to be built with an attachment to the house, for which we currently have a permit, the Wickboldts' will have the most restricted view of all the options discussed. Our original request for a variance opened up a space of some 10-15 feet between the house and garage and was within all of the zoning setback requirements. The second and current proposal, in response to our neighbors' stated concerns and the Board's suggestions, increases the open space by some 300% to about 60 feet. Finally, we examined more than 5 different placements of the garage. In the end, we felt that the current proposal was a win-win solution. It opened up a significant amount of space for the Wickboldts ' to look across our property and gave us the safest driveway location. This safety issue is a real concern. Our lot fronts on a very sharp curve in the road. Because many drivers underestimate the severity of this curve, extra caution is necessary entering and exiting the driveway by car. In fact the safest entry and exit point is from the southern edge of the property. Of even more importance, we do not wish to expose our six-year old son, who will be riding his bicycle in and out of the driveway, to avoidable danger. We therefore prefer a driveway location that is more rather than less safe, i.e. the driveway drawn on the current prposal In conclusion, we ask that the Board grant. us the requested variance. 'I .- They have not taken our feeling or objections to the first proposal to heart. Now he claims hardship and says he cannot attach the garage to the house as should have been in his original plan. 6. - We feel that strict adherence to Village codes , ordi- nances and guidelines , which were written to maintain then character of Southold , should be enforced as close as possible . 7. - And lastly, we understand they need a garage--and so we do not object to a garage built to the south side and as close as possible to their new home . We would rather not go quite that close so this is a suggestion of 15 feet. The difference that this scheme has, for the neighbor, who' s kind of where you are looking, is that previously there was a gap of about 15' between the garage and the house and now there is a gap of over 55 to 60 feet. We've also tried to respond to your preference of not having. the garage doors face the street. So they face, they turn around this way. MR VILLA: You didn't reduce the size at all or the height? MR PIEX: The garage is the same size. Mr Kelly, who will probably say something, it' s important to him to have two cars. CHAIRMAN GOEHRINGER: Okay. I apologize Mr. and Mrs. I forgot your last name. Would you like to address the Board again? MRS WICKBOLDT: Good evening. This is the first we've seen this, just like yourselves. I have not been able to go back to the property and see how this fits in relationship togour home and what it does. I would like permission to be able to do that and then come back. I don' t know if that' s allowed, but you keep extending, you know. CHAIRMAN GOEHRINGER: Well we have a hearing scheduled, a special hearing scheduled for the 5th of April, I really do not want to put any additional information on it that night. I would like to close it to verbatim testimony that night. So I guess what I ' ll do is I' ll ask the Board if they would recess it until that particular point at which it happens to be a rather lengthy hearing. I assume what we could do - probably is have you come in first thing. Five minutes and rap it up then. That' s what we' ll do, you digest it and you let us know. MRS WICKBOLDT: I just have this one other comment to make because this is really going to be in the front yard just 20 feet off the street. I don't have a garage on my property and either does the gentlemen on the other side. If they get permission to put it in the front like that does that open the door that other people can do the same thing. To me these garages, this is a large double garage. My house is 28 feet long. His house is 23 . the garage will be 23 feet wide, that' s like overpowering. But that' s probably neither here nor there. But what you are doing is, I assume, I can do the same thing, if he' s allowed do it, later on. Not that that' s what I want to do. What you are doing is, is that going to look nice on that lot. I think more importantly is, is the question are we opening up what we refer to as a precedent. In this particular case as I had talked to these people who were here prior, we do definitely have problems with waterfront parcels of property when they become updated from weekend houses to year round houses, or seasonal houses to year round houses. And it certainly has been my preference, and I 'm not speaking for anybody else here to put them in the front yard if a person shows that there is really a unique hardship that they have to have a garage and there is one required. MRS WICKBOLDT: I still don' t understand why they can't put it here. It actually affects nobody. CHAIRMAN GOEHRINGER: We' ll ask him that question, but you' ll come back to us on the fifth after you digest this. MRS WICKBOLDT: Alright. Fine. CHAIRMAN GOEHRINGER: The set back for the house? MR WICKBOLDT: The set back line for the houses or anything on the block is 45 foot? CHAIRMAN GOEHRINGER: It' s either 45 or 50 . Okay. Doug we didn' t discuss that reducing of the side yard on the one side. Maybe Mr. Kelly wants to address that or? CHAIRMAN GOEHRINGER: We had originally, I didn' t know this was detachable. We were asking you to place it over there. I thank you for your proposal, but maybe we missed understood each other at the last hearing. I want to be honest with you, that our court, that the lady that transcribes the minutes has now gotten and I don't think she' s 28 years old has now gotten three gray hairs from trying to deal with that hearing because she didn' t know who was speaking when, and what was going on, so we have to be a little more delicate about that situation. And tonight doesn' t appear to be a problem. I thought that you were going to come back, certainly this is a possibility, but I thought that you were going to come back with the placement of this garage over on this side of the house. Did we misunderstand each other? MR PIEX: No. I understood you said I could go as close as 20 feet to the front and within to ten on either side. So I picked that side for several reasons. One of them that Mr. Kelly is going to say something about, having to do with safety. Because there is a very sharp curve here. Also in response to the Wickboldts, if I put the garage here, they are going to be looking at the garage doors. And I expected that they would prefer to look at. a landscaped shingled structure rather than garage doors. CHAIRMAN GOEHRINGER: Okay, thank you. Mr. Kelly, how do you do? MR KELLY: I think that the first thing I should do is get my wife' s name on the record. Her name is different than mine. The last name is Iannicelli. It' s not an easy name to remember, but the translation is Gate of Heaven. If you think of that it kind of flows very nicely. A couple of points I want to make and just in responses, this is the comments I 've had. This house was a full year round house before we bought it. We have owned it for 10 years. We've lived there primarily during that 10 year period trying to think through ways that we could upgrade to take advantage of the water and what not. When we decided to go forward, we gave the architect and the first thing we did is to take him ' around the property and make it . very clear that we wanted to not interfere with the views of our neighbors towards the water. We made that almost a point at the time factor, to do everything to enhance the views down that way. In terms of Wells Ave, there are a number of garages that are separated from the houses and on the road side as opposed to the water side, so this is not a precedent. Secondly, in terms of the positioning of the garage in the front we had happened to be . The way the lot is set up right now there is a regular driveway and a common driveway and there is also kind of a dirt driveway that goes down to the water on the Wickboldt side of the house. You cannot easily access that driveway without stopping and pausing a long period of time to make sure there are no cars coming around the bend in that road. CHAIRMAN GOEHRINGER: That' s on this side of the house? MR KELLY: Right. In order to have some degree of safety in terms of getting in there you really have to get up to where the current driveway is, otherwise you have a big blind spot. We also have a six year old boy and the last thing I want him doing is coming out into that blind spot on his. bicycle. So that' s the main reason for pushing and talking with Doug about why we want the garage over on that side. It' s a very hazardous corner, and that particular corner also, just the way the road is constructed for some reason people go extremely fast relative to tire squeaking. There are always cars coming around there much too fast scaring the neighbors when they hear it. Scaring us when we hear. If we compound that by in effect blocking some of that view with the garage on the other side of the property, it' s going to make it more of a safety hazard. CHAIRMAN GOEHRINGER: Okay. So you have an objection to having it over on this side? MR KELLY: Yes. A strong one. Because we' ll have to come then in such a way that we are always entering off of a blind spot. People coming from, coming up Wells Ave towards Main Road, don' t get to see that second driveway until they get through the curve. CHAIRMAN GOEHRINGER: Alright. MR KELLY: The only other thing is that if we. . .I understand the Wickboldts need to look at how this thing is in perspective, but we would like to request from our point of view because we would like to move forward on this, rather than keep dragging it out. CHAIRMAN GOEHRINGER: I would dearly love to also. But you must understand that we don' t like to become a intermediary. And I will make the same statement I 've made to people before and that is eight years ago we used to send everybody out, recess for twenty minutes and four years ago we had a fist fight out there and we can' t do that anymore. MR WICKBOLDT: A 45 foot set back for the two car garage gives you enough lead to go to the whole to look left and to look right, it' s not that the garage is like in a city on a sidewalk to back out. Do you understand.? You don't think they are not blocking my view of the sound in the country that' s all taken up: This is the only view I've got left. The south, I only look at the creek. I bought the property, used to put a row boat in there and I hope to put my sailboat in the creek someday. That' s the only view we've got. I didn' t buy it for the Sound view or the Peconic Bay or something. This is the only view right now. And if you do get garages all the way down the whole block like this, like my wife said, the whole look is gone. That's why we have the laws for the set backs. CHAIRMAN GOEHRINGER: I have a copy of a survey dated from Peconic Surveyors P.C. the most recent date is December 20, 1990 which indicates a frame house approximately 65 feet from Jockey Creek and approximately 67 . 4 feet from Wells Ave. However the nature of this application is an accessory garage detached from the main structure. As the nature of the application reads approximately 40' feet although it indicates to me 43 feet from Wells Ave. At the closest point it' s 14 feet 1 inch from what appears to be the north property line. Is there somebody who would like to be heard on behalf of this applicant? MR PEIX: I 'm an architect for the Kellys. We have a building permit which we were granted in the middle of December to reconstruct the main house and also to build a new garage site exactly where it' s shown there.. But in that application, that permit; the garage was shown attached to the house. What the Kelly' s are really asking is that we be given permission to not make the connection so the garage can stand free and separate from the house. We think it will be viewed better from neighboring houses. It will just open up the site a little bit. CHAIRMAN GOEHRINGER: Did you state your name -for the record. ? MR PEIX: Douglas Peix. CHAIRMAN GOEHRINGER: Sorry. Can you tell us the approximate size of the proposed garage? MR PEIX: It' s 23 feet square. It' s a two car garage. CHAIRMAN GOEHRINGER: Ok. And what is the maximum height of that one story structure? MR PEIX: You have it on your plans. It' s going to have I think 700, I gave you elevations. It' s going to have walls that I think are 7 or 8 feet high and it' s is going to have a four pitch roof. CHAIRMAN GOEHRINGER: Right. I noticed that. CHAIRMAN GOEHRINGER: No storage at all because you really can' t get to it. The other is just for storage of vehicles and other assorted? MR PEIX: Cars and lawn stuff. MR PEIX: Only that there are a good number of houses along Wells Ave that have detached garages in similar locations. We do intend and we will comply with the side yard set back requirements that are standard. CHAIRMAN GOEHRINGER: I 'm showing 43 feet. Is that correct? / MR PEIX: We have been told by the Building Department that / we have to set back at least 40 feet and the owner would like V to put it approximately 43 . CHAIRMAN GOEHRINGER: When you say the Building Department you are referring to an established set back at 40 is that what they are saying? MR PEIX: It' s apparently a code requirement on Wells Ave that accessory buildings have to go back that far. MR DINIZIO: It appears to be established. Before I go any further I have a question to ask. Isn' t there suppose 15 foot set back on the side property? He is going to put this 14 feet from the property line? CHAIRMAN GOEHRINGER: I think this is smaller thQp a R-40 zone. I would have to check the. . . MRS WICKBOLT: I was under the impression that it had to be 15 feet. But I could be wrong on that too. CHAIRMAN 'GOEHRINGER: I think it' s 10. MRS WICKBOLT: I could be wrong on that too because I 'm new to the area too. We bought this property with the intention of moving in there and living there for the rest of our lives. CHAIRMAN GOEHRINGER: Just let me get an idea of where you are. Standing in front of the property in question you are to the left? MRS WICKBOLT: To the left. Right. If he puts this garage up I will be looking at this enormous building from my kitchen, from my deck, from every window in part of the house that is facing his property. You will have to bare with me because it looks like I 'm the only one that' s going to speak against anything. . . . . Ed Sigmund. ' So I feel a little bit nervous. I also feel strange coming against a neighbor I have to speak against something that he' s doing. Before they started to lift one hammer I can' t understand why they didn' t decide to put this garage and attach it to the house and build something different that would not be so objectionable. He' s building something that is going to devaluate my property because nobody including myself will want to look at this enormous garage that stands there. It is practically on top of the corner of my property. Maybe my husband has something else he would like to say. I feel like I would like to request that you deny him this. . He tells that they are allowed to build it if they put this little walkway and attach it and that they have already received permission. Did I understand that correct? CHAIRMAN GOEHRINGER: Not to my knowledge. MR PEIX: I have a drawing that will help everybody understand it. I have colored it in so you can see. Do you see the yellow bar on that? It was a like breezeway connection. I was directed by the Building Examiners that as long as it was attached to the house it was considered to be part of the house and therefore it would be acceptable. CHAIRMAN GOEHRINGER: That' s a problem of interpretation to be honest with you. Needless to say if they give you a building permit. f PROBLEM WITH MACHINE)- MRS WICKBOLT: Why didn' t he put a garage over like this? These people, there house is over here. This is where -my house is. Everything that he puts in here is what I 've got to look at. We have a little tiny house. We thought we would move in there and spend our retirement years there. We are not in there yet. We are in the process. MR WICKBOLT: We know the building zone. Nothing can be built there. MRS WICKBOLT: I really was startled to see something like this going up. I understand that they want a larger house. They have a child and everybody has their own architectual designs and what they like. But before they started they should have done what they doing. MR WICKBOLT: There is a starting there I don't know what that is. MRS WICKBOLT: They could have really designed themselves a house that would have not been and I wouldn't have said a word. I can't make you people say that he can' t have it. I 'm requesting that you deny this. To me it' s going to spoil I think he' s even going to, I don't think anybody would buy this house. My house is almost as big as the thing he wants to build. We are a little larger but we are talking about a building that is, anyone that knows this little house. Almost as large as my house, except my house has two stories on it. MR WICKBOLT: People pass by they stop and look at it like CHAIRMAN GOEHRINGER: That' s always the case when a new house is being built. Is there anything you would like to say for the record? MR PEIX: I feel defensive and I would like to explain. how things were done. It' s twice what it was more thb-n twice. It was a ranch and now it' s a real two story volume. Attaching the garage to the house to me architectually would have made the house feel even bigger. So as it' s, are pieces more discreet. The problem is this. My understanding of the set back rules are the side yards have to add up to 35 feet and neither side can be less then 20 feet. That' s what I think it is but we can check. Because of where the house is I couldn' t put any -garage in this zone it' s too close to that property line. I have very few places to put the garage. Essentially here or I could have put it here. If I put it here I block their living room view back to the forest. MRS WICKBOLT: But what you are doing now is giving me a lousy view because and I had a nice view I know I can' t change it. I could see everybody' s front yards until the current changes. Which is your concern about your client' s view. I hope you don' t mind that I 'm discussing this with him. Now what you have done to me. CHAIRMAN GOEHRINGER: We are only doing this because you are the only four here. Normally this not a . . . . MRS WICKBOLT: We should be talking this out between each other. CHAIRMAN GOEHRINGER: I can't wait for this to come down in written form. We are going to get yelled at by the person who is doing this. MR PEIX: They intend to plant and have a growing trellis on the back of the garage. I would like to say that this is going to be one of the most more attractive garages because we just didn' t put double a pitched dog house roof on it. MRS WICKBOLT: On a garage. It' s a garage. CHAIRMAN GOEHRINGER: Just let me explain something. If a person does not choose to add there garage to there house in some way it is clearly stated that the only place that this is going to be able to go is in .the front yard. Certainly we could not put this garage in the rear yard. We are forced with either an affixed attachment to the existing dwelling or in this particular case the modified existing dwelling or the new dwelling because it really is a new dwelling. Or putting it in the front yard area. Most of the houses down there that have garages are attached to the house. There is no question about it. I did look at that particular aspect of it. Being on this Board for 11 years no one has ever,and this has no reflection on you, none at all, no one has every told me that they objected to the existence of a garage in the front yard area for the sole purpose of that type of view. We run into this problem all the time with blocking people' s water views. That is not the case this time. This is the first time I have heard it at this particular time. That does not make any difference, and I 'm not taking anything away from you. I 'm just telling you that that' s where I heard it from. Is there anything that this gentlemen could do if this Board was so inclined to place this building in this area that would make you feel better? Is there any type of screening that would make you feel better? We don't have to complete this application tonight, this gentlemen can still construct his clients house we can reconvene after you think about it, the next meeting. I can see you are very upset about it. We are not here to disrupt anybodies life, we are not here to disrupt. MRS WICKBOLT: I know that. I'm aware of that. Even if you decide, I 'm not going to be angry at you people. I 'm telling you, you sent me a notice, and he is asking for a variance and since I 'm able to say something I 'm telling you why. CHAIRMAN GOEHRINGER: I understand. MRS WICKBOLT: I don't want it there. I 'm going to be honest if he gets this and he puts it there, I probably won't move into that house. Because I think every time that I look out of that window it' s going to drive me crazy. I 'm telling you how I feel. However you have to make your decision. CHAIRMAN GOEHRINGER: Where is the entrance to the garage. MR PEIX: Currently it' s proposed to come in that way. The doors would face the street. We are showing I think two house windows, small divided like windows on this side and another one back there. To make it look. . . . . MRS WICKBOLT: It' s ridiculous because before you started. MR WICKBOLT: I know this could .be changed and it could be attached to the house very nice. I even can design you a house. CHAIRMAN GOEHRINGER: How far is it from the existing house right now? MR PEIX: It' s approximately 15 feet, 10 feet. Let me ask this. I don-It know if you can grant that as an option. That would open up a wider gap for the view that you would like to preserve. MRS WICKBOLT: You can' t because my house sits on an angle like this. I 'm not saying anything. We' ll do what this gentlemen says. We' ll go home and think about it. I just feel that you people and your client' s or who is ever in charge of this is taking a lot upon the other people because you should have gotten permission to do all this before you did this. MR PEIX: We did. We have permission. MRS WICKBOLT: Then go and do it. That is the only other thing I can say. Then do it. How come you don't want to do it that way? If you have permission why are you starting with this? MR PEIX: They want to be friendly neighbors. They didn't do this to be . MRS WICKBOLT: Excuse me. They are never even going to live in there. They' ll live in the city. He told me that. CHAIRMAN GOEHRINGER: We have a problem anyway. We have a problem with the doors opening toward the road. So that is a problem that we have, I have. I don't know if the other Board Members have. We always ask for the doors not to open toward the road. MR WICKBOLT: Should this be a fact of why you have a continuance? CHAIRMAN GOEHRINGER: What I 'm going to ask the architect if he would do, we will reconvene this to the next regularly scheduled. See if there is some other way that you can manipulate this and possibly we can deal with this in a different matter and what ever appropriate screening might be even away from. Nothing is etched in stone at this point. We realize that it' s going to have to go in the front yard area, if it' s not affixed to the house. MRS KOWALSKI: What was the reason over here that it wasn' t able to. There is a driveway here, right? i MR PEIX The set back. See the line. This line if I maintain the required set back from this southern property I can' t push it very close. CHAIRMAN GOEHRINGER: No. We can vary that into the side yard area. I would stay at least 10 feet from the property line. The other problem that we have is with water front parcels that you would be closing up or literally attempting to close up a side yard area. You must at all times leave the other side yard area completely open. MR PEIX: That' s fine. There is a road CHAIRMAN GOEHRINGER: I 'm just mentioning that, so that' s something that you could mention to your client because if there is a anticipation of a swimming pool, whatever the situation is. MR PEIX: How do you feel about us poking into the 40 foot set back. CHAIRMAN GOEHRINGER: I have no problem with that. MR PEIX: You don' t. CHAIRMAN GOEHRINGER: As long as the driveway doesn' t open to that. MR PEIX: How close, how far could I go? How close is too close? CHAIRMAN GOEHRINGER: How close is too close. We have granted them as close as 20 feet. We would rather not go to 20 feet. We would rather keep it between 20 and 30. MR DINIZIO: My personal opinion is I really don't see why he can' t attach it to that house. MR WICKBOLT: I know this fellow could design it. He looks like a very capable architect. MR PEIX: I don' t know at this point. We have a signed contract that' s. It was a surprise when they decided that they really liked it free standing and not attached. Most people, most owners like to have a covered connection to the garage, but they didn' t care about that. MRS WICKBOLT: That' s interesting you know because he has this he has permission to move this. MR PEIX: The garage doors on this face you and that' s what you are going to be looking at all the time. MRS WICKBOLT: I ' ll go back and look at it but I doubt, because it' s going to be set away. He' s going to have a front yard here. MR PEIX: Right. Driveway. If you are going in this way you are going to have a big driveway turn around. MRS WICKBOLT: I 'm hoping he' ll landscape some of it. Later on this goes around the corner and somebody builds an attached garage there. MRS WICKBOLT: I stood there now for the last three weeks -.and positioned myself in all different ways.
