Gillispie, Jr., Chairman Robert Bergen Herbert Rosenberg Charles Gregonis,Jr. Serge Doyen, Jr. MINUTES Southold Town Board of Appeals September 24, 1959 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursday, September 241- 1959, at the TOM Clerk's Office., Main Road, Southold, New York. There were present: Messrs® Robert W. Gillispie' Jr. , Chairman' Robert Bergen, Herbert Rosenberg' and Charles Grigonis, Jr. Also present: Mr. Howard M. Terry, Building Inspector. Absent: Mr. Serge Doyen, Jr. PUBLIC HEARING: 7:30 PeM.2 Appeal No. 217 - Upon appli- cation of Lewis N: Griffin, Bay Avenue, Mattituck, New York, for a special exception in accordance with the -Zoning Ordinance, Article IVt Section 4009 Subsection 9, for permission to use and maintain premises as a public garage. Location of property: Mattituck New York bounded north by Sound Avenue, east by Pacific Street, south by now'or formerly of Clara Ben 'amin and west by now or formerly of S. B. Hamilton. Fee paid 15.06. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper® Southold Town Board of Appeals September 2)+9' 1959 CHAIB M-. Is thereanyonp ,present who wishes to speak for this, application? Mr. Lewis N. Griffin, Mattituck9 New York9 stepped forward and_'stated he appeared for the application and would answer any questions the Board might have. Mr. Griffih was requested 'to amend 'his application to eliminate all reference to a gasoline service station on his application for a public garage since he w*as making separate application for the public garage.. . Mr. Griffin agreed to do same. CHAIRMAN: Is there anyone else present who wishes to speak for this application? Is there anyone present who wishes to speak against this application? Are .there Any questions any members of the Board would like to- ask. Mr. Griffin? (No one wished to speak.) Resolution was offered by Mr. Gillispie9 seconded by Ire Bergen and carried9 V AS. application of Lewis No Griffih9 having been considered at Public Hearing No.. 217 on September 21+, 1L959, and the 'Board finding that the public convenience and welfare and justice will- be served and the legally estab- lished or permitted i.se - of. neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be observed, therefore be it BBSOLVLT that the application be granted for a public garage subject to the following conditions: 1. No major repair work shall be performed in the open. 2. Pumps, lubricating and other devices shall be located at least fifteen (15) feet from the line of any street or high- way, right-of-way or - property line. 3, All fuel oil or similar substances shall be stored at least , fifteen (15) Feet distant from any street or lot line. �+. No automobiles, or automobile parts'9 .dismantl.ed or damaged .vehicles and similar articles shall be stored in the open and no parking of vehicles other than those being serviced shall be permitted except in the case of wrecks which are towed on the premises; the operator of this service station shall have three (3) months in which to dispose of these damaged vehicles or shall place them indoors. 5. Signs to be in accordance with Article IV' Section 408 ;of the Building Zone Ordinance of the To-tm of Southold Southold Town Board of Appeals. - ' September 24, 1959 Permission is denied, under this, application for the operation of a gasoline service station an application having been made separately for this. The following words shall be elminiated from the application No. '217 referring to gasoline service station®_ Line 29 paragraph 1. .- ettiao gasoline pumps." Griffin2' Bay Avenue, Mattituck, New York, for, a special exception in accordance with the Zoning Ordinance, 4rticle IV, Section 400' Subsection 92 for permission to use and maintain premises as a gasoline service station in conjunction with the public garage. Location of property-. Mattituck, New York, bounded north by Sound .Avenue, east by Pacific Street, south by now or formerly of Clara Benjamin, and west by now or . formerly of S. B.. Hamilton. Feb paid- $15®CO. . The Chairman opened the hearing by reading application for a special .exception, legal. notice . of hearing, and affidavit attesting to its publication in the official newspaper. CHAIRMAN.® Is there anyone present who wishes to speak for this application? Mx. Lewis N. Griffin stepped forward- and stated he would answer any questions the Board .might haven Mr. Howard Teary, Building Inspectdr 9 explained to the Board the map appearing in the file and gave the location of the property and proposed garage® CHAIRMAN: How big is the building going to be, Mr. Griffin? MR. GRIFFIN 50 ft. by 60 ft. CHAIR14AN-0 What are you going -to service in particular? Mfi. GRIFFIN® It will, be a public garage for trucks. CHAIMM. What type of construction will the garage be of? MR, GRIFFIN® Cement block. There will be three doors on Pacific Street and one on Sound Avenue. Southold Town Board of Appeals September �49 1959 CHAIRMAN: How close is the nearest school? MR. GRIFFIN: At least a mile. CHAIRMA.Ns How big a parking area will you. have? - MR. GRIFFIN: It will. be 60 b. ; 11+8 in front and the property goes back about 500 feet. There is over an acre. The Chairman then read the five conditions imposed when granting service station applications, ' CHAIRMAN: How far will the fuel tanks be from the property lines? IvMo GRIFFIN: .About 50 ft. from Sound. Avenue and about 30 ft® from Pacific Street. CHAIRMAN-. .Are there any other questions anyone wishes to ask' Mr® Griffin? Is there anyone . present who wishes to speak against this .application? (No one wished to speakq,) CHAIRMAN: What do you think is a reasonable length of time to allow wrecks to remain on the property? MR. GRIFFIN I would say three months® (Mr. Griffin ?,rent on to explain the procedure concerning wrecked carsv the length of time it takes the insurance companies to settle claim ' etc®) The 'Board' also discussed with Mr. Griffin a suitable location on his property for placing the wrecked cars. Three months was the period of time agreeable to Mr.o Griffin and the Board of Appeals for holding wrecked cars before disposing of theffib Resolution was offered by Mr. Bergen9 seconded by Mr. Grigonis ,and carried' WHEREAS application of T#e4is N. Duck Point Motel, Depot Lane, Cutchogue, New York, -for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 11, for permission to erect and maintain a directional advertising sign on the property of Mrs. Hull S. Chew, southeast side Main Road, Laurel, New York. Fee paid '$15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper. CHAIRMAN. Is there anyone present who wishes to speak .for this application? Nam. F. J. -ROSSIO I -don't think we have enough directional signs on Route 25. There is one in Cutchogue and nothing between Cutchogue and Riverhead, and to catch the public traveling east- erly we need another inbetween. The sign will, be a directional arrow like the one on Depot Lane. It will be located before the other signs, approximately 100 to 150 feet- past the property line, about half way inbetween the Mattituck motel sign and the gas station. After further discussion as to the location of the proposed sign, Resolution was offered by Mr. Bergen, seconded by Mr. Grigonis, and carried, WHEREAS application of-F. J. Rossi, having been con sidered at Public Hearing No. 219 on September 24, 1959, and the Southold Town Board of .Appeals ' September 24, 1959 Board finding that the public convenience and welfare and justice will be served and the legally esteabl.ished .or permitted use of neighborhood property will not 'be substantially or permanently injured and the spirit of the Ordinance will be observed, ther&- fore be it RESOLVED that the application be granted as requested with the following stipulations the sign is to be no closer than five (5) feet to any property 1ine and approximately midway between the property of the. Long Isl.and ' Ice Corp. on the west and the present Mattituc.k Moi1 sign on the east, Permission is granted for a directional arrow and is good until revoked. Vote of the Board: .yes®- Mr. Gillispie, Mr® Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of the Meeting of September .17, 1959, on motion of Mro Grigonis, seconded by Mr. Rosenberg and carried, were approved as submitted. Vote of 'the Board® Ayes®- Mr. Gillispie, Mr. Bergen, Mr; Rosenberg, and Mr. Grigonis. By resolution offered by Mr. Rosenberg, seconded by Mr. Bergen and carried, 7®3 0 P.M. John Gada., a/c ,Alexander Robinson, Private Road, Estates Section, Fishers Island, New York, for a variance in accordance with the Zoning Ordinance, ,Article 1112 Section 300, Subsectioh .72' for permission to locate private garage with reduced setback. Vocation of property, north side private road, Fishers Island Estates, Fishers Island, New ' York, bounded north .by Fishers Island Sound, east by Pierre S. DuPond 3rd, south by Fishers Island Estates, and west by Van Horn Ely. Vote of the Board® Ayes- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. It was further RESOLVED that Legal notice of hearing be published in the official newspap ear The Suffolk Times, on date of 0ct6ber 27 1959, and the New L ond�on Day on or about the same dated Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis® .Southold. Town Board of Appeals September 21+1 1959 The Board of Appeals discussed and approved the follow- ing addition to the recommended procedure to be followed by applicants seeking directional signs: "In the interest of clarifying the suggested .procedure for applicants seeking directional signs , it is the determination of the Board that the maximum sign permitted for directional advertising of a motel or' restaurant is interpreted 4s being 12 fto 6 in, by 6 ft. 6 in. , and not to exceed 50 sq. ft. in area."
